HomeMy WebLinkAboutPC MIN 10-28-14MINUTES REGULAR MEETING TUSTIN PLANNING COMMISSION OCTOBER 28, 2014 7:00 p.m. CALL TO ORDER Given INVOCATION /PLEDGE OF ALLEGIANCE: Commissioner Smith ROLL CALL: Present: Chairperson Thompson Chair Pro Tern Lumbard Commissioners Altowaiji, Kozak, Smith PUBLIC CONCERNS: Residents living in the Meadows and Laurelwood areas (Ms. Marsha Lindsey, Barbara Schroer and Mike Krupa) spoke in opposition of a stadium possibly being proposed at Tustin Legacy. Their collective concerns were related to traffic, noise, pollution, impacts on health, and quality of life. The speakers noted that petitions in opposition are being circulated and signatures are being gathered. Binsack Binsack stated that there are preliminary discussions with the City Manager's Office but no formal applications are currently pending with the City. PRESENTATION/WORKSHOP: Adopted 1. DRAFT CITY OF TUSTIN CULTURAL RESOURCES DISTRICT Resolution COMMERCIAL DESIGN GUIDELINES — PUBLIC WORKSHOP No. 4272, as amended. The Commercial Design Guidelines (CDG) serves as a guide to assist property owners, architects, contractors, and other design professionals in understanding the City's goals for the preservation of historically significant buildings and neighborhoods. Another purpose is to provide basic principles for achieving quality design and development compatible with the character of the Cultural m Resources District (CRD); the guidelines are intended to help property owners and design professionals in designing projects that are acceptable and consistent with the design criteria and standards established for the CRD. RECOMMENDATION: That the Planning Commission conduct a public workshop and if deemed appropriate, adopt Resolution No. 4272 recommending that the City Council approve the CDG for the CRD. Binsack Binsack suggested that Thompson invite audience members, who might be interested in providing input, to speak on the item since the item is the final public workshop. None Public Comments Kozak Kozak had favorable comments regarding the CDG and was supportive of the recommended action. Thompson Thompson requested clarification from legal counsel on the actions taken by the California Federal Political Practices Commission (FPPC) report regarding Commissioners Altowaiji and Thompson's participation with the action of the item and whether or not there would be a conflict of interest. Bobak In response to Thompson's request, Bobak provided background information on the City's inquiry to the FPPC requesting advice on regulations relating to members of governing agencies participation when they have a financial interest in the regulations being adopted and whether the regulations would affect their property (home or business) owned by either the public official or member of the public official's family. In May 2014, the FPPC gave advice stating Altowaiji and Thompson did not have a conflict of interest because there was no reasonable foreseeability that the CDG would have a material or financial effect on properties they own. Altowaiji Altowaiji commented on the FPPC's advice to legal counsel and was in support of the item. Smith Smith asked staff if the CDG were presented to MIG, and was also in support of the item. Binsack In response to Smith's question, Binsack stated MIG was given a copy of the CDG for informational purposes, not to review. Lumbard Lumbard thanked staff for the work put into the CDG and had favorable comments on the item. Thompson Thompson provided additional favorable comments. Motion: It was moved by Kozak, seconded by Lumbard, to adopt Resolution No. 4272, as amended. Motion carried 5 -0. Approved CONSENT CALENDAR: Minutes — Planning Commission — October 28, 2014 — Page 2 of 6 2. APPROVAL OF MINUTES — OCTOBER 14, 2014, PLANNING COMMISSION MEETING. RECOMMENDATION: That the Planning Commission approve the Minutes of the October 14, 2014 meeting as provided. Smith Smith requested one minor change be made to the Minutes (remove "ing" from "Park" on Page 4). 