HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: REQUEST FOR TREE REMOVAL - 14652 ALDER LANE RECOMMENDATION Pleasure of the City Council. BACKGROUND A resident, Mrs. Cecere at 14652 Alder Lane (Peppertree Subdivision) has requested the removal of a street tree in front of her residence. This tree is a mature Magnolia tree and was planted as a part of the development of Tract No. 8912 in 1976. Alder Lane has mature Magnolia trees on both sides of the street. In March, 1991, the City Council passed and adopted Ordinance No. 1051 amending the Tustin City Code relative to parkway trees and shrubs. Section 7306 and 7307 of the ordinance state the following: Section 7306: Removal and/or replacement (a) the Manager of Field Services shall be authorized to remove trees which have been determined to be blighted, diseased or unsafe to the public. Trees removed by the City will be replaced within a reasonable time by the City with a tree from the City approved list of trees. (b) Request from an adjacent property owner for the removal of a healthy tree specimen in the public right-of-way shall be evaluated by the Manager of Field Services or his/her designated representative. A healthy tree specimen will not be removed unless it has caused damage to adjacent property or is determined to be unsafe. Section 7307: Right of Appeal Any determination of the Manager of Field Services may be appealed in writing, to the Director of Public Works, and ultimately to the City Council. DISCUSSION Mrs. Cecere is appealing the previous decisions of staff and myself and is requesting that the Magnolia tree in front of her residence at 14652 Alder Lane be removed and not be replaced with any tree. Her request is based upon the tree's loss of leaves and that it is continuously messy. Staff has reviewed the request and has determined that the Magnolia tree is healthy and it is not causing damage to the adjacent property or damage to the sidewalk and curb/gutter. Per Section 7305 of Ordinance No. 1051, staff is not authorized to remove this tree. Section 7307 of the ordinance provides the right of appeal to the City Council. Mrs. Cecere has indicated that she wishes to exercise this right of appeal and requests that the City Council authorize the removal of the Magnolia tree in front of her residence. Robert S.
