Binsack, Zoning Administrator PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: None PUBLIC HEARING: 1. CONDITIONAL USE PERMIT 2014 -07: A request to operate ancillary scuba instruction in conjunction with an existing wholesale and online scuba store. APPLICANT: TIM LAU 2600 WALNUT AVENUE, SUITE F TUSTIN, CA 92780 PROPERTY OWNER: PROJECT LOCATION: ENVIRONMENTAL STATUS: RECOMMENDATION: TUSTIN BUSINESS CENTER, LLC 1400 QUAIL STREET, SUITE 105 NEWPORT BEACH, CA 92660 2600 WALNUT AVENUE, SUITE F THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 14 -003 approving Conditional Use Permit (CUP) 2014 -07 to operate ancillary scuba instruction in conjunction with an existing wholesale and online scuba equipment shop located within an existing 1,800 square foot tenant space at 2600 Walnut Avenue, Suite F. Zoning Administrator Action Agenda June 30, 2014 Page 2 The Zoning Administrator called the meeting to order. It was noted that there were no members of the public present to express public concerns. The Zoning Administrator stated she had reviewed the staff report and conditions of approval and had no concerns at this time. The Zoning Administrator asked the consultants for the applicant if they had reviewed the conditions of approval and understood them. The public hearing was opened at 10:31 a.m. The consultants for the applicant, Clark Skinner, and Mike Yao were present. Mr. Skinner and Mr. Yao stated they reviewed the conditions of approval and had no questions or concerns at this time. The public hearing closed at 10:34 a.m. The Zoning Administrator approved Zoning Administrator Action (ZAA) 2014- 003 thereby approving Conditional Use Permit 2014 -07. 2. USE DETERMINATION 2014 -01, CONDITIONAL USE PERMIT 2014 -05 AND DESIGN REVIEW 2014 -004: A Use Determination to allow pet stores, as conditionally permitted uses, within the Retail Commercial (Cl) zoning district, authorize a pet store use within an existing 11,550 square feet tenant space and approve an exterior fagade modification. APPLICANT: KEITH GLASSMAN GPA INC. 1309 POST AVENUE TORRANCE, CA 90501 OWNER: TUSTIN HEIGHTS S.C. LP. C/O KIMCO REALTY CORP. 23 MAUCALY IRVINE, CA 92618 PROJECT LOCATION: 1192 IRVINE BLVD. ENVIRONMENTAL STATUS: THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. Zoning Administrator Action Agenda June 30, 2014 Page 3 RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 14 -004 approving Use Determination 2014 -01 determining that pet stores are similar conditionally permitted uses within the Retail Commercial (Cl) zoning district and approve Conditional Use Permit 2014 -05 and Design Review 2014 -004 to establish a pet store with fagade modifications, located in an existing 11,550 square -foot tenant space at 1192 Irvine Blvd. The Zoning Administrator called the meeting to order. It was noted that there were no members of the public present to express public concerns. The Zoning Administrator stated she had reviewed the staff report and conditions of approval and had no concerns at this time. The Zoning Administrator asked the project manager for the applicant if he had reviewed the conditions of approval and understood them. The public hearing was opened at 11:00 a.m. The project manager for the applicant, Spencer Regnery, was present. Mr. Regnery stated he reviewed the conditions of approval and had no questions or concerns at this time. The public hearing closed at 11:03 a.m. The Zoning Administrator approved Zoning Administrator Action (ZAA) 2014- 004 thereby approving Use Determination 2014 -01, Conditional Use Permit 2014 -05 and Design Review 2014 -004. REGULAR BUSINESS: None ADJOURNMENT: 11:03 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
