SUBJECT: DESIGN REVIEW 92-009; APPLICANT - CARL'S JR.
RECOMMENDATION
It is recommended that the Community Redevelopment Agency approve
Design Review 92-009 by adopting Resolution No. RDA 92-9, as
submitted or revised.
BACKGROUND
The applicant wishes to construct outdoor play equipment within a
landscaped area between the restaurant and drive-through lane at
14041 Newport Avenue. On June 22, 1992, the Planning Commission
approved Conditional Use Permit (CUP).92-023 to amend CUP 89-47
which authorized the construction of the Tustin Freeway Center in
order to modify the approved site plan to construct outdoor play
equipment in conjunction with the existing Carl's Jr. restaurant.
The subject site is bounded by a commercial property to the south,
a shopping center to the west, the I-5 Freeway to the north, and
commercial property to the east across Newport Avenue. The subject
site is zoned Planned Community Commercial (PC -C). Since the site
is within the South Central Redevelopment Area, final design
approval is required by the Community Redevelopment Agency.
This item is not a public hearing, therefore, no formal noticing
was sent. The property owner was notified of the availability of
the staff report for this project.

The subject outdoor play equipment would be located on the east
side of the Carl's Jr. restaurant in an existing landscaped area
between the building and the drive-through lane. The equipment,
which would be made of galvanized steel pipe structure and padded
with yellow foam, would be a maximum of 121-311 in height, and would
be 16'-5" by 16'-511. Red slides and yellow cubes would fit inside
the steel structure, and black netting would enclose the structure.
Green rubber matting would be installed under the equipment. The
proposed padded outdoor playground equipment would be designed for
"soft play" for children up to 4'-0" in height.

Design of the playground equipment would meet the requirements of
the United States Consumer Product Safety Commission. A 10'-0"
long bench would be installed in the outdoor area for adult
supervisors. A sign stating that adult supervision is required
would be installed on the inside of the door that leads to the
playground area pursuant to United States Consumer Product Safety
Commission requirements. A sign would be placed on the inside of
the fence to explain the playground rules.
A tile patio would be installed as a transition surface between the
green rubber matting and the entrance to the restaurant. The
playground equipment would be enclosed by a 6'-0" in height metal
fence with vertical members placed at four inches on center. The
fence would be painted forest green to match the existing
restaurant trim and would have several yellow, metal "happy stars".
The playground equipment would-be lighted with existing building
fixtures, and with an existing parking lot light. The Tustin
Police Department had no security concerns for the playground
equipment.
To clear space for the playground, the applicant would replace the
existing bicycle rack in the landscaped area closer to the drive-
through lane. The bicycle rack would be accessed by the existing
sidewalk at the south side of the restaurant, and would be buffered
from the drive-through lane by existing landscaping.
CONCLUSION
Given the analysis conducted by staff, it is recommended that the
Community Redevelopment Agency approve Design Review, 92-009 by
approving Resolution No. RDA 92-9 as submitted or revised.

A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY
OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESIGN
REVIEW 92-009 AUTHORIZING CONSTRUCTION OF OUTDOOR
PLAY EQUIPMENT AT THE CARL'S JR RESTAURANT LOCATED
AT 14041 NEWPORT AVENUE
The Community Redevelopment Agency of the City of Tustin does
hereby resolve as follows:
I. The Community Redevelopment Agency finds and determines
as follows:
A. A proper application, Design Review 92-009, has
been filed by Carl Karcher Enterprises, Inc.
requesting authorization to construct outdoor play
equipment at the Carl's Jr. Restaurant located at
14041 Newport Avenue.
B. Pursuant to Section 9272 of the Tustin Municipal
Code, the Community Redevelopment Agency f inds that
the location, size, architectural features and
general appearance of the proposed outdoor
playground equipment will not impair the orderly
and harmonious development of the area, the present
or future development therein, or the occupancy as
a whole. In making such findings, the Community
Redevelopment Agency has considered at ieast the
following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Landscaping, parking area design and traffic
circulation.
5. Location, height and standards of exterior
illumination.
6. Location and appearance of equipment located
outside of an enclosed structure.
7. Physical relationship of proposed structures
to existing adjacent uses.
8. Appearance and design relationship of proposed
structures to existing structures and possible
future structures in the neighborhood.
9. Development guidelines and criteria as adopted
by the City Council.
C. This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15303 (Class 3).

II. The Community Redevelopment Agency approves Design Review
No. 92-009 to allow the construction of outdoor play
equipment at the Carl's Jr. restaurant located at 14041
Newport Avenue subject to the conditions contained in
Exhibit A incorporated herein by reference.
PASSED AND ADOPTED by the Community Redevelopment Agency of
the City of Tustin at a regular meeting held on the 6th day of
July, 1992.

CONDITIONS OF APPROVAL
DESIGN REVIEW 92-009
GENERAL
(1) 1.1 The proposed project shall substantially conform to
submitted plans date stamped July 6, 1992, on file with
the Community Development Department as herein modified
or as modified by the Director of Community Development
in accordance.with this exhibit.
(1) 1.2 Approval of Design Review 92-009 is contingent upon the
applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development.
(1) 1.3 Permits for the construction of the playground equipment
shall be issued within 18 months of approval or this
Design Review shall become null and void.
(1) 1.4 All construction shall meet the requirements of the 1991
Uniform Building Code.
PLAN SUBMITTAL
(1) 2.1 At plan check, submit three (3) sets of construction
plans, two (2) sets of structural calculations prepared
by a licensed engineer/architect. Requirements of the
Uniform Building code shall be complied with as approved
by the Building Official.
(1) 2.2 Technical details and plans for all utility installations
shall be required as applicable. No field changes shall
be made without corrections submitted to and approved by
the Building Official.
(1) 2.3 Exit gates shall be of panic hardware and shall swing in
the direction of exit travel per Section 3304 of the
Uniform Building Code.

FEES
(1) 4.1 Payment of all applicable building plan check and permit
fees shall be made to the Community Development
Department prior to the issuance of any building permits
in accordance with the Tustin City Code.
