AMENDMENT TO THE PRELIMINARY PLAN FOR THE MCAS
TUSTIN REDEVELOPMENT PROJECT, AUTHORIZING THE
PREPARATION OF THE PRELIMINARY REPORT, AND
AUTHORIZING THE TRANSMITTAL OF INFORMATION TO
TAXING AGENCIES AND OFFICIALS.
SUMMARY
Amendment of the Preliminary Plan for the MCAS Tustin Redevelopment Project is
necessary for modifying proposed Project Area boundaries to delete territory in the City of
Irvine and other acreage outside of former MCAS Tustin.
RECOMMENDATION
Staff recommends approval of Resolution No. RDA 02-4 apProving the Amendment to
the Preliminary Plan for the MCAS Tustin Redevelopment Project and authorizing and
directing the transmittal of information required by Sections 33327 and 33328 of the
Health and Safety Code.
FISCAL IMPACT
The Agency's 2002-03 MCAS Tustin budget fund anticipated costs anticipated for
processing this Preliminary Amendment and activities associated with creation of the
MCAS Tustin Redevelopment Project Area.
BACKGROUND/DISCUSSION
The Preliminary Plan for the MCAS Tustin Redevelopment Project ("Project") was
considered and adopted by the Tustin Planning Commission by Resolution No. 3544 on
September 8, 1997. Resolution No. 3544 also established the boundaries for the
Project. On December 9, 2002, the Tustin Planning Commission adopted Resolution
No. 3856, which approved an Amendment to the Preliminary Plan and amended the
boundaries of the Project. The Resolution also authorized the submission of the
Amendment to the Preliminary Plan to the Tustin Community Redevelopment Agency
(the "Agency"). The Amendment to the Preliminary Plan deleted the portion of the
former MCAS Tustin (the "Base) in the City of Irvine and also deleted approximately 48
acres of the authorized 52+/- acres of territory permitted by state law outside of the
boundaries of the former MCAS Tustin.

Pursuant to Section 33327 of the California Redevelopment Law (Health and Safety
Code), upon receipt of the Preliminary Plan, the Agency must transmit specific
information to the taxing officials (i.e. the auditor, assessor, County tax collector, and
governing bodies of local agencies that receive a portion of property taxes) and the
State Board of Equalization. The information to be transmitted includes: (1) a
description of the boundaries of the proposed Project Area; (2) a statement that a plan
for the redevelopment of the Project Area is being prepared; and (3) a map indicating
the boundaries of the proposed Project Area. After the adoption of the Preliminary Plan,
if the boundaries of the Project Area are changed, the Agency is required to notify the
taxing officials and the State Board of Equalization within 30 days by transmitting a
description and map indicating the boundary changes made.
Pursuant to Section 33328 of the Health and Safety Code, the Agency is required to
advise the taxing agencies and the State Board of Equalization of the last equalized
assessment roll it proposes to use for the allocation of taxes. In turn, the County
officials charged with the responsibility of allocating taxes under Sections 33670 and
33670.5 must prepare and deliver to the Agency and the taxing agencies a report that
provides specific information regarding assessed valuation and tax revenues describe in
Section 33328 of the Health and Safety Code.
By adopting Resolution No. RDA 02-4, the Agency will approve the Amendment to the
Preliminary Plan and authorize and direct the transmittal of the information required by
Sections 33327 and 33328 of the Health and Safety Code to the taxing agencies and
State Board of Equalization.

A RESOLUTION OF THE TUSTIN COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING THE AMENDMENT TO THE
PRELIMINARY PLAN FOR THE MCAS TUSTIN
REDEVELOPMENT PROJECT
The Tustin Community Redevelopment Agency DOES HEREBY RESOLVE as
follows:
The Tustin Community Redevelopment Agency finds and determines as follows:

By Resolution No. 3856 adopted on December 9, 2002, the Planning
Commission of the City of Tustin amended the boundaries of the MCAS Tustin
Redevelopment Project (the "Project"), approved an Amendment to the
Preliminary Plan for the Project and submitted said Amendment to the
Preliminary Plan to the Agency;
NOW, THEREFORE, the Tustin Community Redevelopment Agency resolves as
follows:

The Amendment to the Preliminary Plan for the MCAS Tustin Redevelopment
Project, as formulated and approved by the Planning Commission of the City
of Tustin by Planning Commission Resolution No. 3856, attached hereto as
Exhibit I is hereby received and approved.
Pursuant to Section 33328.3 of the Health and Safety Code, the Executive
Director of the Agency is hereby authorized and directed to file the information
required by Health and Safety Code Sections 33327 and 33328 with the
appropriate taxing officials, taxing agencies and State Board of Equalization.
The Tustin Community Redevelopment Agency does hereby determines that
the 2002-03 assessment roll is the Base Year Assessment Roll the
Redevelopment Agency proposes to use for the allocation of taxes pursuant to
Section 33670 of the Community Redevelopment Law.
The Executive Director of the Tustin Redevelopment Agency is hereby
authorized and directed to transmit a map and a description of the amended
boundary of the Project Area, a statement that a plan for redevelopment of the
area is being prepared, and advice of the base year assessment roll which the
Tustin Community Redevelopment Agency proposes to use for the allocation
of taxes pursuant to Section 33670 of the Community Redevelopment Law, to
the taxing officials and agencies, and to the State Board of Equalization, in the
form and manner required by law.

