Dear Ms. Binsack ,
Thank you for meeting with me yesterday and considering our Business license request at
the Woodlawn address. This letter is submitted to confirm my wish to have the
aforementioned appeal deferred until we have had a chance to review the City's decision
regarding our alternative business license request for research, design and assembly of
compost equipment at the site. Secondly, I you remember, 1 would also like your opinion
if the CRV and Universal Waste drop off center required in the upcoming refuse contract
would comply with City Zoning at the site.

Dear Ms. Stoker:
On behalf of the Pacific Business Center Owners Association located at 15131 through 15151
Woodlawn, we are writing in response to the February 1, 2007 Official Notice of the Public
Hearing regarding the appeal of determination of the proposed use at 15201 Woodlawn Avenue.
The property owners and members of the Pacific Business Center do not want the Community
Development Department to grant Federal Disposal the use of the proposed recycling center at
15201 Woodlawn Avenue. The proposed use of the property at 15201 Woodlawn Ave for solid
waste and recycling services will impose a nuisance to the Pacific Business Center and the
surrounding business parks. The waste and recycling center would have a negative effect on the
area, values of surrounding property, and would not appear consistent with the businesses in the
area. This area has been designated for business development and technology. Currently the
City of Tustin is spending large amounts of money to renovate the main thoroughfares in the
vicinity. The proposed use would draw heavy traffic, increased noise, an unpleasant odor,
possible hazardous waste /material and increase in rodent and bird activity.
We thank you for your consideration of our concerns in this matter. The members and the Board
of Directors of Pacific Business Center would be happy to meet with you to discuss the concerns
and negative effects this may have if the proposed use is granted. You may contact Karen

Notice is hereby given that the Planning Commission of the City of Tustin, California, will
conduct a public hearing on February 12, 2007, at 7:00 p.m. in the Council Chambers, 300
Centennial Way, Tustin, California, to consider the following:
Appeal of Determination of Proposed Use at 15201 Woodlawn Avenue
An appeal by Don Shubin of Federal Disposal Service of the Community Development
Director's decision on December 20, 2006, that the proposed use of the property at
15201 Woodlawn Avenue for solid waste and recycling services, including the garaging
and maintenance of refuse collection vehicles, is not a permitted use pursuant to the
Pacific Center East Specific Plan.
The property at 15201 Woodlawn Avenue is located within Planning Area 15 of the
Pacific Center East Specific Plan Area, which has a technology center land use
designation. Pursuant to Section 4.5 E of the Specific Plan, decisions of the
Community Development Director are appealable to the Planning Commission.
This project is statutorily exempt pursuant to Section 15270 of Title 14, Chapter 3 of
the California Code of Regulations (Guidelines for the California Environmental Quality
Act) which states that CEQA does not apply to projects rejected or disapproved by a
public agency.
If you challenge the subject item in court, you may be limited to raising only those issues
you or someone else raised at the public hearing described in this notice, or in written
correspondence delivered to the City of Tustin at or prior to the public meeting.

Pursuant to Tustin City Code section 2512(g), you may appeal this decision to the City Council by
filing an appeal with the Director of Community Development within ten (10) days after receipt of
notification of this decision. Should you file an appeal, you will be notified at least ten (10) days in
advance of the City Council hearing date.

This questionnaire was developed by the Orange County Fire Authority (OCFA) in conjunction with the South Coast Air Quality Management
District ( SCAQMD), and the County of Orange Certified Unified Program Agency (CUPA) to facilitate review of your plans, the issuance
of required building and fire permits, as well as issuance of your Certificate of Occupancy.
This form will: 1) Determine your need for compliance with federal and state mandated Community- Right -to -Know laws. These laws pro-
hibit the issuance of a Certificate of Occupancy to a business that will handle hazardous materials unless the business has met or is meeting the
requirement to file a chemical inventory disclosure packet with the OCFA. These laws may require a Risk Management Plan to be filed with
OCFA if the facility will handle certain regulated substances. These laws also govern the permitting of a facility handling certain regulated
substances to be constructed within 1,000 feet of a school (K -12), general acute care hospital or long term care facility; 2) Determine your need
for compliance with state mandated AQMD laws; 3) Determine your need for compliance with specific Uniform Fire and Building Code
requirements which may affect the building design, plan submittal, permit issuance or obtaining a Certificate of Occupancy; and 4) Determine
your need for compliance with state mandated hazardous materials regulations. '
