REGULAR MEETING OF THE CITY COUNCIL CITY OF TUSTIN, CALIFORNIA AUGUST 19, 1996 CALL TO ORDER/PLEDGE OF ALLEGIANCE The meeting was called to order by Mayor Worley at 7:01 p.m. at the Council Chambers, 300 Centennial Way, Tustin, California. The Pledge of Allegiance was led by Councilmember Doyle. INVOCATION ,The Invocation was given by Rev. Henry Sellers, First Baptist Church of Tustin. Development Beverley White, Deputy City Clerk Dave Gottlieb, Redevelopment Project Manager Approximately 50 in the audience COUNCILMEMBER POTTS' FIVE-YEAR SERVICE AWARD Mayor Worley presented Councilmember Potts his five-year service award; stated he had worked tirelessly for the past five years and had a talent for persevering; noted items he had supported including campaign reform, recreation activities, youth facilities, additional parks, redevelopment, and senior housing; commented on the sacrifices each Councilmember must make when they assume public office; and stated that Councilmember Potts had made Tustin a better place to live and work. Councilmember Potts accepted the award; stated it was satisfying to achieve results for the community, and noted those results were accomplished by a collective effort by Council. ORANGE COUNTY VECTOR CONTROL BY FABIE COMBS Fabie Combs, Orange County Vector Control trustee, reported that Vector Control was a countywide district governed by a Board of Trustees; explained Vector Control's function; stated that educational programs and information brochures were available to the public; announced per parcel benefit assessment reductions; and thanked Council for allowing her to serve on the Board of Trustees. PROCLAMATIONS FORMER CULTURAL RESOURCES ADVISORY COMMITTEE MEMBER AUDREY HEREDIA Mayor Worley read and presented a proclamation to Audrey Heredia, former Cultural Resources Advisory Committee Member. Audrey Heredia stated that it had been a pleasure and privilege to work on the Cultural Resources Advisory Committee; noted she would continue her involvement with the Committee and Old Town; thanked CITY COUNCIL MINUTES Page 2, 8-19-96 Council for the proclamation; and noted her business, the McCharles House, was depicted on the proclamation's art work. FORMER PLANNING COMMISSIONERS MARJORIE KASALEK AND NAN LUNN Mayor Worley read and presented proclamations to Marjorie Kasalek and Nan Lunn, former Planning Commission Members. Marjorie Kasalek thanked Council for the proclamation; stated it — had been a rewarding experience to serve on the Planning ' Commission; remarked on residing in Tustin for 20 years; and commended Council, the Planning Commission, and staff. Nan Lunn thanked Council for the opportunity to serve on the Planning Commission; stated she had enjoyed working with the Commissioners, Council, and staff; thanked Council for their interest in South Tustin; and noted she would continue to reside in the City. RETIRED CANINE UNIT: OFFICER ARRANTS AND CANINE BRIT Mayor Worley read and presented proclamations to Officer Keith Arrants and Canine Brit for their service to the community, and honoring Brit's retirement. Officer Arrants thanked Council for supporting the Canine Program and stated it had been a pleasure to have been a part of the program. Councilmember Potts commented on how agencies utilized each other's canine units; commended the program; and noted Officer Arrants' and Brit's numerous arrests. PUBLIC INPUT REGISTER NEWSPAPER ARTICLE George Jeffries, City Treasurer, commented on a recent article in the Register newspaper reporting inaccurate and misleading information regarding the City's finances; explained the City's operating fund and securities; and emphasized that Tustin was financially stable. Council/speaker/staff discussion followed regarding that investments were not made to balance the City's budget; City securities had been purchased prior to the County of Orange bankruptcy; the newspaper article's misrepresentation of the City's finances and non disclosure; and the advantages of portfolio management. OLD TOWN REDEVELOPMENT The following members of the audience spoke regarding the Downtown Business Association's request for support of promoting Old Town redevelopment by waiving all City fees, reducing property taxes, and authorizing grant funding for a marketing program: Rick Boufford, The Black Sheep Bistro Doug Prescott, 18201 Von Karman Ave., Irvine Tom Anderson, 725 El Camino Way, Tustin Bill Moses, Anchor Printing Greg Bennett, Bennett Architects Mayor Worley stated that Council supported downtown