A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN DETERMINING THAT THE LOCATION,
PURPOSE, AND EXTENT OF A PROPOSED CONVEYANCE OF
EIGHT (8) RESIDENTIAL UNITS LOCATED AT 14741 AND 14751
NEWPORT AVENUE OWNED BY THE CITY OF TUSTIN TO THE
ORANGE COUNTY RESCUE MISSION CONFORMS WITH THE
TUSTIN GENERAL PLAN
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A. That the City of Tustin proposes to convey eight (8) residential units
located at 14741 and 14751 Newport Avenue owned by the City to
the Orange County Rescue Mission.
B. That the proposed conveyance is associated with the provision of
transitional housing for homeless Veterans, which is recognized in
the City's Housing Element of the General Plan.
C. That California Government Code Section 65402 (c) provides that a
local agency such as the City shall not convey real property until the
location, purpose, and extent of the project has been submitted to
and reported upon by the local planning agency as to the conformity
with the applicable, adopted general plan.
D. The proposed disposition supports several General Plan Housing
Element goals and policies, including the following:
1. Housing Element Goal 1: Provide an adequate supply of
housing to meet the need for a variety of housing types and
the diverse socio- economic needs of all community residents.
2. Housing Element Policy 1.11: Encourage the availability of
affordable housing for special needs households, including
large, low- income families. Special needs households include
the elderly, large families, female- headed households with
children, households with a disabled person, and the
homeless.
3. Housing Element Policy 1.14: Provide continued support for
the County Homeless Assistance Program and other
homeless assistance programs within Tustin and in adjacent
cities.

4. Housing Element Policy 1.15: Encourage the provision of
grants and technical assistance to various organizations and
agencies that provide assistance to persons with special
needs such as the homeless, disabled, low- income, and
elderly persons.
E. That the properties were originally acquired by the City for rights -of-
way needs associated with Newport Avenue Extension project in
compliance with the Circulation Element of the General Plan.
Proper deed restrictions will be placed on the properties requiring
the properties be reverted back to the City if and when Newport
Avenue Extension Project Phase II is required.
F. That subsequent entitlement application will be obtained by the
OCRM to establish the transitional housing use within the Multiple
Family Residential (R3) District.
G. That general plan conformity determinations required by
Government Code Section 65402 are not "projects" requiring
environmental review pursuant to the California Environmental
Quality Act.
II. The Planning Commission hereby determines that the location, purpose,
and extent of a proposed conveyance of eight (8) residential units located at
14741 and 14751 Newport Avenue to OCRM for transitional housing for
homeless Veterans conforms with the Tustin General Plan.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a
regular meeting held on the 9t" day of December, 2014.
