HOUSING SET-ASIDE FUNDS
RECOMMENDATION
It is recommended that the Agency take the following actions:
1. Approve the use of $550, 000 in South Central .Housing Set -Aside
funds for implementation of specific housing rehabilitation
programs and public improvements in the southwest neighborhood
as part of the City's Community Improvement Partnership
Program, by minute order.
2. Appropriate and obligate $550,000 in South Central Project
area housing set-aside funds (as part of 1991-92 Redevelopment
Agency Budget) for implementation of specific approved
programs associated with the City's Community Improvement
Partnership Program. Any unspent balance of obligated Housing
Set-aside funds will be carried.over to fiscal year 1992-93.
BACKGROUND & DISCUSSION
On. October 7, 1991 the Tustin Redevelopment Agency and City Council
after review of a status report on the City's Community Improvement
Partnership Program directed staff to develop program guidelines
for use of 20% housing set-aside monies for housing rehabilitation
and certain public improvements within designated target areas in
the South Central Project area. While it.was understood that staff
would be bringing .back a comprehensive strategy in the next several
months for utilization of all accrued South Central. housing set-
aside monies, the Agency supported staff's recommendation that
housing set-aside monies be used wherever legally possible to
finance housing rehabilitation and public improvement programs in
target areas concentrated in the southwest portion of the City.
Appropriately staff would recommend that $550,000 of South Central
Housing set-aside funds be committed to the following programs at
this time:

The Housing Rehabilitation Program is meant to provide
financial incentives to property owners in concentrated target
areas of the southwest portion of the City in order to
stimulate rehabilitation of residential properties.
Specifically, three programs are recommended:
1. Single Family Residential Deferred Payment Loan Program -
$75,000
This program will provide loans of up to $10,000 in
target areas based upon certain income restrictions.
Repayment of the loan is not required until property is
sold or title is transferred. (Program year 1 objective
- rehabilitation of 10 properties)
2. Rental Loan Program - $250,000
This program will be available to investor-owned
residential property in certain target areas and will
allow a maximum deferred loan of $3,000 per unit, not to
exceed $25,000 per property. Owners may participate in
the program if 51% of rents and tenant incomes meet
qualification criteria for low and moderate income
participants as provided for under State statutes. A
rent limitation agreement is also required for the term
of the loan. (Program Year 1 objective - rehabilitation
of 10 - 15 properties)
3. Residential Grant Program - $75,000
The grant program is available to income qualified owner
occupied single family and investor owned rental
property. The maximum grant amount is $3,000 per
property and must be used to beautify the exterior of a
property. (Program Year 1 objective - minor exterior
improvements to 25 properties)
With required State statutory restrictions and the
inexperience of prospective program participants, a high
degree of marketing and technical assistance from staff will
be necessary. Administrative staff will be directed toward
significant marketing and promotion, pre-screening, loan
counseling, work write-up, estimating, contract negotiation,
supervision and inspection, monitoring, reporting and trouble-

shooting. It is anticipated that administrative
represent approximately 10% of the requestedprogram funding
commitment to the program.
A detailed Housing Rehabilitation Program Manual is attached
which complies with all State statutory requirements. The
document has been reviewed and approved by the City Attorney's
office.

1.0 INTRODUCTION
1.1 Purpose

administration of the City's Housing Rehabilitationwith Program

1.4 Conflict of Interest
No member of the governing body of theCity of Tustin who exercises
official, employee, or agent of the City Government
policy, decision-making functions or responsibilities in connection
with the planning and implementation of the Housing Rehabilitation
Program shall directly or indirectly be eligible for this program.
This prohibition shall continue for one year after an individual's
relationship with the City Government ends.
2.0 PROGRAM DESCRIPTIONS AND PROGRAM GUIDELINES
The City of Tustin offers three Housing Rehabilitation dprograms renters f oA
low and moderate -income homeowners, landlords,

2.1 Single Family Residential Deferred Payment Loan Program

2.1.3 The loan is specifically designed to help single-
family homeowners who meet the income eligibility
criteria contained in Appendix 6.2 as noted, the
maximum loan amount depends on income qualification
criteria. Applicant's income eligibility is
determined based on the prior full year's gross
earnings. This will include employment income,
pensions, interest on savings, social security
income, etc. For simplification, the Applicant's
prior year's 1040 Tax Form and last monthly pay
stubs, as well as any other statements from various
governmental agencies indicating prior year's
income, will be utilized. In the

Eligible Loan Programs
Eligible home improvements under the Loan Program include, fol but

Roofs, windows, doors, stairs, driveways, on-site sidewalks,
existing fences and walls, screens, plumbing, electrical, or
mechanical systems;
foundations, walls, ceilings, smoke
detectors, and approved security screen doors and terio; and

4.0 PROGRAM PROCEDURES
4.1 Screening Interview
4.1.1. When a homeowner or owner -investor ma the an inquiry
about a program, staff determines

a. Applicant's home address or, in the case of an
owner -investor, property addres
b. Applicant's income, or in the case of an owner -
investor, number of units, rents currently charged,
and tenant incomes.

