HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ON ACCEPTANCE OF PUBLIC IMPROVEMENTS WATER MAIN RELOCATION ON EL CAMINO WAY AND THE ALLEY BETWEEN EL CAMINO PLAZA AND 1-5 FREEWAY (PROJECT NO. 600095A, P.W. FILE NO. W9.1 -3A) RECOMMENDATION It is recommended that the City Council at their meeting of April 6, 1992 adopt the attached resolution accepting said work and authorizing the recordation of the Notice of Completion. Assuming no claims or stop payment notices are filed, it is further recommended that 35 days after the date of recordation of the notice of completion, that the Council authorize payment of the final 10% retention amount of $7,753.71. This amount, together with previous payments of $69,783.38 represents 100% of the final contract amount. BACKGROUND This project encompassed the relocation of water mains on El Camino Way and the alley between El Camino Plaza and I-5 Freeway to accommodate Caltrans I-5/SR-55 Interchange Project, Stage 3. The work has been completed to the satisfaction of the Engineering Division. The final contract amount for this project is $77,537.09. This represents a cost savings of 6.5 percent from the original contract amount of $82,918.40. . Awn Robert S. Ledend4cker Director of Public Works/ City Engineer RSL:NM:kIb:FINALACCEPT Nestor Mondok Assistant Civil Engineer 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 92-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE WATER MAIN RELOCATION ON EL CAMINO WAY AND THE ALLEY BETWEEN EL CAMINO PLAZA AND I-5 FREEWAY, PROJECT NO. 600095 WHEREAS, John T. Malloy and John T. Malloy, Inc. (Joint Venture) having a contract with the City of Tustin to construct the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the notice of completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: The Water Main Relocation on E1 Camino Way and the Alley between E1 Camino Plaza and I-5 Freeway, Project No. 600095 AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be and is hereby authorized to execute and file a notice of completion and acceptance of said public work and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 6th day of April, 1992. ATTEST: City Clerk Charles Puckett, Mayor
