HUSTON, CITY MANAGER FROM: POLICE DEPARTMENT SUBJECT: ORDINANCE REVISION Recommendation: That Tustin Municipal Code Section 5332(C) entitled "Effect of Permission to Load and Unload" be modified to include all vehicles, for purposes of loading and unloading, for twenty minutes. Background: On 5/12/92 'we received a request from Bob Ledendecker, City Engineer, to consider modifying Tustin City Code Section 5332 (C) (1) and 5332 (C) (2) . The proposed modifications would allow the loading and unloading of materials from any vehicle instead of only commercial vehicles as is our current ordinance. We sent the request to the City Attorney and it was his recommendation that the section be modified to include all vehicles, for twenty minutes. Attached is the proposed recommendation from the City Attorney. We would recommend that this ordinance be amended. 600000 W. According to the California Vehicle Code, yellow -urbing: "indicates stopping only for the purpose of loading or unloading passengers or freight for the time as may be specified by local ordinance." ^he Tustin City Code currently allows only commercial vehicles to :oad and unload in yellow loading zones. While this condition may ::e easy to enforce, it may not be providing the small business people of the City with adequate service. Public Works has =ecently received a. request to install a yellow loading zone at 130 Zentennial Way so that the small businesses located there can load _nd unload their vehicles. The need to be able to load and unload .r©m any vehicle has been expressed. In this case this request seems reasonable. I yellow loading zone has been recently painted at the noted vocation and the business owners requesting the loading zone have een informed that the loading and unloading of materials is -iimited to the use of commercial vehicles. Effect of Permission to load or Unload. Permission is granted to stop or stand a vehicle for purposes of loading or unloading of materials and shall apply to any vehicle, but shall not extend beyond the time necessary, and, in any event, not more than twenty (20) minutes."
