FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION
SUBJECT: LEVY OF ANNUAL ASSESSMENTS FOR THE 1992-93 FISCAL YEAR FOR THE TUSTIN LANDSCAPE
AND LIGHTING DISTRICT (FILE #2709.81)
RECOMMENDATION
It is recommended that the City Council adopt the following:
1. Resolution No. 92-77 ordering preparation of an Engineer's Report; and
2. Resolution No. 92-78 approving the Engineer's Report; and
3. Resolution No. 92-79 of intention of levy annual assessments, annex
additional territory, and to set the protest hearing for July 20, 1992.
BACKGROUND
The Engineer's Report prepared by BSI Consultants, Inc. has been filed with the City
Clerk. There is one new parcel proposed for annexation to the District this
upcoming 1992-93 fiscal year and is identified as the Aldersgate Methodist Church
located at 1201 Irvine Boulevard. The recommended 1992-93 fiscal year assessments
are shown below:
Street
Li hating Landscaping
Single Family Unit $ 16.21 $ 35.00
Condo/Apartment Unit $ 12.16 $ 26.25
Commercial Acre $ 97.26 $210.00
The landscape maintenance segment of the District covers only the areas within East
Tustin between the curbline and the perimeter walls along the arterial street
system. The maintenance of median islands within the East Tustin area, as well as
the remainder of the City, is funded by general fund monies. Developed commercial
frontages and local street landscaping are maintained privately by associations,
either business owners or homeowners.
The street lighting.segment of the District includes both the East Tustin area and
various other locations throughout the City which were not previously included in
the original Tustin Lighting District. These locations/areas are shown on the maps
marked Exhibit "B" of the Engineer's Report.
The proposed levy of assessments has decreased for street lighting in 1992-93 and
has increased for landscaping maintenance compared to last year as follows:

ANNUAL ASSESSMENTS FOR TUSTIN LANDSCAPE AND LIGHTING DISTRICT
JUNE 15, 1992
PAGE 2
The increase in landscape assessments are due to the expansion of
infrastructure inventory and a slow done dwelling unit development. The street
light assessments should continue to decrease slowly as the dwelling unit production
increases and the infrastructure inventory stabilizes.
The total costs to be assessed for lighting and landscape for fiscal year 1992-93
are as follows:
Street Lighting $117,700.00
Landscaping $272.400.00
Total $390,100.00
DISCUSSION
The three attached resolutions require passage and adoption by the City Council at
their June 15, 1992 meeting. These resolutions provide for the following:
° Resolution 92-77 orders the preparation of the Engineer's report for
the levy of the annual assessments for the 1992-93 fiscal year for the
Tustin Landscape and Lighting District.
° Resolution 92-78 approves the Engineer's Report for the 1992-93 fiscal
year for the levy of annual assessment for the Tustin Landscape and
Lighting District and for the annexation of additional territory to
said existing district.
Resolution 92-79 declares the City Council's intention to order the
annexation of additional territory to an existing district and to
provide for an annual levy of assessment for said Landscape and
Lighting District and to levy and collect assessments pursuant to the
Landscaping and Lighting Act of 1972.
Resolution 92-79 sets the date, time and place for a public hearing where all
interested persons may appear before the City Council and be heard concerning the
annual levy of assessments of the District and all other matters relating thereto.
