FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS AND NOTICE OF
COMPLETION FOR CONSTRUCTION AND MODIFICATION OF TRAFFIC
SUBJECT: SIGNALS AND SAFETY LIGHTING AT VARIOUS LOCATIONS (PROJECT NOS
800032, 800038, 800039, 800040 AND 800041 FILE NO. T91-1)
RECOMMENDATION
It is recommended that the City Council at their meeting of July •6,
1992 accept the improvements completed and authorize the
recordation of the Notice of Completion for said improvements with
the adoption of the attached resolution.
Assuming no claims or stop notices are filed, it is further
recommended that 35 days after the date of recordation of the
Notice of Completion the Council authorize payment of the final 10%
retention amount of $39,416.49. This amount together with previous
payments of $354,748.37 represents 100% of the final contract
amount.
BACKGROUND
This project encompasses the construction of traffic signal
modifications and street improvements as follows:
1. New traffic signal and safety lighting installation at Bryan
Avenue and Farmington Road.
2. New traffic signal, safety lighting, signing, and striping
installation and street improvements at Yorba Street and
Vandenberg Lane, including traffic signal coordination with
17th Street.
3. Modification to the existing traffic signal at Red Hill Avenue
and Bryan Avenue to provide protected left -turn movements in
all directions.
4. Modifications to the existing traffic signal at Red Hill
Avenue and Mitchell Avenue to provide protected left -turn
movements from Red Hill Avenue to Mitchell Avenue.
5. Modification to the existing traffic signal at Walnut Avenue
and Browning Avenue to provide protected left -turn movements
from Walnut Avenue to Browning Avenue.
DISCUSSION
The contract for this project was originally awarded to
Intersection Maintenance Service (I.M.S.). However, during the
project I.M.S. filed for bankruptcy and went out of business. At
that point the surety company, Safeco Insurance Company, took over
the contract and procured the services of Steiny and Company for
the completion of the work. This caused a delay in the project
completion; however, all work on this project has been completed to
the satisfaction of Public Works Department/Engineering Division.
The final contract amount for this project was $394,164.86. This
amount is $89.64 below the original contract amount of $394,254.50.
The project was funded by the 1991-92 Capital Improvement Budget.
The attached resolution accepts the public work and improvements
and authorizes the recordation of the Notice of Completion.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZIN
RECORDATION OF NOTICE OF COMPLETION FOR THE CONSTRUCTION AN
MODIFICATION OF TRAFFIC SIGNAL AND SAFETY LIGHTING AT VARIOU
LOCATIONS (PROJECT NOS. 800032, 800038, 800039, 800040, AN
800041)
WHEREAS, a contract was originally awarded to Intersectio
Maintenance Service (I.M.S.) for `the construction of th
hereinafter described -public works and improvements; and
WHEREAS, I.M.S. filed bankruptcy and was unable to comple
the work causing the surety company, Safeco Insurance, to take ov
said contract; and
WHEREAS, Safeco Insurance contracted with Steiny and Com
for the construction of the described public works
improvements; and
WHEREAS, the City Engineer has duly certified to th
construction and completion of said public improvements hereinafte
mentioned in a manner satisfactory to the City Council of the Cit
of Tustin; and
WHEREAS, the City Council finds that said public improvement
hereinafter more particularly described have been completed i
accordance with the provisions of the contract documents and th
Notice of Completion and acceptance of said public works an
improvements should be filed and payment of the balance due to sai
contract authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ci
of Tustin that said public works and improvements be, and the sa
is hereby accepted. Said public works and improvements are mo
particularly described as follows:
1. New traffic signal and safety lighting installation at Brya
Avenue and Farmington Road..
2. New traffic signal, safety lighting, signing, and stripi
installation and street improvements at Yorba Street a
Vandenberg Lane, including traffic signal coordination wi

AND BE IT FURTHER RESOLVED that the City Engineer of the City
of Tustin be and is hereby authorized to execute and file a Notice
of Completion and acceptance of said public works and improvements
described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin held on the 6th day of July, 1992.
