The City Council meets the first and third Monday of each month at 7:00 p. m. in the City Council Chambers at 300 Centennial Way. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City Council agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use in the Council Chambers during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you desire to smoke, an outside speaker has been provided. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior to the meeting. This will allow the City Council sufficient time to review the material prior to taking action. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. INVOCATION - The Invocation will be given by Rev. Jeannette Hedge, Unity Church of Truth. III. ROLL CALL IV. PROCLAMATION, MISS TUSTIN - A proclamation will be presented to the 1991 Miss Tustin and Margarete Thompson will introduce the 1992 Miss Tustin. V. PUBLIC HEARING 1. ORDINANCE REGARDING CITY-WIDE ZONING REGULATIONS FOR THE SITING OF HAZARDOUS WASTE FACILITIES Ordinance No. 1086 addresses the requirements for siting hazardous waste facilities, definitions, permit requirements, application procedures, standards and locational criteria, andthe conditions which would be imposed upon a hazardous waste facility operator. Recommendation: Have first reading by title only and introduction of the following Ordinance No. 1086 as recommended by the Community Development Department: ORDINANCE NO. 1086 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY - OF TUSTIN, CALIFORNIA, ADOPTING CITY-WIDE ZONING REGULATIONS FOR THE SITING OF HAZARDOUS WASTE FACILITIES BY ADDING CHAPTER 9A TO ARTICLE 9 OF THE TUSTIN CITY CODE, BY ADDING SUBSECTION (I) TO SECTION 9242B OF PART 4, CHAPTER 2, ARTICLE 9 OF THE TUSTIN CITY CODE, AND BY AMENDING THE PLANNED COMMUNITY DISTRICT REGULATIONS FOR THE IRVINE INDUSTRIAL COMPLEX CITY COUNCIL AGENDA PAGE 1 MAY 18, 1992 2. SECOND GEN1 ► PLAN EXTENSION -REQUEST Colifornia State Law requires each City to adopt a comprehensive General Plan for the physical development of the City and any land outside its boundaries which bears a relationship to its planning activities. The Office of Planning and Research granted local jurisdictions up to a one-year extension of time, with the possibility of an additional one-year extension, if needed, in order to complete and adopt revisions to the mandatory elements of the General Plan. Recommendation: Adopt the following Resolution No. 92-60 requesting that the State Office of Planning and Research approve a second 12 -month extension for City preparation and adoption of the updated General Plan as recommended by the Community Development Department: RESOLUTION NO. 92-60 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING A SECOND EXTENSION.OF TIME 'TO REVISE THE CITY OF TUSTIN GENERAL PLAN VI. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO action can be taken on off -agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. VII. CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - MAY 4 REGULAR MEETING Recommendation: Approve City Council Minutes of May 4, 1992. 2. APPROVAL OF DEMANDS AND, RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,438,528.84 and ratify Payroll in the amount of $314,960.96. 3. (This item was moved to Public Hearing - Second General Plan Extension Request). 4. RESOLUTION NO. 92-69 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO THE COMPENSATION OF PART- TIME EMPLOYEES OF THE CITY OF TUSTIN Recommendation: Adopt Resolution No. 92-69 adjusting part-time employee salaries•as recommended by the Administrative Services Department. RESOLUTION . 92-65 - A RESOLUTION O] 1E CITY COUNCIL OF THE CITY OF TUSiZN, CALIFORNIA, APPROVING F._.AL TRACT MAPS 14381 AND 14567 Recommendation: Adopt Resolution No. 92-65 approving Final Tract Maps 14381 and 14567 as recommended by the Community Development Department. 6. SALE OF SURPLUS EQUIPMENT Recommendation: Receive and file notice of sale of surplus equipment/vehicles as recommended by the Public Works Department/Field Services Division. 