HUSTON, CITY MANAGER F110MJ: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL TRACT MAP 14 610 RECOMMENDATION It is recommended that the City Council adopt Resolution No. 92-58, as submitted or revised, approving Final Tract Map 14610. BACKGROUND On February 10, 1992, the Planning Commission adopted Resolution No. 3007 recommending to the City Council approval of Vesting Tentative Tract Map 14610, a request to subdivide 23.9 acres into six (6) numbered lots to allow construction of a retail/ commercial center. The City Council approved Vesting Tentative Map 14610 on March 2, 1992, by adopting Resolution No. 92-26. This approval included numerous conditions to be met prior to approval of the Final Map, with which the applicant has complied. On April 27, 1992, the Planning Commission adopted Resolution No. 3028, recommending approval of Final Tract Map 14610 to the City Council. The Final Map is now ready for recordation with the Orange County Recorder's Office. Prior to recordation, the Final Map must be reviewed and approved by the City Council. The site is bordered by E1 Camino Real, Tustin Ranch Road, Bryan Avenue and Myford Road. A variety of land uses are in the vicinity including residences to the north and west, and Tustin Auto Center to the south. The Tustin Market Place is to the east. CONCLUSION The resolution approving the Tentative Tract Map 14610 included numerous conditions which were required to be satisfied prior to recordation. All required revisions and conditions have been met. Staff has determined that the Final Map is in conformance with the -- Tentative Map approval, requirements of the East Tustin Specific Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act. The City Council finds and determines as follows: A. That Final Tract Map No. 14610 has been submitted by Irvine Retail Properties Company. B. That a Public Hearing was held by the Planning Commission on February 10, 1992. At that hearing, the Planning Commission recommended approval of Vesting Tentative Tract Map 14610 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14610 on March 2, 1992. C. That following tentative map approval, the applicant filed Final Tract Map 14610 which conforms with the approved tentative tract map. D. The Planning Commission recommended approval of Final Map 14610 to the City Council on April 27, 1992. E. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to commercial development. F. That no dedication of parkland was required for this development. G. That the site is physically suitable for the type of development proposed. I. That the site is physically suitable for the proposed density of development. J. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. K. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at - large, for access through or use of the property within the proposed subdivision. L. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. M. That the Final Map is in substantial conformance with the Tentative Map. N. That the project is considered Ministerially Exempt pursuant to Section 15268(B) of the California Environmental Quality Act. II. The City Council hereby approves Final Tract Map No. 14610 subject to final approval of the City Engineer.
