SUBJECT: STAFF REPORT/VANDENBERG WELL SITE/ACCEPTANCE OF EASEMENT
As you recall, City and the Vandenberg well site property
owner ("Prospect Office Partners") have agreed to the purchase of
an easement to allow City's construction of a well site. This
Agenda item. is to present to the City. Council the grant deed
conveying the easement which will accommodate the construction of
the Vandenberg well site.
Attached is the Grant Deed which has been executed by the
property owner. Also attached is a resolution by the City Council
accepting the Grant Deed.
Upon City Council's adoption of the Resolution, the City will
pay the required compensation for the easement ($56,350.00) and the
deed will be recorded in the County Recorder's office.

RESOLUTION NO. 92-53
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, ACCEPTING THE GRANT DEED FOR
PERMANENT EASEMENT FROM PROSPECT OFFICE
PARTNERS.
(A portion of Parcel 7 of Parcel Map 88-179
Tustin, California)
WHEREAS, the City of Tustin and Prospect Office Partners have
entered into an Agreement for the conveyance of a permanent
easement to operate and maintain water well facilities on property
located at 17592 East 17th Street, Tustin, California; and
WHEREAS, the City and owner have agreed upon compensation for
the easement.
NOW, THEREFORE, be it resolved by the City Council of the City
of Tustin to accept the Grant Deed conveying a permanent easement
to operate and maintain municipal water well facilities and a
temporary construction easement to accommodate the construction of
said facilities, said Grant Deed attached as Attachment 1 and
incorporated herein by reference.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin held on the 6th day of APRIL , 1992.

FOR A VALUABLE CONSIDERATION, receipt of which is hereby
acknowledged,
PROSPECT OFFICE PARTNERS, a California limited partnership
hereby GRANTS to
THE CITY OF TUSTIN, a municipal corporation,
the real property in the City of Tustin, County of Orange, State of
California described as:
1. A permanent easement to operate and maintain
municipal water well facilities and related
appurtances, on the property more fully described
in Exhibit A, attached and incorporated herein by
reference, and including reasonable access thereto
over the common area of the property, more
particularly described in Exhibit A-1, attached and
incorporated herein by reference;
2. A temporary construction easement to accommodate
permanent water well facilities, which.yasement
shall automatically expire upon completion of the
water well facilities, and more fully described in
Exhibit B, attached and incorporated herein by
reference.

No. 88-404567 in Book 235, Pages 29 and 30 of Parcel Maps, Records of
Orange County, California, described as follows:
Beginning at the southeasterly corner of said Parcel No. 2, said
corner being on the northerly right-of-way line of Vandenberg Lane
(64' wide) ;
Thence, S. 88053108" W., along the southerly line of said Parcel 2
and said northerly right-of-way line, a distance of 22.00 feet to the
true -point of beginning;
Thence, continuing S. 88053'08" W. along said southerly line and
northerly right-of-way line, a distance of 2.14 feet to the beginning
of a tangent curve concave southeasterly and having a radius of 589.65
feet;

SUBJECT: VANDENBERG WELL SITE ACQUISITION
We have completed the process of the acquisition of the
Vandenberg well site easement. Please find attached a conformed
copy of the grant deed conveying the easement to City which was
recorded on April 9, 1992. City now has control of the area in
question. In addition, the property owner has been compensated for
the easement.
