CALL TO ORDER PUBLIC INPUT CONSENT CALENDAR ITEMS 1 -2 1. WRITTEN REPORT REQUIRED BY GOVERNMENT CODE SECTION 65858(D) IN REFERENCE TO INTERIM URGENCY ORDINANCE NO. 1451, PROHIBITING THE ESTABLISHMENT OR EXPANSION OF MASSAGE ESTABLISHMENTS On October 21, 2014, the City Council of the City of Tustin unanimously adopted Interim Urgency Ordinance No. 1451, prohibiting the establishment or expansion of massage establishments for a period of 45 days. The temporary 45 -day moratorium is set to expire on December 5, 2014. Pursuant to Government Code Section 65858(d), at least ten (10) days prior to the expiration or extension of a moratorium, the City Council must issue a report describing the measures taken to alleviate the conditions leading to the adoption of the Interim Urgency Ordinance. This document constitutes the written report required by Government Code Section 65858(d). Recommendation: That the City Council receive and file this report. Please note: Written materials relating to agenda items for an open session regular meeting of the Council that are distributed to a majority of the Council members less than 72 hours prior to the meeting are available for public inspection at the following locations: In the City Clerk's Office during regular business hours and following business hours (after 5:30 p.m.) in the Council Chamber on the day of the meeting. 2. PROMISSORY NOTE SETTLEMENT AGREEMENT WITH THE STATE OF CALIFORNIA DEPARTMENT OF FINANCE Approval is requested to enter into a Promissory Note Settlement Agreement ( "Settlement Agreement ") with the State of California Department of Finance ( "DoF "). Recommendation: 1. It is recommended the City Council take the following actions: a. Approve the Settlement Agreement with DoF in a form substantially consistent with the attachment; and b. Authorize the City Manager to execute and transmit the Settlement Agreement to DoF and to take all actions necessary to implement its provisions; and c. Authorize the Finance Department to appropriate $5,000,000 from Fund 189 (Land Held for Resale) and send payment as provided in the Settlement Agreement upon execution of the Agreement by all parties; and d. Authorize the Finance Department to make future payments consistent with the terms of the Settlement Agreement. 2. It is recommended the City Council, acting as the Successor Agency, take the following actions: a. Approve the Settlement Agreement with DoF in a form substantially consistent with the attachment; and b. Authorize the Executive Director to execute the Settlement Agreement and to take all actions necessary to implement its terms. 3. It is recommended the Tustin Housing Authority Commissioners take the following actions: a. Approve the Settlement Agreement with DoF in a form substantially consistent with the attachment; and b. Authorize the Executive Director to execute the Settlement Agreement and to take all actions necessary to implement its terms.