7. UNIFORM RENTAL AND LAUNDRY SERVICE CONTRACT Recommendation: Authorize renewal of the Uniform Rental and Laundry Service contract with Mission Uniform and Linen Service as recommended by the Public Works Department/Field Services Division. 8. QUITCLAIM OF UTILITY EASEMENTS - IRVINE BOULEVARD Recommendation: Approve the quitclaim deed for sanitary sewer and storm drain easements within the previously vacated segments of Irvine Boulevard westerly of Jamboree Road and authorize the Mayor to execute said deed on behalf of the City as recommended by the Public Works Department/Engineering Division. 9. DECLARATION OF SURPLUS VEHICLES AND WORK EQUIPMENT Recommendation: Declare specified equipment surplus and not required for -public use and authorize the Public Works Department to dispose of equipment in accordance with Ordinance No. 871 as recommended by the Public Works Department/Field Services Division. 10. AWARD OF CONTRACT FOR SIDEWALK, CURB AND PAVER REPAIR PROJECT, 1991-92 FY Recommendation: Award the contract Advanced Construction, Santa Monica, in as recommended by the Public Works Division. 11. MEASURE "M" PROGRAM COMPLIANCE GUTTER, AND INTERLOCKING for subject project to the amount of $86,426.50 Department/Engineering RESOLUTION NO. 92-59 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE LOCAL PAVEMENT MANAGEMENT PLAN OF THE CITY OF TUSTIN; Recommendation: (A) Adopt Resolution No. 92-59 certifying the City of Tustin's Pavement Management Plan; and (B) Authorize the Mayor and City Clerk to execute a Memorandum of Understanding regarding receipt and use of Measure M funds; and (C) Adopt the Congestion Management Program and Measure M Seven Year Capital Improvement Program, fiscal year 1992-93 through 1998-99; and (D) Authorize the Public Works Director/City Engineer to submit the City of Tustin's Measure M program to the Orange County Transportation Authority as recommended by the Public Works Department/Engineering Division. 12. RESOLUTION NO. 92-70 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE WATER MAIN REPLACEMENTS ON NISSON ROAD FROM NEWPORT AVENUE TO RED HILL AVENUE AND ON EL CAMINO REAL FROM NEWPORT AVENUE TO ORANGE STREET CITY COUNCIL AGENDA PAGE 3 MAY 18, 1992 Recommend on: Adopt Resolution No. 70 accepting said work and author -zing the recordation of the ._,cice of Completion; and RESOLUTION NO. 92-71 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR STREET REHABILITATION ON NISSON ROAD FROM NEWPORT AVENUE TO RED HILL AVENUE, A DISADVANTAGED BUSINESS ENTERPRISE PROJECT, PARTICIPATION GOAL 10% Recommendation: Adopt Resolution No. 92-71 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/ Engineering Division. VIII. ORDINANCE FOR INTRODUCTION 1. ORDINANCE NO. 1089 - ZONE CHANGE 92-001 (14442 HOLT AVENUE) Pursuant to the City Council's direction at the close of Public Hearing on May 4, 1992, concerning the subject application and related applications (Vesting Tentative Parcel Map 91-288, Variance 91-019 and Design Review 91-048), staff has prepared an ordinance for the Council's consideration approving the zone change application. Recommendation by the Community Development Department: a. Adopt the following Resolution No. 92-67 certifying the Negative Declaration for the project as adequate for the project: RESOLUTION NO. 92-67 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION AS ADEQUATE FOR ZONE CHANGE 92-001, VESTING TENTATIVE PARCEL MAP 91-288, VARIANCE 91-019 AND DESIGN REVIEW 91-048 INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT b. URGENCY ORDINANCE NO. 1088 - PUSHCART Adoption of Urgency Ordinance No. 1088 would provide interim regulations for the operation of pushcarts within the City of Tustin during the period that a permanent ordinance can be developed, considered, and adopted by the City Council. Recommendation by the Community Development Department: a. Provide direction to staff regarding pushcart regulations. b. Have first reading by title only and introduction of Urgency Ordinance No. 1088. c. NEW BUSINESS 1. ORAL REPORT - TILLER DAYS 1992 Representatives from Tustin Tiller Days will be present to provide the City Council with an update for the 1992 celebration and request financial support from the City Council for 1992. Recommendation: Pleasure of the City Council. 