HomeMy WebLinkAbout02 PC REPORT GPCReport to the Planning Commission DATE: SUBJECT: APPLICANT: PROPERTY OWNER: LOCATION: ZONING: ENVIRONMENTAL DETERMINATION: DECEMBER 9, 2014 ITEM #2 TUSTIN GENERAL PLAN CONFORMITY DETERMINATION CITY OF TUSTIN CITY OF TUSTIN 14741-14751 NEWPORT AVENUE MULTIPLE FAMILY RESIDENTIAL DISTRICT (R-3) GENERAL PLAN CONFORMITY DETERMINATIONS REQUIRED BY GOVERNMENT CODE SECTION 65402 ARE NOT "PROJECTS" REQUIRING ENVIRONMENTAL REVIEW PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST: GENERAL PLAN CONFORMITY FINDING FOR CONVEYANCE OF EIGHT (8) RESIDENTIAL UNITS LOCATED AT 14741 AND 14751 NEWPORT AVENUE OWNED BY THE CITY OF TUSTIN TO THE ORANGE COUNTY RESCUE MISSION RECOMMENDATION That the Planning Commission adopt Resolution No. 4275 determining that the conveyance of eight (8) residential units located at 14741-14751 Newport Avenue owned by the City of Tustin to the Orange County Rescue Mission is in conformance with the Tustin General Plan. BACKGROUND On December 16, 2014, the City of Tustin owned residential units located at 14741 County Rescue Mission (OCRM). Since the property was acquired by the Planning Commission General Plan Conformity Determination December 9, 2014 Page 2 City to retain right-of-way needs associated with the Newport Avenue Extension Project Phase II, the conveyance will be conditioned on the property reverting back to the City if and when Newport Avenue Extension Project Phase II is required. Pursuant to Section 65402 (c) of the Government Code, prior to acquisition or disposition of real property by a local agency such as the City, a general plan conformity determination is required. The Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed conveyance are consistent with the General Plan. The property to be acquired will be used by the OCRM to provide transitional housing to homeless Veterans. While the properties will be used to provide housing for homeless Veterans in the same manner as they currently function in providing housing to the eight households occupying the units; subsequent entitlement application would be required in compliance with the zoning requirements. OCRM will provide all services necessary to transition Veterans from homelessness to permanent housing at their Village of Hope location. Housing for homeless Veterans meets the General Plan's Housing Element Goal 1, to provide an adequate supply of housing to meet the need for a variety of housing types and the diverse socio-economic needs of all community residents. Specifically, it complies with Housing Element Policy 1.11, encouraging the availability of affordable housing for special needs households, including large, low-income families. Special needs households include the elderly, large families, female -headed households with children, households with a disabled person, and the homeless. In addition, the City has taken the initiative to create transitional housing for veterans in lieu of the grants listed under Federal Resources in Housing Element Table H-19, which are used to develop programs that help veterans recover from homelessness, including establishing transitional housing and supportive services for homeless veterans. Finally, housing for homeless Veterans will assist the City in meeting the Housing Element's Regional Housing Needs Assessment goal of providing housing for extremely low- income individuals. Residential housing for homeless Veterans is consistent with the General Plan and zoning Ordinance. The Planning Commission finds and determines as follows: A. That the City of Tustin proposes to convey eight (8) residential units located at 14741 and 14751 Newport Avenue owned by the City to the Orange County Rescue Mission. B. That the proposed conveyance is associated with the provision of transitional housing for homeless Veterans, which is recognized in the City's Housing Element of the General Plan. C. That California Government Code Section 65402 (c) provides that a local agency such as the City shall not convey real property until the location, purpose, and extent of the project has been submitted to and reported upon by the local planning agency as to the conformity with the applicable, adopted general plan. D. The proposed disposition supports several General Plan Housing Element goals and policies, including the following: 1. Housing Element Goal 1: Provide an adequate supply of housing to meet the need for a variety of housing types and the diverse socio-economic needs of all community residents. 2. Housing Element Policy 1.11: Encourage the availability of affordable housing for special needs households, including large, low-income families. Special needs households include the elderly, large families, female -headed households with children, households with a disabled person, and the homeless. 3. Housing Element Policy 1.14: Provide continued support for the County Homeless Assistance Program and other Resolution 4275 December 9, 2014 Page 2 homeless assistance programs within Tustin and in adjacent cities. 4. Housing Element Policy 1.15: Encourage the provision of grants and technical assistance to various organizations and agencies that provide assistance to persons with special needs such as the homeless, disabled, low-income, and elderly persons. E. That the properties were originally acquired by the City for rights-of- way needs associated with Newport Avenue Extension project in compliance with the Circulation Element of the General Plan. Proper deed restrictions will be placed on the properties requiring the properties be reverted back to the City if and when Newport Avenue Extension Project Phase II is required. F. That subsequent entitlement application will be obtained by the OCRM to establish the transitional housing use within the Multiple Family Residential (R3) District. G. That general plan conformity determinations required by Government Code Section 65402 are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that the location, purpose, and extent of a proposed conveyance of eight (8) residential units located at 14741 and 14751 Newport Avenue to OCRM for transitional housing for homeless Veterans conforms with the Tustin General Plan.
