HUSTON, CITY MANAGER F13OM: COMMUNITY DEVELOPMENT DEPARTMENT , 10JECT: FINAL TRACT MAPS 14381 AND 14567 RECOMMENDATION It is recommended that the City Council adopt Resolution No. 92-65 approving Final Tract Maps 14381 and 14567. BACKGROUND On August 12, 1991, the Planning Commission adopted Resolution No. 2937 recommending to the City Council approval of Vesting Tentative Tract Map 14381. The City Council approved Vesting Tentative Tract Map 14381 on September 3, 1991, by adopting Resolution. No. 91-115. These approvals included numerous conditions to be net prior to approval of the final map, with which the applicant has complied. The Final Maps are now ready for recordation with the Orange County Recorders Office. Prior to recordation, the Final Maps must be reviewed and approved by the Planning Commission and City Council. The Planning Commission recommended approval of the Final Maps at their May 11, 1992 meeting by adopting Resolution No. 3025. Pursuant to Section 66456.1 of the Subdivision Map Act, a subdivider may file multiple final maps prior to the expiration of the vesting tentative tract map. Included in the Conditions of Approval for Vesting Tentative Tract Map 14381, was a requirement that multiple final maps would be permitted so long as the map containing the recreation facility was filed first or concurrently with any other maps. Final Map 14381 includes the recreation facility and is comprised mostly of Lot 2 of Tract 13627 while Final Map 14567 is being filed for that portion comprised mostly of Lot 3 of Tract 13627. Both Final Maps are being filed and compared with Vesting Tentative Tract Map 14381. These Final Maps combined will provide for the development of 155 single-family dwelling units and are bound on the north by Patriot Way, by Lot 4 of Tract 13627 to the south, by Jamboree Road to the east and by Pioneer Road to the west. City Council Final Tract May 18, 1992 Page 2 CONCLUSION Report Maps 14381 and 14567 The resolutions approving the tentative tract maps for these projects included numerous conditions which were required to be satisfied prior to recordation. All required conditions have been met. Staff has determined that the Final Maps are in conformance with the Vesting Tentative Tract Map approvals, requirements of the East Tustin Specif is Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. That Final Tract Maps 14381 and 14567 have been submitted by California Pacific Homes. B. That a public hearing was held by the Planning Commission on August 12, 1992. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 14381 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14381 on September 3, 1991. C. That following tentative map approval, the applicant filed Final Tract Maps 14381 and 14567. D. That on May 11, 1992, the Planning Commission recommended approval of Final Maps 14381 and 14567 to the City Council by adopting Resolution No. 3025. E. Section 66456.1 of the. Subdivision Map Act permits a subdivider to file multiple final maps prior to the expiration of the vesting tentative tract map. F. The Final Maps are considered ministerially exempt pursuant to Section 15268(B) of the California Environmental Quality Act. G. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, the Development Agreement and Subdivision Map Act as it pertains to the development of residential units. H. The 1.581 acres of parkland required for this development was previously dedicated with recordation of Tract 13627. I. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 14381 on School. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at -large, for access through or use of the property within the proposed subdivision. N. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. O. That the Final Map is in substantial conformance with the Vesting Tentative Tract Map. II. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That Final Tract Maps 14381 and 14567 have been submitted by California Pacific Homes. B. That a public hearing was held by the Planning Commission on August 12, 1992. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 14381 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14381 on September 31 1991. C. That following tentative map approval, the applicant filed Final Tract Maps 14381 and 14567. D. Section 66456.1 of the Subdivision Map Act permits a s41 ubdivider to file multiple final maps prior to the expiration of the vesting tentative tract map. E. The Final Maps are considered ministerially exempt pursuant to Section 15268(B) of the California Environmental Quality Act. F. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, the Development Agreement and Subdivision Map Act as it pertains to the development of residential units. G. The 1.581 acres of parkland required for this development was previously dedicated with recordation of Tract 13627. H. That the City has reviewed the status of the School. Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 14381 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. 1 2 3 4 5 6 T 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 2E Z 2� Resolution No. 3025 Page 2 I. That the site is physically suitable for the type of development proposed. J. That the site is physically suitable for the proposed density of development. K. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. L. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at -large, for access through or use of the property within the proposed subdivision. M. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. N. That the Final Map is in substantial conformance with the Vesting Tentative Tract Map. II. The Planning Commission hereby recommends to the City Council approval of Final Tract Maps 14381 and 14567 subject to final approval by the City Engineer.