2. REQUEST FOR TREE REMOVAL - 14652 ALDER LANE Resident, Mrs. Cecere, is appealing previous decisions by staff and is requesting that the magnolia tree in front of her residence at 14652 Alder Lane be removed and not be replaced. Recommendation: Pleasure of the City Council. 3. COMMISSION/COMMITTEE VACANCIES OCCURRING JULY 20, 1992 On July 20, 1992, terms will expire for three members of the Planning Commission, three members of the Parks and Recreation Commission and two members of the Cultural Resources Advisory Committee. Recommendation: Provide staff with direction for filling vacancies on the Planning Commission, Parks and Recreation Commission and Cultural Resources Advisory Committee occurring on July 20, 1992, as recommended by the Office of the City Clerk. 4. COMMUNITY SURVEY RESULTS AND SUMMER PROGRAM RECOMMENDATIONS One of the goals of the Community Improvement Partnership Program (CIPP) Task Force has been to address recreation and community service issues in the neighborhoods of Southwest Tustin. Recommendation: (1) Receive and file survey results, (2) Appropriate $6,500 for summer youth programs and ( 3 ) Authorize the Community Improvement Partnership Program (CIPP) Task Force to develop a "Community Action Team" consisting of appropriate CIPP representatives and other community services providers as recommended by the Community Improvement Partnership Program Task Force. 5. REQUEST FROM MR. PHILIP COX TO ADDRESS THE CITY COUNCIL At the last City Council meeting, Mr. Philip Cox requested permission to address the City Council on May 18, 1992, regarding Old Town. Recommendation: Pleasure of the City Council. 6. RECOMMENDATION TO FILL WATER BOARD VACANCY After a lengthy period of advertising, staff has received a letter of interest from a qualified applicant wishing to serve on the City of Tustin Water Corporation Board of Directors. AUDIT COMMITTEE VACANCY A vacancy has existed on the Audit Committee since the resignation of Ms. Cheryl Gunderson in December, 1991. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - MAY 11, 1992 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of May 11, 1992. 2. FREEWAY CONSTRUCTION STATUS REPORT Report relates to freeway and local street cl.osures in the Tustin area. Recommendation: Receive and f ile subject report as recommended by the Public Works Department/Engineering Division. 3. STATUS REPORT - ST. JEANNE DE LESTONNAC SCHOOL PUBLIC RIGHT-OF-WAY ACCESS A meeting with Caltrans staff, the school and the City was held on March 5, 1992, to discuss pedestrian visibility, feasibility of re-routing pedestrian activity, conversion of Stoneglass to public street, and continued access to Main Street. APPROVAL OF DEMANDS Recommendation: Approve Demands in the amount of $96,591.78. 5. DESIGN REVIEW 91-50 (15491 PASADENA AVENUE) The applicant is requesting approval for construction of twelve (12) garages and three ( 3 ) parking spaces adjacent to an existing apartment complex. Recommendation: Approve Design Review 91-50 by adopting the following Resolution No. RDA 92-05 as recommended by the Community Development Department: RESOLUTION NO. RDA 92-05 - A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESIGN REVIEW 91- 50 FOR THE CONSTRUCTION OF TWELVE (12) GARAGES, THREE (3) PARKING SPACES AND SITE IMPROVEMENTS AT THE APARTMENT COMPLEX LOCATED AT 15491 PASADENA AVENUE 6. STATUS REPORT - CIVIC CENTER EXPANSION PROJECT At the Agency's regular meeting on May 4, 1992, Agencymember Potts requested that the Agency be provided with basic background information and a status report on the Civic Center Expansion Project.