The Executive Director of the Tustin Redevelopment Agency is hereby
authorized to pay to the State Board of Equalization and the Orange County
fees for filing and processing said statement and map as may be required
pursuant to the Community Redevelopment Law.

In the event the 2002-03 Base Year Assessment Roll is not captured, the
Tustin Redevelopment Agency designates the 2003-04 assessment roll as the
Base Year Assessment Roll proposed to be used for the allocation of taxes
pursuant to Section 33670 of the Community Redevelopment Law, and the
Executive Director is authorized and directed to notify the taxing officials,
affected taxing agencies, and the State Board of Equalization of the change in
base year assessment rolls.

RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN AMENDING THE BOUNDARIES
OF THE MCAS TUSTIN REDEVELOPMENT PROJECT
AND APPROVING AN AMENDMENT TO THE
PRELIMINARY PLAN.
The Planning Commission does hereby resolve as follows:
1. The Planning Commission finds and determines as follows:

That by_ Resolution No. 3544, adopted on September 8, 1997, the
Planning Commission of the City of Tustin (the "Planning
Commission") selected and designated the existing boundaries of
the MCAS-Tustin Redevelopment Project (the "Project") and
approved a Preliminary Plan (the "Preliminary Plan") for the Project.

The Agency has proposed to amend the boundaries of the Project
Area to exclude territory (the "Excluded Area") as delineated in the
"Map of the Excluded Area," attached hereto as Exhibit A and
incorporated herein by reference.
C,
The Planning Commission finds that it is in the public interest to
amend the Preliminary Plan in order to amend the boundaries of
the Project Area to exclude the Excluded Area.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
TUSTIN DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission hereby amends the boundaries of
the Project to exclude the Excluded Area. In the 'event it is necessary for
clarification purposes to make' minor, technical changes to the boundaries
described in Exhibit A, which changes do not add or subtract area, the Planning
Commission hereby finds and determines that any such minor, technical change
for clarification purposes does not materially affect the boundaries selected and
designated hereby for the preparation of the official Redevelopment Plan for the
Project.
Section 2. The Planning Commission hereby approves the Amendment
to the Preliminary Plan (the "Amendment to the Preliminary Plan") for the Project
in the form attached hereto as Exhibit B and incorporated herein by reference.

Section 3. The Chairman of the Planning Commission is hereby
authorized and directed to submit the Amendment to the Preliminary Plan to the
Tustin Community Redevelopment Agency.

AMENDMENT TO THE
PRELIMINARY PLAN FOR THE
MCAS-TUSTIN REDEVELOPMENT PROJECT
The Preliminary Plan for the MCAS-Tustin Redevelopment Project (the
"Preliminary Plan") is hereby amended as follows:
1. The first paragraph of the Introduction section is hereby amended
to read as follows:
This is the Preliminary Plan (the "Preliminary Plan") for the MCAS 'Tustin
Redevelopment Project (the "Project"). The area within the Project (the "Project
Area") includes all property within the Tustin Marine Corps Air Station which is
located in the City of Tustin (the "MCAS Property") and certain property outside
the Tustin Marine Corps Air Station which is located in the City of Tustin (the
"Tustin Property").
2. Section III shall be amended to read as follows:
As a basis for the redevelopment of the prOject Area, it is proposed that, in
general, the land uses in the Project Area shall be residential, commercial,
industrial and public uses as shall be permitted bY the MCAS-Tustin Specific
Plan/Reuse Plan. All of the property is regulated now by the Specific Plan and
as permitted by the General Plan of the City of Tustin for the other areas located
within the Tustin Property (the "Applicable Plans").
3. Substitute in place of the Map of the Project Area, Exhibit A to the
Preliminary Plan, the Revised Map of the Project. Area, attached hereto as
Attachment No. 1.
4. All references in the Preliminary Plan to the Project Area shall
mean and refer to the area shown on the Revised map of the 'Project Area.
5. Delete the Legal Description of the Project Area, ~Exhibit B to the
preliminary Plan, and all references thereto in. the Preliminary Plan.