3. TRANSMITTAL OF DRAFT SUBDIVISION MANUAL On September 3, 2013, the City Council adopted Ordinance No. 1430 approving Code Amendment 2013 -002, a comprehensive amendment to the Tustin Subdivision Code, primarily to simplify and streamline the subdivision process. Section 9311 e of the Subdivision Code provides the Director of Community Development with the authority to generate a Subdivision Manual that contains the rules, procedures and interpretations as may be necessary to administer the Subdivision Code. Since the Draft Subdivision Manual is a major revision to the previous Manual, it is being forwarded to the Planning Commission for review, input and concurrence. RECOMMENDATION: That the Planning Commission receive the Community Development Department's draft update of the City's Subdivision Manual and set the item for formal consideration on December 9, 2014. Binsack Binsack reminded the Commission that the existing Subdivision Manual and supplemental changes made to the updated manual were provided to them that evening for review. She also mentioned the change in date of the next scheduled Commission meeting (tentative meeting), due to the Veteran's Day holiday. Thompson Thompson asked for clarification on the action of the item and whether or not the Commission needed to provide input at the meeting. Binsack Binsack's response to Thompson's question was that the Commission would have time to review then provide input at the December 9, 2014 meeting. Motion: The Consent Calendar was moved in two (2) motions. It was moved by Smith, seconded by Altowaiji, to approve the Minutes, as amended. Motion carried 5 -0. Minutes — Planning Commission — October 28, 2014 — Page 3 of 6 It was moved by Smith, seconded by Kozak to receive and review the item then continue the item to the December 9, 2014 Planning Commission meeting. None. PUBLIC HEARING REGULAR BUSINESS: 4. DOWNTOWN COMMERCIAL CORE PLAN UPDATE The purpose of this report is to update the Planning Commission on the progress made to date on the preparation of the Downtown Commercial Core Plan (DCCP) and provide the Planning Commission the current schedule for project completion. RECOMMENDATION: That the Planning Commission receive and file this report. The meeting recessed at 7:30 p.m. The meeting reconvened at 7:33 p.m. Thompson Thompson recused himself since he owns property in the Old Town area, which could potentially be affected by the update given. Binsack Presentation given. Lumbard Lumbard had favorable comments for the consultant of the DCCP, MIG, and the October 1, 2014 workshop. He hopes to see more residents participate at the second workshop on December 4, 2014. Motion: It was moved by Altowaiji, seconded by Kozak. Motion carried 4 -0 -1. 5. SUMMARY OF PROJECTS The following report provides a summary of projects and activities since the last report which was presented at the July 8, 2014, Planning Commission meeting. The report focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved; major improvement projects; Certificates of Appropriateness; Code Enforcement activities; and, other items which may be of interest to the Commission. RECOMMENDATION: That the Planning Commission receive and file this item. Presented by: Adrianne DiLeva- Johnson, Sr. Management Assistant Minutes — Planning Commission — October 28, 2014 — Page 4 of 6 Smith Smith asked about the delay in opening the Union Market at the District and whether it was due to construction, permitting, or if there were issues with their "unique footprint ". He also asked if the market was currently open and if the existing processes (inspections, permitting) was easily handled by staff. Ogdon Ogdon's response to Smith's questions generally included: Delays were due to the construction; some tenants were going through tenant improvements; tenants were operating with a temporary occupancy permit which will end in early November; and, the market is currently open but the individual tenants are not. Kozak Kozak thanked staff for the work involved in all the projects presented and he thanked DiLeva- Johnson for another great report. Thompson Thompson was impressed with the Amalfi advertisements all over Tustin as well as with the Memorial Care filling the vacant buildings at Red Hill Ave. /Irvine Blvd. Smith Smith thanked staff for the graffiti map. Lumbard Lumbard was impressed with the decrease in graffiti incidents in FY 2014/15 compared with the last four (4) years. He also had favorable comments for the Graffiti Program. Motion: It was moved by Altowaiji, seconded by Smith, to receive and file the report. Motion carried 5 -0. STAFF CONCERNS: Binsack Binsack's updates to the Commission generally included: Upcoming California Preservation Foundation webinars; clarification on the Commission's adjournment date being November 12, 2014; and currently, no items planned for the November Planning Commission meetings. COMMISSION CONCERNS: Smith No concerns. Lumbard Lumbard reminded everyone of Veterans Day and to be sure to "thank those who have secured our freedom ". He commended the City of Tustin on all of the ongoing projects. Kozak Kozak thanked staff for the outreach to the public and Commission on the CDG.
