FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS AND NOTICE OF COMPLETION FOR
SUBJECT: WATER MAIN REPLACEMENT PROJECTS ON THEODORA DR., LIVINGSTON AVE.,
LILLIAN WAY, CANDEDA PL., ROMANZA PL., LEON PL., AND LEON WAY
RECOMMENDATION
That the City Council at their meeting of April 21, 1992 accept the
improvements constructed and authorize the recordation of the Notice
of Completion for said improvements with the adoption of the attached
resolution.
Assuming no claims or stop payment notices are filed, it is further
recommended that 35 days after the date of recordation of the Notice
of Completion the Council authorize payment of the. final 10% retention
amount of $34,720.94. This amount together with previous payments of
$312,488.45 represents 100% of the final contract amount.
BACKGROUND
This project encompasses replacement of deteriorated water main lines
on Theodora Drive, Livingston Avenue, Lillian Way, Candeda Place,
the unincorporated
Romanza Place, Leon Place, and Leon Way, in
territory of Orange County.
DISCUSSION T
All work on this project has been completed by the contractor R.L. .
Construction, Inc. to the satisfaction of the Public Works
Department/Engineering Division. The final contract amount for this
project was $347,209.39. This represents an increase of 8.1 percent
over the original contract amount of $319,198.00. The final contract
amount is $18,790.61 below the amount budgeted for this work. The
additional costs involved those associated with sawcutting asphalt
concrete and Portland cement concrete, replacement of curb and gutter,
installation of additional asphalt concrete and installation of 10"
water main fittings.
The project was funded by the 1991-92 Capital Improvement Budget.
The attached resolution accepts the works of improvements and
authorizes the recordation of the Notice of Completion.

RESOLUTION NO. 92-55
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING
RECORDATION OF NOTICE OF COMPLETION FOR THE WATER MAIN
REPLACEMENT ON THEODORA DR., LIVINGSTON AVE., LILLIAN WAY,
CANDEDA PL., ROMANZA PL., LEON PL., AND LEON WAY (PROJECT NOS.
600088 & 600093)
WHEREAS, R.L.T. Construction,.,Inc. , having a contract with the
City of Tustin to construct the hereinafter described public work
and improvement; and
WHEREAS, the City Engineer has duly certified to the
construction and completion of said public improvements hereinafter
mentioned in a manner satisfactory to the City Council of the City
of Tustin; and
WHEREAS, the City Council finds that said contractor has
completed said public improvement hereinafter more particularly
described in accordance with the provisions of the contract
documents and the Notice of Completion, and acceptance of said
public work and improvement should be filed and payment of the
balance due of said contract authorized in accordance with the
contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said public work and improvement be, and the same is
hereby accepted. Said public work and improvement is more
particularly described as follows:
The water main replacement on Woodland Drive, Theodora
Dr., Livingston Ave., Lillian Way, Candeda Pl., Romanza
P1., Leon Pl., and Leon Way (Project Nos. 600088 &
600093)
AND, BE IT FURTHER RESOLVED that the City Engineer of the City
of Tustin be and is hereby authorized to execute and file a Notice
of Completion and acceptance of said public work and improvement
described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin held on the 21st day of April, 1992.
