SUBJECT: DESIGN REVIEW 92-021; APPLICANT, STEPHEN D. PAQUETTE
RECOMMENDATION
It is recommended that the Redevelopment Agency approve Design
Review 92-021 by adopting Resolution No. RDA 92-7, as submitted or
revised.
BACKGROUND
On June 22, 1992, the Planning Commission adopted Resolution No.
3048 approving Conditional Use Permit (CUP) 92-019, amending CUP
91-010, and recommending to the Redevelopment Agency approval of
Design. Review 92-021 authorizing modifications to the parking lot
layout, installation of landscape improvements and construction of
new east elevations for a fire damaged structure on the property
located at 135 South Prospect Avenue. A copy of Resolution No.
3048 has been included as Attachment A.
The subject property is located within the First Street Specific
Plan Project Area and maintains a zoning designation of "Commercial
as a Primary Use." The City Council has previously authorized the
tire service use on the subject property by approving Conditional
Use Permit 91-010. The project site is also located within the
Town Center Redevelopment Project Area requiring final design
review approval of the proposed site improvements by the
Redevelopment Agency.
DISCUSSION
The submitted plans propose to utilize the area remaining from the
demolition of a portion of the fire damaged structure
(approximately 11 014 square feet) , located at the northwest portion
of the site, to provide parking lot improvements which include re -
striping, installation of wheel stops, relocation of the trash
enclosure and modification to the affected landscape planters.
These improvements will provide eighteen parking spaces, which
meets the City's Code for required spaces as calculated for each
type of use on the subject property.

Previously, the project site had been granted a Consolidated
Parking Access Bonus by the City Council for combining access and
parking with the adjacent car wash site, allowing for a reduction
of two spaces from the overall total spaces required between the
two sites. The improvements proposed would eliminate the two -space
deficiency .in the shared parking between the two properties;
however, reciprocal access would still be maintained.
The other improvements, which included.a trash enclosure, landscape
modifications and completion of the east building elevations for
the remaining portion of the fire damaged structure, have all been
designed consistent with the materials, finishes and colors
previously approved for the.project site.
CONCLUSION
Based upon the above analysis and recommendation of the Planning
Commission, it is recommended that the Redevelopment Agency adopt
Resolution No. RDA 92-7 approving Design Review 92-021, subject to
the conditions contained in Exhibit A of Planning Commission
Resolution No. 3048.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF
THE CITY OF TUSTIN, CALIFORNIA, APPROVING
DESIGN REVIEW 92-021 AUTHORIZING MODIFICATIONS
TO THE PARKING LOT LAYOUT, INSTALLATION OF
LANDSCAPE IMPROVEMENTS AND CONSTRUCTION OF NEW
EAST ELEVATIONS FOR A FIRE DAMAGED STRUCTURE
ON THE PROPERTY LOCATED AT 135 SOUTH PROSPECT
AVENUE.
The Redevelopment Agency of the City of Tustin does
hereby resolve as follows:
I. The Redevelopment Agency finds and determines as
follows:
A. Pursuant to the adopted Town Center
Redevelopment Plan, the Redevelopment Agency
shall approve all site plans and architectural
designs of any project proposed within the
Redevelopment Agency Project Area.
B. That a proper application, Design Review 92-
021, has been filed on behalf of Stephen D.
Paquette requesting authorization to modify
the parking lot layout, installation of
landscape improvements and construction of new
east elevations for a fire damaged structure
on the property located at 135 South Prospect
Avenue.
C. That the Planning Commission has recommended
to the Redevelopment Agency approval of Design
Review 92-021 by adopting Resolution No. 3048,
at their meeting held on June 22, 1992.
D. Pursuant to Section 9272 of the Tustin
Municipal Code, the Redevelopment Agency f inds
that the location, size, architectural
features and general appearance of the
proposed development will not impair the
orderly and harmonious development of the
area, the present or future development
therein, or the occupancy as a whole. In
making such findings, the Redevelopment Agency
has considered at least the following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Type and pitch of roofs.

Design Review No. 92-021 authorizing modifications
to the parking lot layout, installation of
landscape improvements and construction of new east
elevations for a fire damaged structure on the
property located at 135 ,South Prospect Avenue,
subject to all conditions contained in Exhibit A of
Planning Commission Resolution No. 3048,
incorporated herein by reference.
PASSED AND ADOPTED by the Redevelopment Agency of the
City of Tustin at a regular meeting held on the 6th day
of July, 1992.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-019
AMENDING CONDITIONAL USE PERMIT 91-010 AND
RECOMMENDING TO THE REDEVELOPMENT AGENCY APPROVAL
OF DESIGN REVIEW 92-021, AUTHORIZING MODIFICATIONS
TO THE PARKING LOT LAYOUT, INSTALLATION OF
LANDSCAPE IMPROVEMENTS AND CONSTRUCTION OF NEW EAST
ELEVATIONS FOR A FIRE DAMAGED STRUCTURE ON THE
PROPERTY LOCATED AT.135 SOUTH PROSPECT AVENUE.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:
A. That proper applications, Conditional Use Permit
92-019 and Design Review 92-021, have been filed on
behalf of Stephen D. Paquette requesting an
amendment to Conditional Use Permit 91-010 and
authorization to modify the parking lot layout,
installation of landscape improvements and
construction of new east elevations for a fire
damaged structure on the property located at 13E
South Prospect Avenue.
B. A public hearing was duly noticed, called and helc
for said applications on June 22, 1992.
C. That the establishment, maintenance, and operation
of the use applied "for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfar(
of the persons residing or working in the
neighborhood of such proposed use, nor be injurious

II. The Planning Commission hereby approves Conditional Use
Permit No. 92-019 amending Conditional Use Permit 91-010
and recommends to the Redevelopment Agency approval of
Design Review 92-021 authorizing modifications to the
parking lot layout, installation of landscape
improvements and construction of new east elevations for
a fire damaged structure on the property located at 135
South Prospect Avenue, subject to all conditions
contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 22nd day of June, 1992.

EXHIBIT A
DESIGN REVIEW 92-021
CONDITIONS OF APPROVAL
RESOLUTION NO. 3048
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped June 22,
1992, on file with the. Community Development Department,
as herein modified, or as modified by the Director of
Community Development Department in accordance with this
Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Design Review approval shall become null and void unless
all permits are'issued within eighteen (18) months of the
date. of approval of the Design Review by the
Redevelopment Agency.
(1) 1.4 Approval of Design Review 92-021 is contingent upon the
applicant signing and returning an "Agreement to
Conditions Imposed" form, as established by the Director
of Community Development.
(1) 1.5 All applicable conditions of approval stated in City
Council Resolution Nos. 91-110, 91-111 and 91-112 shall
remain in full force and effect.
PLAN SUBMITTAL
2.1 At building plan check submittal:
(3) A. Three sets of construction plans for all on-site
improvements including landscaping and irrigation
shall be submitted including two sets of structural
calculations where required. Requirements of the
Uniform Building Plumbing, Mechanical and
Electrical Codes shall be complied with as approved
by the Building Official.
