SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR PEPPERTREE PARK
BOCCE BALL COURTS (CIP NO. 20073)
SUMMARY:
The construction of the Peppertree Park Bocce Ball Courts is complete and the project
is ready for acceptance and filing of the Notice of Completion.
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution No. 14 -54 accepting the Peppertree Park Bocce Ball Court
Improvements (CIP No. 20073), and
2. Authorize the City Clerk to file the Notice of Completion with the County
Recorder's office.
FISCAL IMPACT:
The Peppertree Park Bocce Ball Courts Project was included in the Capital
Improvement Program (CIP) for Fiscal Year 2013 -2014. A combination of Community
Development Block Grant (CDBG) Funding and Park Development Funds (131) were
utilized to complete this project. The final cost of the project was $128,737.02.
CORRELATION TO THE STARTEGIC PLAN:
This project addresses Goal A of the City of Tustin Strategic Plan regarding Economic
and Neighborhood Development. Specifically, it relates to Strategy #6, the Peppertree
Bocce Ball Courts will expand the recreational opportunities for Tustin.
BACKGROUND:
The Community Services Commission identified the construction of the Peppertree Park
Bocce Ball Courts as a priority during the FY 2013 -2014 Capital Improvement Program
(CIP) workshop.
The improvements of the Peppertree Park Bocce Ball Courts will allow Bocce Ball
enthusiasts of all ages to pursue the activity on high - quality courts. Improvements
included: two concrete courts with synthetic turf, decorative paver walkways, seating
areas, adjacent courtyard repairs and landscaping, and irrigation improvements.

The project was completed on August 29, 2014. The City has retained 5% of the contract
amount, which will be released no sooner than 35 days after the recordation of the Notice
of ompletion ith4the County Recorder's Office.

RESOLUTION NO. 14 -54
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
CALIFORNIA ACCEPTING THE WORKS OF PUBLIC IMPROVEMENT
AND AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE PEPPERTREE PARK BOCCE BALL COURTS
(CIP NO. 20073)
WHEREAS, Ted Enterprises, having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the Project Manager has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
work and improvement should be filed and payment of the balance due said contractor
authorized in accordance with the contract documents;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public work and improvement be accepted, and the same is hereby accepted.
Said public work and improvement is more particularly described as follows:
Peppertree Park Bocce Ball Courts
CIP No. 20073
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 16th day of September 2014.
