PUBLIC CONCERNS The meeting recessed at 7:03 p.m. to restore audio. The meeting reconvened at 7:05 p.m. Approved. CONSENT CALENDAR 1. APPROVAL OF MINUTES — OCTOBER 28, 2014, PLANNING COMMISSION MEETING. RECOMMENDATION: That the Planning Commission approve the minutes of the October 281 2014 meeting as provided. 2. GENERAL PLAN CONFORMITY DETERMINATION A request for a General Plan Conformity finding for conveyance of eight (8) residential units located at 14741 and 14751 Newport Avenue owned by the City of Tustin to the Orange County Rescue Mission. APPLICANT: PROPERTY OWNER: LOCATION: ENVIRONMENTAL: CITY OF TUSTIN CITY OF TUSTIN 14741 -14751 NEWPORT AVENUE General Plan Conformity Determinations required by Government Code Section 65402 are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. Minutes — Planning Commission — December 9, 2014 — Page 1 of 7 RECOMMENDATION: That the Planning Commission adopt Resolution No. 4275 determining that the conveyance of eight (8) residential units located at 14741 -14751 Newport Avenue owned by the City of Tustin to the Orange County Rescue Mission is in conformance with the Tustin General Plan. 3. 2014 CERTIFIED LOCAL GOVERNMENT (CLG) ANNUAL REPORT The 2014 CLG Annual Report summarizes the City's historic presentation efforts and describes how the City met all of the minimum requirements of the CLG program during the 2013/14 reporting period. RECOMMENDATION: That the Planning Commission direct staff to forward the Annual Report to the State Office of Historic Preservation. Motion: It was moved by Kozak, seconded by Lumbard, to approve the Consent Calendar. Motion carried 5 -0. PUBLIC HEARINGS: Continued to a 4. CONDITIONAL USE PERMIT (CUP) 2014 -15 & DESIGN date certain. REVIEW (DR) 2014 -009 CUP 2014 -15 and DR 2014 -009 is a request for an unmanned wireless communication facility consisting of a sixty (60) foot tall mono - eucalyptus faux tree with twelve (12) panel antennas and associated equipment mounted to the structure at 14861 Franklin Avenue in the Planned Community Industrial (PC IND) Zoning District. The applicant has requested a second continuance to provide more time to determine the viability of co- locating on an existing wireless facility on the same site that is scheduled to be decommissioned, or the option of proposing the facility at a different location on the site. RECOMMENDATION: Staff is recommending that the Planning Commission continue their consideration of CUP 2014 -15 and DR 2014 -009 to February 101 2015, to provide adequate time for the applicant to explore all options and prepare revised plans and photo simulations, and for staff to review the revised plans and prepare for the public hearing. Motion: It was moved by Altowaiji, seconded by Kozak, to continue CUP 2014- 15 and DR 2014 -009 to the February 10, 2015 Planning Commission meeting. Motion carried 5 -0. Adopted 5. CONDITIONAL USE PERMIT (CUP) 2014 -18 Resolution No. 4274. A request to establish a master sign plan to allow community and model home signage at the Greenwood Residential Community. APPLICANT/ Sean Doyle PROPERTY OWNER: Standard Pacific Corporation 15630 Barranca Parkway Irvine, CA 92618 LOCATION: Tract 17507 at Tustin Legacy 250 Downs Road ENVIRONMENTAL: This project is categorically exempt pursuant to Section 15311 (Class 11) of the California Environmental Quality Act (CEQA). RECOMMENDATION: That the Planning Commission adopt Resolution No. 4274 approving CUP 2014 -18 to authorize the establishment of a master sign plan for the Greenwood Community at Tustin Legacy which deviates from the standards contained within the Tustin City Sign Code. 7:08 p.m. Public Hearing opened /closed. Kozak Kozak had favorable comments regarding the item. Bobak Bobak stated, for the record, that the all agenda reports were available online for the public's review and the Commission's review 72 hours prior to the meeting. Altowaiji Altowaiji had concerns with regard to the "standard deviation" for the size of the signs, although he was in favor of the project. Smith Smith had favorable comments regarding the item. Thompson Thompson had favorable comments regarding the item. Motion: It was moved by Kozak, seconded by Smith to adopt Resolution No. 4274. Motion carried 5 -0. CONDITIONAL USE PERMIT (CUP) 2014 -24 FOR MASTER SIGN PLAN FOR TUSTIN LEGACY TEMPORARY PROJECT IDENTIFICATION SIGNS A request to establish a master sign plan to allow temporary project identification signs at various locations within Tustin Legacy. APPLICANT: City of Tustin Attn: Jeffrey C. Parker 300 