HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: OUTDOOR LOUDSPEAKERS AT THE CRAB COOKER RESTAURANT 17260 E. SEVENTEENTH STREET RECOMMENDATION Pleasure of the Council BACKGROUND The Crab Cooker restaurant has requested authorization to install loudspeakers in their outdoor waiting area adjacent to the main building entrance. According to the restaurant management, the purpose of the sound amplifying device is to provide music for patrons who wait outdoors for dining tables inside the restaurant, and to announce when a table has become available. The request can only be considered if an amendment to the Tustin City Code to allow outdoor loudspeakers or other sound amplifying devices on a case-by-case basis has been approved by the City Council. The restaurant is located on the corner of Yorba Street and Vandenberg Lane in the Enderle Center. The commercial center is zoned Planned Community; a townhouse development is located across Vandenberg Lane. See the attached vicinity and location maps. The main entrance to the restaurant and the outdoor waiting area are located on the east side of the building; two speakers, oriented toward the seating, are proposed. See the attached site plan and elevations. In evaluating this request, the Council should consider the constitutional right of free speech of all persons, but should also consider possible impacts to nearby residents regarding the quiet enjoyment of their property. City Council Report Outdoor Loudspeakers at the Crab Cooker Restaurant April 21, 1992 Page 2 CONCLUSION Should the Council approve this request by Minute Order, Community Development Department staff recommends including the following conditions: 1. The installation of outdoor loudspeakers shall be subject to the approval of Ordinance 1083, which will be effective on May 20, 1992. 2. Loudspeakers shall be directed away from Vandenberg Lane and nearby residential areas. 3. All exterior sound amplifying devices shall comply with exterior noise standards, stated in Section 4614 of the Tustin City Code. 4. Should the Community Development Department receive written complaints or objections to noise caused by the outdoor loudspeakers, the Director of Community Development shall require a noise study and/or tests by a qualified professional to determine compliance with Section 4614 of the Tustin City Code and develop mitigation measures. The applicant for the loudspeaker request shall pay the cost of the study and/or tests, as well as implementation of any mitigation measures required by the Director. �i rl-ula R in Christine A.
