HomeMy WebLinkAboutCC RES 15-09RESOLUTION NO. 15 -09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR THE HOUSING - RELATED PARKS PROGRAM TO THE STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT The City Council of the City of Tustin does hereby resolve as follows: The City Council finds and determines as follows: A. That the State Department of Housing and Community Development (HCD) issued a Notice of Funding Availability dated December 10, 2014 (NOFA), under its Housing - Related Parks (HRP) Program. B. That the City of Tustin desires to apply for a HRP Program grant and submit the 2014 Designated Program Year Application Package released by the Department for the HRP Program. C. That the City of Tustin has satisfied the eligibility requirements of the HRP Program by receiving certification of its Housing Element on November 6, 2013, and by submitting General Plan Annual Progress Reports on March 22, 2010, March 24, 2011, March 28, 2012, March 22, 2013, and March 12, 2014. D. That HCD is authorized to approve funding allocations for the HRP Program, subject to the terms and conditions of the NOFA, Program Guidelines, Application Package, and Standard Agreement. E. That the grant funds would be used to fund capital projects, such as a skate park, at proposed Veterans Park to be located at the northwest comer of Valencia Avenue and Severyns Road in Tustin Legacy. Veterans Park will be located in a census tract that is a Disadvantaged Community and be located in an area that qualifies as a Park - Deficient Community, as defined in the Program Guidelines. The City of Tustin is hereby authorized and directed to apply for and submit to HCD the HRP Program Application Package released December 2014 for the 2014 Designated Program Year in an amount not to exceed $700,000. If the application is approved, the City of Tustin is hereby authorized and directed to enter into, execute, and deliver a State of California Standard Agreement (Standard Agreement) in an amount not to exceed $700,000, and any and all other documents required or deemed necessary or appropriate to secure the HRP Program Grant from HCD, and all amendments thereto (collectively, the "HRP Grant Documents "). III. The City of Tustin shall be subject to the terms and conditions as specified in the Standard Agreement. Funds are to be used for allowable capital asset project expenditures to be identified in Exhibit A of the Standard Agreement. The application in full is incorporated as part of the Standard Agreement. Any and all activities funded, information provided, and timelines represented in the application are enforceable through the Standard Agreement. The City of Tustin hereby agrees to use the funds for eligible capital asset(s) in the manner presented in the application as approved by HCD and in accordance with the NOFA and Program Guidelines and Application Package. IV. The City Council authorizes the Director of Community Development to execute in the name of the City of Tustin the HRP Program Application Package and the HRP Grant Documents as required by HCD for participation in the HRP Program.
