HomeMy WebLinkAbout00 AGENDA 06-01-92AGENDA ZITY COUNCIL REGULAR MEET CITY OF TUSTIN JUNE 11 1992 - 7:00 P.M. The City Council meets the first and third Monday of each month at 7:00 p.m. in the City Council Chambers at 300 Centennial Way. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City Council agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use in the Council Chambers during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you desire to smoke, an outside speaker has been provided. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior to the meeting. This will allow the City Council sufficient time to review the material prior to taking action. PRESENTATION, 5:30 P.M. - Environmental Management Agency will make a presentation to the City Council on the Moulton Parkway Street Improvements. This presentation is open to the public. I. APPROVAL OF MINUTES - MAY 18, 1992 REGULAR MEETING 'Recommendation: Approve the City Council Minutes of May 18, 1992. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,682,872.80 and ratify Payroll in the amount of $352,875.60. 3. REJECTION OF CLAIM NO. 92-22 - CLAIMANT, ALLSTATE INSURANCE/YVONNE HALES; DATE OF LOSS, 1/25/92; DATE FILED WITH CITY, 5/5/92 Recommendation: Reject subject claim for personal injury and property damages of an undetermined amount as recommended by the City Attorney. 4. DECLARATION OF SURPLUS EQUIPMENT Recommendation: Declare specified equipment surplus and not required for public use and authorize the Public Works Department to dispose of equipment in accordance with Ordinance No. 871 as recommended by the Public Works Department/ Engineering Division. S. RESOLUTION NO. 92-72 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 92-2 Recommendation: Adopt Resolution No. 92-72 approving Lot Line Adjustment No. 92-2 as recommended by the Public Works Department/Engineering Division. VIII. ORDINANCES FOR INTRODUCTION 1. ORDINANCE NO. 1090 - ROOSTERS At their regular meeting on May 4, 1992, the City Council directed staff to prepare an amendment to the City Code to permit the maintenance and keeping of roosters within the single family residential portions of "Old Town" Tustin subject to certain specific development standards. Recommendation: Have first reading by title only and introduction of the following Ordinance No. 1090: ORDINANCE NO. 1090 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 4221 OF ARTICLE 4, CHAPTER 2, PART II OF THE TUSTIN CITY CODE, ESTABLISHING MINIMUM STANDARDS FOR THE MAINTENANCE OF ROOSTERS IN THE CITY OF TUSTIN IX. ORDINANCES FOR ADOPTION 1. ORDINANCE NO. 1089 - ZONE CHANGE 92-001 (14442 HOLT AVENUE) The following Ordinance No. 1089 had first reading by title only and introduction at the May 18, 1992 City Council meeting: ORDINANCE NO. 1089 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 92-001, A REQUEST TO CHANGE THE DESIGNATION OF THE PROPERTY LOCATED AT 14442 HOLT AVENUE FROM E-4 (RESIDENTIAL ESTATE DISTRICT) TO R-1 (SINGLE- FAMILY RESIDENTIAL DISTRICT) Recommendation: Have second reading by title only and adoption of Ordinance No. 1089 (roll call vote). X. OLD BUSINESS 1. AUDIT COMMITTEE At the May 18, 1992 meeting, the City Council discussed whether appointment requirements to the Audit Committee should be amended. b Recommendation: Pleasure of the City Council. 2. IRVINE BUSINESS COMPLEX (IBC) On May 7, 1992, the City of Tustin submitted written comments to the City of Irvine Planning Commission reinforcing our concerns regarding infeasible traffic improvements with the City of Tustin and the failure of Irvine to construct certain Irvine Business Complex (IBC) improvements required since 1985, and proposed that the City of Irvine enter into an agreement with Tustin to ensure the financing and completion of certain improvements in Tustin. Recommendation: Authorize staff to negotiate and prepare a Memorandum of Understanding between the Cities of Irvine and Tustin related to traffic mitigation on the Irvine Business Complex (IBC) project as recommended by the Community Development Department. XI. NEW BUSINESS 1. RECEIPT OF CITY COUNCIL MEETING AGENDA MATERIAL At the May 18, 1992 meeting, Councilmember Thomas asked if it would be possible to receive the agenda material on the Wednesday before the meeting rather than Thursday, which is current practice. POLICY REGD"nING CITY COUNCIL EXPENDITr"P:S Mayor Pro .am Potts requested that t�Ae City Council consider adoption of a policy requiring the City Council's formal approval for any item of expense not already authorized to all members of the City Council. Recommendation: Adopt the following Resolution No. 92-75 providing that any request made by a Councilmember for an item that is not provided for in the annual budget, or otherwise authorized for all Councilmembers, must be formally approved by the City Council: RESOLUTION NO. 92-75 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PRESCRIBING APPROVAL OF COUNCILMEMBER EXPENSE REIMBURSEMENT XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - MAY 26, 1992 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of May 26, 1992. 2. 1991-92 CAPITAL IMPROVEMENT PROJECTS SCHEDULE/STATUS REPORT QUARTERLY UPDATE A graphical charting report of the schedule/status for the 1991-92 Capital Improvement Program as of the end of the fiscal year's third quarter. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 3. INVESTMENT SCHEDULE AS OF APRIL 30, 1992 Investment schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department. 4. "CALIFORNIA DREAM IN TROUBLE" - LEAGUE OF CITIES VIDEO At the City Council meeting of May 18, 1992, Councilmember Thomas requested that the League of California Cities' video tape entitled "California Dream in Trouble" be shown at the June 1, 1992 City Council meeting. Recommendation: Pleasure of the City Council. 5. OVERVIEW OF THE FOOTHILL/EASTERN TRANSPORTATION CORRIDOR AGENCY BOARD OF DIRECTORS MEETING OF MAY 14, 1992, RELATIVE TO ACTIONS TAKEN ON EASTERN TRANSPORTATION CORRIDOR Report on the proceedings of the May 14, 1992 Foothill/Eastern Transportation Corridor Agency Board of Directors meeting. IRVINE RANCH WATER DISTRICT PROPOSED AMENDED RULES AND REGULATIONS PERTAINING TO THE USE OF SEWERAGE FACILITIES To protect the environment, as well as Irvine Ranch Water District (IRWD) waste water treatment system facilities and the health and safety of IRWD waste water workers, the IRWD is required to adopt and implement an individual waste water pretreatment and source control program. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 7. ST. JEANNE DE LESTONNAC SCHOOL DRIVEWAY ACCESS - STATUS REPORT On May 27, 1992, the City Council and staff received letters from Sister Mary Salud Estrada and Sister Mary of Jesus Rodriguez of St. Jeanne de Lestonnac School regarding the status of their driveway access to Main Street issue.