Centennial Way Tustin, CA 92780 PROPERTY OWNER: City of Tustin Attn: Jeffrey C. Parker 300 Centennial Way Tustin, CA 92780 LOCATION: Tustin Legacy ENVIRONMENTAL: This project is categorically exempt pursuant to Section 15311 (Class 11) of the California Environmental Quality Act (CEQA). RECOMMENDATION: That the Planning Commission adopt Resolution No. 4273 approving CUP 2014 -24 to authorize establishment of the Master Sign Plan for Tustin Legacy Temporary Project Identification Signs, as required by the Tustin Sign Code. Due to conflicts of interest, Lumbard and Smith recused themselves from the item. Bobak Bobak clarified to the Commission that the project site is technically the entire district. Public Hearing opened /closed at 7:15 p.m. Kozak Kozak asked staff to clarify the intent of a master sign plan and that the purpose is to provide guidance for future sign programs /developments at the Tustin Legacy. Reekstin Reekstin confirmed Kozak's statement and stated the purpose of a master sign plan is for future individual developments. Minutes — Planning Commission — December 9, 2014 — Page 4 of 7 Altowaiji Altowaiji's concerns generally included: Size and number of signs; wood vs. metal posts and durability; and the signs interfering with the public right -of -way. Binsack Binsack's explanation to Altowaiji's concern generally included: Size of site encompasses over 800 acres; reference to the larger signs at the Market Place and the District; the signs would be in both private and public rights -of -way but would not interfere; and noted the intended purpose of a master sign program is for projects of this magnitude. Reekstin Reekstin further responded to Altowaiji's concern with "size" stating that the signs would be installed on a temporary basis, and are primarily located in undeveloped areas; wood construction for the temporary signs would be appropriate for a temporary basis. Thompson Thompson asked if the signs would be installed and maintained by the present builders or the City. Buchanan Buchanan further stated that the signs would be installed by a contractor maintained by the City on a quarterly basis. The purpose is for identification of Tustin Legacy and that the boundaries are well known and that the temporary signs will serve the purpose of showing content, direction, and land uses until the permanent signs are installed. Thompson Thompson had favorable comments with regard to the bus stop and the use of the street lights for signage. Motion: It was moved by Kozak, seconded by Altowaiji, to adopt Resolution No. 4273. Motion carried 3 -0 -2. REGULAR BUSINESS: Received and 7. SUBDIVISION MANUAL filed. On September 3, 2013, the City Council adopted Ordinance No. 1430 approving Code Amendment 2013 -002, a comprehensive amendment to the Tustin Subdivision Code. Section 9311e of the Subdivision Code provides the Director of Community Development with the authority to generate a Subdivision Manual that contains the rules, procedures and interpretations as may be necessary to administer the Subdivision Code. RECOMMENDATION: That the Planning Commission receive and file the Subdivision Manual. Binsack Binsack stated staff responded to comments made by Thompson and no further comments from the other Commissioners. Motion: It was moved by Lumbard, seconded by Smith, to receive and file the Subdivision Manual. Motion carried 5 -0. STAFF CONCERNS: Binsack thanked the Commission for their attendance at the December 4t" Downtown Commercial Core Plan (DCCP) Workshop #2. An update to be provided at a Planning Commission meeting in January or February and wished all in attendance Happy Holidays! COMMISSION CONCERNS: Kozak Kozak attended the following events: • 11/20 - Mayor's Thanksgiving Breakfast • 12/2 — City Council meeting — Congratulations to Mayor Puckett and Mayor Pro Tern Nielsen. • 12/4 — DCCP Workshop #2 — Kozak had favorable comments for MIG. • 12/5 — The City's 30th Annual Christmas Tree Lighting In remembrance, December 7th was the 73rd anniversary of the Japanese attack on Pearl Harbor and wished all in attendance Happy Holidays! Altowaiji Altowaiji asked staff if there would be a Planning Commission meeting on December 23rd and wished all in attendance Happy Holidays! Binsack In response to Altowaiji's question on the scheduled December 23rd Planning Commission meeting, Binsack asked that the Commission to adjourn until January 13, 2015 and that the December 23rd meeting would be canceled; and, wished all in attendance Happy Holidays! Smith Wished all in attendance Happy Holidays!