businesses and redevelopment efforts. William Huston, City Manager, stated that this item would be agendized at the September 3, 1996 Council meeting. HOMEOWNERS COMPLAINTS Jane Anderson, Sevilla Homeowners Association, reported on complaints received from homeowners in the Sevilla development regarding numerous rats and pigeons in the area. CITY COUNCIL MINUTES Page 3, 8-19-96 Councilmember Saltarelli responded that installation of wire screening covering roof eaves would alleviate pigeon nesting. Councilmember Doyle stated that Orange County Vector Control would respond to the rat problem free of charge. PUBLIC HEARING (ITEM 1) ►••+1. PLACING ASSESSMENTS FOR SOLID WASTE COLLECTION ON THE 1996-97 TAX ROLL Mayor Worley opened the public hearing at 7:55 p.m. There were no speakers on the subject and the public hearing was closed. It was moved by Saltarelli, seconded by Thomas, to adopt the following Resolution No. 96-81, placing charges for solid waste collection on the tax roll for fiscal year 1996-97: RESOLUTION NO. 96-81 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 5473 ET SEQ. OF THE HEALTH AND SAFETY CODE OF THE STATE OF CALIFORNIA, APPROVING AND ADOPTING A REPORT RELATIVE TO PARCELS OF REAL PROPERTY RECEIVING SOLID WASTE COLLECTION SERVICES, DETERMINING THE CHARGES FOR SOLID WASTE COLLECTION TO BE ASSESSED AGAINST THE RESPECTIVE LOTS OR PARCELS OF LAND AS THEY APPEAR ON THE CURRENT ASSESSMENT ROLL Motion carried 5-0. 400-10 CONSENT CALENDAR (ITEMS 2 THROUGH 9). It was moved by Thomas, seconded by Potts, to approve the Consent Calendar as recommended by staff. Motion carried 5-0. �2. APPROVAL OF MINUTES - AUGUST 5, 1996 REGULAR MEETING Recommendation: Approve the City Council Minutes of August 5, 1996. 3. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $863,209.74 and ratify Payroll in the amount of $341,846.41. 380-10 360-82 4. PROFESSIONAL SERVICES AGREEMENT FOR DESIGN OF NEW MAIN STREET WELL NO. 4 (PROJECT NO. 600103) Recommendation: Authorize the Mayor and City Clerk, subject to final City Attorney approval, to execute an agreement with Richard C. Slade & Associates for hydrogeologic services for the design of the sub -surface facilities for the new Well No. 4 at the Main Street site as recommended by the Public Works Department/Water Services Division. 400-10 5. AWARD OF CONTRACT FOR WATER MAIN REPLACEMENTS, CITY PROJECT NOS. 600125, 600126 AND 600128 Recommendation: Award a contract for the subject project to G. R. McKervey, Inc. of Santa Ana, California, in the amount of $443,234.00 as recommended by the Public Works Department/Water Services Division. 400-45 6. RESOLUTION NO. 96-86 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR WATER MAIN REPLACEMENT ON LINDA LANE/LAURIE LANE/LAURINDA WAY, ON CLARISSA LANE, AND ON ARBOLADA WAY/FIESTA WAY (CITY PROJECT NO. 600123) AND ON NORWOOD PARK PLACE (PROSPECT TO LIVINGSTON), ON BIGELOW PARK DRIVE, ON LIVINGSTON STREET, ON KIRK AVENUE/DALL LANE/NORWOOD PARK PLACE, AND ON HOLT AVENUE (CITY PROJECT NO. 600124), AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 96-86 approving plans and specifications and authorizing advertisement for bids for the subject project as recommended by the Public Works Department/Water Services Division. 400-45 7. AGREEMENT BETWEEN IRVINE UNIFIED SCHOOL DISTRICT AND CITY OF TUSTIN, AS THE LOCAL REUSE AUTHORITY FOR MCAS, TUSTIN Recommendation: Approve an agreement between the City of Tustin CITY COUNCIL MINUTES Page 4, 8-19-96 and the Irvine Unified School District regarding transfer of a school site and other mitigation measures as recommended by the Assistant City Manager. 400-10 8. AGREEMENT WITH CALIFORNIA HIGHWAY PATROL/COURT LIAISON SERVICES Recommendation: Approve the contract authorizing the City of Tustin to continue to perform the court liaison duties for the Santa Ana office of the California Highway Patrol as recommended by the Police Department. 400-10 9. PLANNING COMMISSION ACTION AGENDA - AUGUST 12l 1996 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of August 12, 7-996. 