HUSTON, EXECUTIVE DIRECTOR FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: DESIGN REVIEW 92-034, APPLICANT, GARY CLARK RECOMMENDATION It is recommended that the Community Redevelopment Agency approve Design Review 92-034 by adopting Resolution No. RDA 92-10, as submitted or revised. BACKGROUND The applicant wishes to install canvas awnings on the commercial property located at 13022 and 13024 Newport Avenue at the southeast corner of Newport Avenue and Old Irvine Boulevard. Since the site is within the South Central Redevelopment Area, final design approval is required by the Community Redevelopment Agency. The subject site is bounded by a commercial property*to the south and to the east, a commercial center across Old Irvine Boulevard to the north, and a commercial center across Newport Avenue to the west. The subject site is zoned C-1 (Commercial Retail). This item is not a public hearing, therefore, no formal noticing was sent. The property owner was notified of the availability of the staff report for this project. DISCUSSION The applicant wishes to modify the appearance of the subject commercial structure by covering the existing mansard roof overhang with a green awning. The subject structure is a single story concrete building painted tan with glass storefronts and brick bulkheads facing Newport Avenue. The existing mansard roof which will be covered by the awning has asphalt shingles. A parapet wall projects above the mansard roof and contains the business identification for the tenant's spaces. The applicant is not proposing to place signs on the awning or underlight the awning. Redevelopment Agency.Report Design Review 92-034 July 6, 1992 Page 2 As proposed, the green awning would be attached to the existing mansard roof structure by steel tubing which would be attached to concealed cross bars located every 45 inches on center. The existing brown vertical posts attached to the mansard roof would remain to provide structural support. This structure would provide sufficient support for the canvas awning. The canvas awning would be fire retardant. Commercial properties in the surrounding area, such as Faraday's restaurant and LaFayette Plaza, also utilize awnings in the architectural design of the structures. Like the use of awnings in these surrounding commercial properties, the proposed awning will be compatible with the architecture of the structure and will be harmonious with the existing color scheme. CONCLUSION Given the analysis conducted by staff, it is recommended that the Community Redevelopment Agency approve Design Review 92-034 by approving Resolution No. RDA 92-10 as submitted or revised. RDA 92-10 A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESIGN REVIEW 92-034 AUTHORIZING CONSTRUCTION OF AWNINGS AT THE COMMERCIAL STRUCTURE LOCATED AT 13022 AND 13024 NEWPORT AVENUE The Community Redevelopment Agency of the City of Tustin does hereby resolve as follows: I. The Community Redevelopment Agency finds and determines as follows: A. A proper application, Design Review 92-034, has been filed by Gary Clark, requesting authorization to construct awnings at the commercial structure located at 13022 and 13024 Newport Avenue. B. Pursuant to Section 9272 of, the Tustin Municipal Code, the Community Redevelopment Agency finds that the location, size, architectural features and general appearance of the proposed outdoor playground equipment will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Community Redevelopment Agency has considered at least the following items: . 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Location, height and standards of exterior illumination. 5. Physical relationship of proposed structures to existing adjacent uses. 6. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood. 7. Development guidelines and criteria as adopted by the City Council. C. This project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15303 (Class 3). II. RDA 92-10 CONDITIONS OF APPROVAL DESIGN REVIEW 92-034 GENERAL (1) 1.1 The proposed project shall substantially conform to submitted plans date stamped July 6, 1992, on file with the Community Development Department as herein modified or as modified by the Director of Community Development in accordance with this exhibit. (1) 1.2 Approval of Design Review 92-034 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.3 Permits for the construction of the awnings issued shall be within 18 months of approval or this Design Review shall become null and void. (1) 1.4 All construction shall meet the requirements of the 1991 Uniform Building Code. (4) 1.5 Awnings shall not be backlit with lights. PLAN SUBMITTAL (1) 2.1 At plan check, submit three (3) sets of construction plans, two (2) sets of structural calculations prepared by a licensed engineer/architect. Requirements of the Uniform Building code shall be complied with as approved by the Building Official. FEES (1) 3.1 Payment of all applicable building plan check and permit fees shall be made to the Community Development Department prior to the issuance of any building permits in accordance with the Tustin City Code.
