PARKER, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: GRANT APPLICATION FOR HOUSING - RELATED PARKS PROGRAM SUMMARY: The State Department of Housing and Community Development (HCD) recently announced the availability of $35 million in grant funds for Designated Program Year 2014 that may be used by eligible local governments to fund park - related capital asset projects though the Housing - Related Parks (HRP) Program. The HRP Program, funded by Proposition IC, provides grant funds based on the number of bedrooms in qualifying affordable housing units permitted between January 1, 2010, and December 31, 2014. The grant funds are required to be used for the costs of park and recreation facility creation, development, or rehabilitation, including the acquisition of land and the construction, rehabilitation, and acquisition of park equipment and physical property. Staff recommends that the estimated grant funds of up to $660,850 be allocated to the construction of park facilities at the proposed Veterans Park in Tustin Legacy. In 2014, the City of Tustin (the City) applied for and received an HRP Program 2013 Designated Program Year Grant in the amount of $260,700 to fund improvements at Frontier Park. The City is eligible to apply for grant funds again this year because additional affordable housing units were permitted during the current funding cycle. One of the requirements of the HRP Program is a resolution from the City Council, authorizing the submittal of the application to HCD and the execution of an agreement with the State of California to secure the grant from HCD. RECOMMENDATION Adopt Resolution No. 15 -09, authorizing the submittal of a grant application for the Housing - Related Parks Program to HCD, and the execution of an agreement with the State of Califomia to secure the grant from HCD if the application is approved. FISCAL IMPACT: The City is eligible to receive up to $660,850 to fund park - related capital asset projects through the HRP Program in this funding cycle. There is no requirement for local matching funds or in -kind services. The fiscal impact related to the administration of the grant funds is insignificant. City Council Agenda Report Housing - Related Parks Program February 3, 2015 Page 2 CORRELATION TO THE STRATEGIC PLAN: The submittal of a grant application for the HRP Program supports Goal B (Public Safety and Protection of Assets) by providing funding related to capital improvement planning to ensure continuous maintenance and improvement of park facilities. BACKGROUND: The State Department of HCD recently announced the availability of $35 million in grant funds for Designated Program Year 2014 that may be used by eligible local governments to fund park - related capital asset projects though the HRP Program. To be eligible for the HRP Program, local governments must have a housing element that has been determined by HCD to comply with State Housing Element law and must have submitted the required General Plan Annual Progress Reports to HCD for the applicable program years. The City has satisfied both of these requirements by receiving certification of its Housing Element on November 6, 2013, and by submitting Annual Progress Reports on March 22, 2010, March 24, 2011, March 28, 2012, March 22, 2013, and March 12, 2014. The HRP Program is funded by Proposition IC and provides grant funds based on the number of bedrooms in qualifying affordable housing units permitted between January 1, 2010, and December 31, 2014. Eligible applicants may receive between $500 and $2,200 per bedroom for qualifying low- income housing units, and between $750 and $2,725 per bedroom for qualifying very low- income housing units, depending on the number of applicable bonus awards. Grant funds are not awarded for moderate - income housing units. Bonus awards are provided for newly constructed units, extremely low - income units, infill projects, disadvantaged and park- deficient communities, parks that support infill development, and Regional Housing Needs Allocation achievement. It is estimated that the City is eligible to receive up to $660,850 in grant funds. All of the qualifying affordable housing units for this funding cycle are located within Anton Legacy Apartments in Tustin Legacy. There are 30 one - bedroom, 46 two - bedroom, and 12 three - bedroom very low- income housing units; and 25 one - bedroom, 38 two - bedroom, and 10 three - bedroom low- income housing units at the Anton Legacy Apartments. Other low- income and very low- income affordable housing units in Tustin Legacy or citywide were either permitted before 2010 or were included in the previous funding cycle of the HRP Program. The City would be eligible for future funding cycles of the HRP Program, if such funding is made available, based on future qualifying affordable housing units. City Council Agenda Report Housing - Related Parks Program February 3, 2015 Page 3 The grant funds are required to be used for the costs of park and recreation facility creation, development, or rehabilitation, including the acquisition of land and the construction, rehabilitation, and acquisition of equipment and physical property. Infrastructure and other improvements that support these facilities are also eligible for funding. However, park projects do not need to be related to the affordable housing units on which the grant is based. Funds must be requested by April 30, 2017, and fully expended by June 30, 2017. If funding is secured, it is proposed that the funds be used for improvements at proposed Veterans Park in Tustin Legacy, such as a skate park, and /or the construction, acquisition, rehabilitation, or major maintenance of other park equipment or assets. The Community Development Department requests the City Council authorization for participation in the HRP Program. Binsack Community Development Director ATTACHMENT A CITY COUNCIL RESOLUTION NO. 15 -09 RESOLUTION NO. 15 -09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR THE HOUSING - RELATED PARKS PROGRAM TO THE STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT The City Council of the City of Tustin does hereby resolve as follows: The City Council finds and determines as follows: A. That the State Department of Housing and Community Development (HCD) issued a Notice of Funding Availability dated December 10, 2014 (NOFA), under its Housing - Related Parks (HRP) Program. B. That the City of Tustin desires to apply for a HRP Program grant and submit the 2014 Designated Program Year Application Package released by the Department for the HRP Program. C. That the City of Tustin has satisfied the eligibility requirements of the. HRP Program by receiving certification of its Housing Element on November 6, 2013, and by submitting General Plan Annual Progress Reports on March 22, 2010, March 24, 2011, March 28, 2012, March 22, 2013, and March 12, 2014. D. That HCD is authorized to approve funding allocations for the HRP Program, subject to the terms and conditions of the NOFA, Program Guidelines, Application Package, and Standard Agreement. E. That the grant funds would be used to fund capital projects, such as a skate park, at proposed Veterans Park to be located at the northwest corner of Valencia Avenue and Severyns Road in Tustin Legacy. Veterans Park will be located in a census tract that is a Disadvantaged Community and be located in an area that qualifies as a Park - Deficient Community, as defined in the Program Guidelines. II. The City of Tustin is hereby authorized and directed to apply for and submit to HCD the HRP Program Application Package released December 2014 for the 2014 Designated Program Year in an amount not to exceed $700,000. If the application is approved, the City of Tustin is hereby authorized and directed to enter into, execute, and deliver a State of California Standard Agreement (Standard Agreement) in an amount not to exceed $700,000, and any and all other documents required or deemed necessary or appropriate to secure the HRP Program Grant from HCD, and all amendments thereto (collectively, the "HRP Grant Documents "). Resolution No. 15 -09 Housing Related Parks Program Page 2 III. The City of Tustin shall be subject to the terms and conditions as specified in the Standard Agreement. Funds are to be used for allowable capital asset project expenditures to be identified in Exhibit A of the Standard Agreement. The application in full is incorporated as part of the Standard Agreement. Any and all activities funded, information provided, and timelines represented in the application are enforceable through the Standard Agreement. The City of Tustin hereby agrees to use the funds for eligible capital asset(s) in the manner presented in the application as approved by HCD and in accordance with the NOFA and Program Guidelines and Application Package. IV. The City Council authorizes the Director of Community Development to execute in the name of the City of Tustin the HRP Program Application Package and the HRP Grant Documents as required by HCD for participation in the HRP Program.