120-50 REGULAR BUSINESS (ITEMS 10 THROUGH 11) 10. NAME ALTERNATIVES FOR 14722 NEWPORT AVENUE - NEWPORT FAMILY AND YOUTH CENTER Mike Henley, Director of Community Services, reported that development of the Newport Family and Youth Center was proceeding rapidly; the contractor had mobilized on site and demolition was scheduled within the week; choosing a name for the center was necessary; TAFFY name selections had been forwarded to the Parks and Recreation Commission; and the Commission's recommendation of two name alternatives for Council approval. Council discussion followed that South Tustin Neighborhood Center did not clearly represent the center's location; Newport -Sycamore and Newport Youth and Family Center indicated the location of the center; including Newport in the name could create confusion with the city of'Newport Beach; incorporating Tustin in the name; and continuing the item for further discussion. Council concurred to continue this item to the September 3, 1996 Council meeting. 930-40 11. HERITAGE WAY NEIGHBORHOOD PARR - PROJECT NO. 400042 AUTHORIZATION TO PROCEED Mike Henley, Director of Community Services, reported staff was requesting authorization to begin the design and development process by advertising for Request for Qualifications (RFQ) for Heritage Way Neighborhood Park. Councilmember Saltarelli stated that this project was a priority; conceptual design work for this park had been initiated; and utilizing the same contractor, RJM Design Group, designing the Tree Park would expedite the process. Mayor Worley noted the projected park opening was July 1998 and in order to accelerate park construction, she supported negotiating with RJM Design Group for park design. Councilmember Potts stated The Irvine Company had completed designs for the park and those drawings could be used to start the process; and a 1998 completion would provide adequate time to pay for the park. William Huston, City Manager, said accelerating the project could best be achieved during park design with a professional services agreement; RJM Design Group had been through the qualification process and was currently working on the Tree Park; Council could negotiate a contract with RJM in order to expedite the process; and a rough conceptual plan for the park did exist. Council/staff discussion followed regarding the existing conceptual plan was designed for a 5 -acre park; the same company designing the Tree Park and Heritage Way Neighborhood Park would expedite the review process; The Irvine Company was obligated to contribute $200,000 to this project; funding was available to begin the project; park grading; and park construction must be CITY COUNCIL MINUTE. Page 5, 8-19-96 advertised for bids. It was moved by Thomas, seconded by Potts, to authorize negotiations with RJM Design Group for park design services. Motion carried 5-0. 920-35 PUBLIC INPUT - None OTHER BUSINESS/COMMITTEE REPORTS REGISTER NEWSPAPER ARTICLE Councilmember Saltarelli thanked George Jeffries for addressing the Register article; and he objected to the misrepresentations printed in the article. POLICE DEPARTMENT'S GANG UNIT Councilmember Doyle commented on the success of the Police Department's gang unit and removal of gang members from the streets. POWER FAILURE Councilmember Doyle noted that as a result of the recent black out, Southern California Edison was re-evaluating their computer software to avoid future power outages. Councilmember Potts stated that during power outages, vehicles must stop at intersections and yield to vehicles on their right. REPUBLICAN CONVENTION Mayor Pro Tem Thomas remarked on his attendance at the Republican Convention; and noted only one speaker addressed issues at the local level. ORANGE COUNTY FIRE AUTHORITY REPRESENTATIVE Mayor Worley announced she would replace Councilmember Saltarelli as the City's Fire Authority representative. TUSTIN UNIFIED SCHOOL DISTRICT SUPERINTENDENT Mayor Worley noted she had met with the new school superintendent, Dr. George Mannon, and was encouraged by his ideas and believed the City would have an excellent working relationship with him and the school district. MARINE CORPS AIR STATION, TUSTIN CLOSURE Mayor Worley reported on a meeting with the military regarding the Tustin Base closure which was scheduled to occur on July 31, 1999. COAST GUARD HOUSING/BASE REUSE PLAN Mayor Worley reported that a decision had not been reached on Coast Guard housing upon base closure, but stated the City would proceed with the Base Reuse.Plan. CLOSED SESSION Mayor Worley announced that the City Council would convene in closed session to confer with the City Attorney about matters of pending litigation regarding W. D. Franks vs. City of Tustin WCAB Case No. AHM0040436. CITY COUNCIL MINUTES Page 6, 8-19-96 ADJOURNMENT Mayor Worley adjourned the meeting at 8:24 p.m. The next regular meeting of the City Council was scheduled for Tuesday, September 3, 1996, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
