RESOLUTION NO. 92-49, RESCINDING EXCESSIVE WATER USE PENALTIES
SUBJECT: AS ESTABLISHED IN ORDINANCE NO. 1063, SECTION E.
RECOMMENDATION:
That the City Council, at its meeting of April 6, 1992, adopt
Resolution 92-49, rescinding excessive water usage penalties as
established in Ordinance No. 1063, a Mandatory Water Conservation
and Rationing Program.
BACKGROUND:
On April 1, 1991, in response to five consecutive years of drought,
and a requirement by the Metropolitan Water District of Southern
California (MWD) that the City reduce its imported water usage by
thirty percent, the City Council passed and adopted Ordinance No.
1063, a Mandatory Water Conservation and Rationing Program.
The Ordinance established allowable water usages for various types
of customers, provisions for variances in cases of hardship, and
provisions for monetary penalties if the allowable water usages
were exceeded. This program (and an unusually mild summer),
resulted in a sixteen percent reduction in water use for calendar
year 1991.
On March 27, 1992, the MWD Board of Directors voted to return to a
voluntary program requesting a ten percent reduction in water use.
MWD's decision was prompted by the actions taken by the State
Department of Water Resources, which released additional water to
its users resulting in an adequate supply of water for this year.
MWD cautions that the large state reservoirs still contain below
normal storage, and it may be necessary to return to more
restrictive rationing next year.
DISCUSSION:
The adoption of Resolution No. 92-49 will eliminate excessive water
use penalties as established in Ordinance No. 1063. Water bills
will still be structured in the same manner so that customers can
monitor their conservation efforts and note usage had the penalties

been in effect. Water will be billed at the current regular rates
of $.33 for the first 6 billing units and $.71 for all usage over
6 units.
If conditions change and more restrictive rationing is required,
the City Council will have the option of reinstating the penalties
by resolution.
Information concerning this proposal was distributed to water
customers along with the required mailing of the Annual Water
Quality Report on April 1, 1992. The resolution will also be
published in a local newspaper in order to notify customers of the
change.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIISTIN
RESCINDING EXCESSIVE WATER USE PENALTIES AS ESTABLISHED
IN CITY OF TIISTIN ORDINANCE NO. 1063 SECTION E.
WHEREAS, the City Council of the City of Tustin adopted
Ordinance No. 1063, establishing a Mandatory Water Conservation and
Rationing Program on April 1, 1991; and
WHEREAS, the City Council adopted Ordinance no. 1063 based on
a finding that the Metropolitan Water District of Southern
California (MWD) would impose severe penalties on the City if it
were not to achieve a thirty percent (30%) reduction in water
purchases from MWD; and
WHEREAS, Section E of Ordinance No. 1063 provides for
additional charges and penalties in the event that allowable water
usage established by the Ordinance are exceeded; and
WHEREAS, Section F or Ordinance No. 1063 allows the City
Council from time to time "to set, revise, increase or decrease the
allowable water usage and the charges, surcharges and penalties as
deemed necessary to accommodate water allocations, charges and
penalties imposed by MWD..."; and
WHEREAS, due to above normal rainfall in its service area and
reduced water usage during the past year, MWD has modified its
requirements to request a voluntary ten percent (10%) reduction in
water use and has rescinded penalties for excessive use;
NOW, THEREFORE, BE IT RESOLVED that the City of Tustin City
Council, effective April 6, 1992 does hereby rescind all additional
charges and penalties for excessive water use as provided for by
Section E of Ordinance No. 1063; and
BE IT FURTHER RESOLVED that the City of Tustin requests that
ter users continue their voluntary water conservation practices;
BE IT FURTHER RESOLVED that if excessive use penalties are
reimposed by MWD, the City of Tustin may reinstate additional
charges and penalties as provided for by Section E of Ordinance No.
1063.
