HUSTON, CITY MANAGER FROM: COMMUNfTY DEVELOPMENT DEPARTMENT SUBJECT: FINAL TRACT MAP 14499 RECOMMENDATION It is recommended that the City Council adopt Resolution No. 92-90 approving Final Tract Map 14499. BACKGROUND On October 28, 1991, the Planning Commission adopted Resolution No. 2965 recommending to the City Council approval of Vesting Tentative Tract Map 14499. The City Council approved Vesting Tentative Tract Map 14499 on November 18, 1991, by adopting Resolution No. 91-148. These approvals included numerous conditions to be met prior to approval of the final map, with which the applicant has complied. The Final Map is now ready for recordation with the Orange County. Recorders Office. Prior to recordation, the Final Maps must be reviewed and approved by the Planning Commission and City Council. The Planning Commission recommended approval of the Final Map. at their June 22, 1992 meeting by adopting Resolution No. 3053. Final Map 14499 includes ten numbered lots and six lettered lots, accommodating 208 condominium dwelling units and a recreation facility. Final Map 14499 is bordered by Jamboree Road to the east, Pioneer Road and Lots 7 and 8 of Tract 13627 to the west, Lots 2 and 3 of Tract 13627 to the north and Lot 5 of Tract 13627 to the south. CONCLUSION The resolution approving the tentative tract map for this project included numerous conditions which were required to be satisfied prior to recordation. All required conditions have been met. Staff has determined that the Final Map is in conformance with the Vesting Tentative Tract Map approvals, requirements of the East Tustin Specific Plan, Development Agreement, the City's Subdivision City Council Report Final Tract Map 14499 July 6, 1992 Page 2 Code, the East Tustin EIR and the ' State Subdivision Map Act. The City Council finds and determines as follows: A. That Final Tract Map 14499 have been submitted by California Pacific Homes. B. That a public hearing was held by the Planning Commission on October 28, 1991. At this hearing the Planning Commission recommended approval of Vesting tentative Tract Map 14499 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14499 on November 18, 1991. C. That following tentative map approval, the applicant filed Final Tract Map 14499. D. That on June 22, 1992, the Planning Commission recommended approval of Final Map 14499 to the City Council by adopting Resolution No. 3053. E. The Final Map is considered ministerially exempt pursuant to Section 15268 (B) of the California Environmental Quality Act. F. That the proposed subdivision is in. conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, the Development Agreement and Subdivision Map Act as it pertains to the development of residential units. G. The 1.3860 acres of parkland required for this development was previously dedicated with recordation of Tract 13627. H. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 14499 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. M. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. N. That the Final Map is in substantial conformance with the Vesting Tentative Tract Map. II. The City Council hereby approves Final Tract Map 14499 subject to final approval by the City Engineer. The Planning Commission finds and determines as follows: A. That Final Tract Maps 14499 has been submitted by The Bren Company. B. That a public hearing was held by the Planning Commission on October 28, 1991. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 14499 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14499 on November 18, 1991. C. That following tentative map approval, the applicant filed Final Tract Maps 14499. D. The Final Map is considered ministerially exempt pursuant to Section 15268(b) of the California Environmental Quality Act. E. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, the Development Agreement and Subdivision Map Act as it pertains to the development of residential units. F. The 1.3860 acres of parkland required for this development was previously dedicated with recordation of Tract 13627. G. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 14499 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. H. That the site is physically suitable for the type of development proposed. I.
