ACCEPTANCE OF IMPROVEMENTS AND AUTHORIZING RECORDATION OF
"NOTICE OF COMPLETION" FOR PROJECT NO. 1 - SIDEWALK AND
SOB.JE(3,1 WHEELCHAIR RAMPS SB821 PROJECT 1990-91 FY AND 1991-92; PROJECT
NO. 2 SIDEWALK ON VANDENBERG LANE SB 821 PROJECT 1989-90 FY
RECOMMENDATION
It is recommended that the City Council, at their meeting of March
16, 1992, adopt the attached resolution accepting the works of
improvement and repair and authorizing the recordation of the
Notice of Completion for subject Projects Numbers 1 and 2.
Assuming no claims or stop -notices are filed, it is further
recommended that, 30 days after the date of recordation of the
notice of completion, the City Council authorize payment of the
final loo retention amount of $4,492.22. This amount together with
previous payments of $40,429.93, represents 100% of the final
contract amount of $44,922.15
BACKGROUND
This project consisted of the construction of new PCC sidewalk and
wheelchair access ramps in the industrial area of westbound Walnut
Avenue, between Tustin Ranch Road and the west side of the railroad
crossing. Also new sidewalk and retaining wall for the southside
of Vandenberg Lane, from Yorba Street to approximately 563 feet
east.
These two projects are being paid for with SB821 funds from an
available amount of $40,254.00. Actual contract costs were as
follows:
Original Contract Cost $37,427.15
Contract Change Order No. 1 $ 51072.95
Contract Change Order No. 2 $ 2,422.05
$44,922.15
DISCUSSION
These improvements and repairs have now been completed by the
Contractor, Grigolla & Sons Construction Company, Inc. to the
satisfaction of the City's Public Works Department.
To clarify the contract costs the change orders are defined as
follows:
Contract Change Order No. 1 Because of the good quality and the
timely way the work was being completed by the contractor, it was
decided to utilize Grigolla & Sons to pave the dirt parkway area in
front of W.R. Nelson Elementary School and eliminate a potential
tripping hazard. This change order is not being paid for by SB821
funds, but is being paid for by the annual curb and gutter repair
program monies.
Contract Change Order No. 2 - This change order became necessary
when the retaining wall design on Vandenberg Lane needed
modification because of existing perimeter wall footing conditions.
This change order can be covered by SB821 funds.
The final contract amount for this project is $44,922.15 which
represents an increase of 20.9% over the original contract amount.
This increase was due to the two change orders previously
discussed.
It is requested that the Tustin City Council pass and adopt the
attached resolution accepting the works of improvement and repair
and authorizing the recordation of the Notice of Completion for
Project No. 1 - Sidewalk and Wheelchair Ramps - SB821 Project,
1990-91 FY and 1991-92 FY; Project No. 2 - Sidewalk on Vandenberg
Lane - SB821 Project, 1989-90 FY.

RESOLUTION NO. 92-44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR PROJECT
NO. 1 - SIDEWALK AND WHEELCHAIR RAMPS-SB821 PROJECT 1990-91 FY
AND 1991-92 FY; PROJECT NO. 2 - SIDEWALK ON VANDENBERG LANE -
SB821 PROJECT, 1989-89
WHEREAS, Grigolla & Sons Construction Company, Inc. having a
contract with the City of Tustin to construct the hereinafter
described public work and improvement; and
WHEREAS, the City Engineer has duly certified to the
construction and completion of said public improvements hereinafter
mentioned in manner satisfactory to the City Council of the City of
Tustin; and
WHEREAS, the City Council finds that said contractor has
completed said public improvement hereinafter more particularly
described in accordance with the provisions of the contract
documents and the notice of completion and acceptance of said
public work and improvement should be filled and payment of the
balance due said contract authorized in accordance with the
contract documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said public work and improvement be, and the same is
hereby accepted. Said work and improvement is more particularly
described as follows:
The construction of new sidewalk and wheelchair ramps on
Walnut Avenue; sidewalk and retaining wall on Vandenberg
Lane
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Engineer
of the City of Tustin be, and is hereby authorized to execute and
file a notice of completion and acceptance of said public work and
improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin held on the 16th day of March, 1992.
