HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS: WATER MAIN SUBJECT: REPLACEMENTS ON NISSON ROAD FROM NEWPORT AVENUE TO RED HILL AVENUE AND ON EL CAMINO REAL FROM NEWPORT AVENUE TO ORANGE STREET; AND STREET REHABILITATION ON NISSON ROAD FROM NEWPORT AVENUE TO RED HILL AVENUE, A DISADVANTAGED BUSINESS ENTERPRISE PROJECT, PARTICIPATION GOAL 10% (FOR STREET REHABILITATION ONLY) (PROJECT NOS. 600086 AND 700108, P.W. FILE NO. R90-3) RECOMMENDATION It is recommended that the City Council at'their meeting of May 18, 1992 adopt the attached resolutions accepting said work and authorizing the recordation of Notices of Completion. Assuming no new claims or stop payment notices are filed, it is further recommended that 35 days after the date of recordation of the notice of completion, that the Council authorize payment of the final 10% retention amount of $29,997.99. This amount, together with previous payments of $269,981.91 represents 100% of the final contract amount. BACKGROUND The 1990-91 FY Budget allocated $160,500.00 for water replacement on Nisson Road and $93,000.00 from the General Fund plus $10,300.00 (an estimated amount) from SB -140 funds for street rehabilitation on Nisson Road. An additional $40,000.00 from the General Fund was allocated in 1991-92 FY Budget. The final amount of reimbursement, to the City, of SB -140 Gas Tax Monies will be $22,492.00. The Contractor's certification indicates a 12% Disadvantaged Business Enterprise (DBE) participation level. The work has been completed to the satisfaction of the Engineering Division. The final contract amount is $299,979.90. This represents an increase of 3.7 percent over the original contract amount of $289,225.25. The majority of the increase was due to increased asphalt pavement quantities. Robert S. Ledendecker _ Director of Public Works/ City Engineer RSL:kIb:NISSON Nestor Mondok Assistant Civil Engineer 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 -25 26 27 28 RESOLUTION NO. 92-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE WATER MAIN REPLACEMENTS ON NISSON ROAD FROM NEWPORT AVENUE TO RED HILL AVENUE AND ON EL CAMINO REAL FROM NEWPORT AVENUE TO ORANGE STREET, PROJECT NO. 600086 WHEREAS, Sully -Miller Contracting Company, having a contract with the City of Tustin to construct the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned, in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the notice of completion, and acceptance of said public work and improvement should be filed and payment of the balance due of said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Water Main Replacements on Nisson Road from Newport Avenue to Red Hill Avenue and on E1 Camino Real from Newport Avenue to Orange Street, Project No. 600086 AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be and is hereby authorized to execute and file a notice of completion and acceptance of said public work and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 18th day of May, 1992.
