DATE: MARCH 20, 1992 TO: HONORABLE MAYOR, MEMBERS OF THE CITY COUNCIL FROM: CITY ATTORNEY SUBJECT: STAFF REPORT/VANDENBERG WELL SITE/ACCEPTANCE OF EASEMENT As you recall, City and the Vandenberg well site property owner ("Prospect Office Partners") have agreed to the purchase of an easement to allow City's construction of a well site. This Agenda item. is to present to the City. Council the grant deed conveying the easement which will accommodate the construction of the Vandenberg well site. Attached is the Grant Deed which has been executed by the property owner. Also attached is a resolution by the City Council accepting the Grant Deed. Upon City Council's adoption of the Resolution, the City will pay the required compensation for the easement ($56,350.00) and the deed will be recorded in the County Recorder's office. ake JAM G. (A portion of Parcel 7 of Parcel Map 88-179 Tustin, California) WHEREAS, the City of Tustin and Prospect Office Partners have entered into an Agreement for the conveyance of a permanent easement to operate and maintain water well facilities on property located at 17592 East 17th Street, Tustin, California; and WHEREAS, the City and owner have agreed upon compensation for the easement. NOW, THEREFORE, be it resolved by the City Council of the City of Tustin to accept the Grant Deed conveying a permanent easement to operate and maintain municipal water well facilities and a temporary construction easement to accommodate the construction of said facilities, said Grant Deed attached as Attachment 1 and incorporated herein by reference. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 6th day of APRIL , 1992. Please find attached a conformed copy of the grant deed conveying the easement to City which was recorded on April 9, 1992. City now has control of the area in question.