4.1.2. If Applicant appears eligible, proceed to Section
4.2.
4.2. Application Process
4.2.1. Staff provides appropriate application forms to
Applicant and makes a case folder. Place name and
address of Applicant on folder, identifying
applicable program. A different color folder tag
should be created for each program (i.e. yellow -
rental, green - single family, blue - grant).
a. Forms 2, 5 and 6 go to single family owner -occupied
applicants.
b. Forms 3, 5 and 6 go to property owner applicants.
Owner -investor qualify for Rental Loan Program and
Grant Program using current rental levels (Appendix
6.3) and tenant income criteria (Appendix 6.4).
Homeowner mails Forms 4 and 5 to tenants for
explanation of the loan program and income
verification.
C. If single family homeowner Applicant is on social
security, Form.7a should be completed and signed.
d. To verify existing loans on property, use Form 7b,
employment form 7c, use form 7d to order a credit
report. In addition to the above information,
applicant shall provide

(for single family loan and single family
grant applicants).
3. Rental receipts (for rental owners)

program.
4,2;2. During the course of the application process, all
pertinent information transactions and daily
information during the application and construction
phase must be included in the folder and recorded
in the log. (Form No. 1.) All application forms and
deeds should be kept on the left side together with
the Log (Form No. 1), and rehabilitation work and
contracts on the right side.
4.2.3. Applicant completes and signs all forms, including
providing all verifications such as proof of

ownership and income. An offer to photocopy all
verification should be made to Applicant.
4.2.4 Staff date stamps applications received and reviews
and verifies application data and income
eligibility and completes Form 8. Approval of
application file is required by Loan Committee
before proceeding to Step No. 4.2.6 loan or grant
approval is good for 120 days provided applicant
proceeds to construction stage in a timely fashion.
Extension may be granted by loan committee.
4.2.5 If at the point the Applicant is found (per City
guidelines) not to be eligible for the program, the
Applicant shall be notified in writing and a file
maintained for documentation of the above
information.
4.2.6 Otherwise, if the Applicant is found to be ligible
(per City guidelines), staff shall

owner a deposit for the cost of title work and
order a title report (Form 9). At the desire of
the applicant, the cost of the title report can be
added to the Loan. If such is the applicant's
decision, the deposit will be returned after the
loan document is signed if the applicant does not
wish to proceed further after the report has been
ordered. The deposit shall be maintained by City
as reimbursement for costs incurred.
Property Inspection
4.3.1 If approved, staff shall request
and inspection
write-up from Building Inspector
Enforcement Officer. Staff shall make an
appointment with the Applicant to inspect the
property and assist the property owner in selection
of rehabilitation items which will most directly
improve the quality of the housing. Applicant's
proposed improvements will be reviewed to establish
construction costs, also code violations will be
noted for corrections. Abatement of conditions
which do not meet local building and property
maintenance standards will be mandatory.
In preparing the work write-up, the City will fund
a proposed improvement based on the following order
of priorities:
a. Code violation corrections

b. Cure incipient code violations (violations
which are beginning to become apparent).
c. Necessary structural work, including
foundation, roof, doors, windows.
d. Repair and modernization of utility systems,
including sewer, water, electrical,
ventilating and heating systems.
e. Interior and exterior problems resulting from
deferred maintenance.

payments (contract must be more than $3,500) if:
a. Bill describing work is submitted to City.
b. The Building Inspector has inspected and is
satisfied with completed work.
C. Contractor submits material and labor release
for work completed (Forms 27, and 28 (if work
is less than $500) ). In the case of roofing,
electrical, plumbing, or heating work,
certifications must also be executed by the
contractor (Forms 32, 33, 34, and 35).
d. The Loan Committee approves the request.
4.6.4. If owner acts as builder all work must be completed
within ninety days'or less.
4.6.5. If full or progress payment approved, staff
authorizes Finance Department to issue a two-party
check (Form 30), subject to the conditions in
Section 4.6.3 on the next page. All payments shall
be noted on the request for payment log (Form 31).
4.6.6. If changes from the original plan or work write-up
are necessary during the course of cntr cfoonowa
change order will have to be submitted
(see Form 37):
a. For additional work: If the homeowner needs to
borrow additional funds, they must revise all
contract and lien documents. Otherwise, if the
homeowner pays the additional "out-of-pocket"
costs, no time-consuming revisions will be
necessary. In either case, staff and Loan
Committee must approve the change order.
b. For deleted work, staff and the Loan Committee
must approve all change orders.
C. For substituted material requiring no change
in the contract price, if the homeowner and
contractor agree to the type of substitute to
be used and the substitute is consistent with
attached standard specifications included in
the contract, a change order does not have to
be submitted

5.1. Eligibility

5.2 Authorized Improvements
Before improvements can be authorized, properly

5.4 Annual Review of Loan Program Applicants
On an annual basis, staff shall inspect the property
conditions on all loan applicant sites to ensure continuing
eligibility (Form 42). In the case of the rental program,
Form 25 and Tenant Income form 4 shall be mailed out annually.
In the case of violations of the terms of any

PROGRAM PARTICIPATION AGREEMENT
THIS AGREEMENT is entered into on , by and
between the "Tustin Community Redevelopment Agency" (hereinafter
the "Agency") and

SECTION 1. PURPOSE OF AGREEMENT
1.1 The purpose -of this Agreement is to implement the Housing
Rehabilitation Program (the "Project") and to provide for the
participation in the Project by the Participant(s) through the
rehabilitation and/or construction of improvements on that certain
real property owned or occupied by Participant and located at
(hereinafter the "Site") .
SECTION 2. PRELIMINARY APPROVALS
2.1 Participant has.submitted, and the City has approved plans for
rehabilitation and/or construction work (thereinafter the
"Improvements") for the Site. The approved plans are set forth on
Attachment A to this Agreement.
2.2 Participant has submitted a bid for the Improvements for
approval by the Agency. The approved bid is attached to the
Agreement as Attachment B.
SECTION 3. CONSTRUCTION OF IMPROVEMENTS
3.1 Participant agrees to construct or cause to be constructed on
the Site the Improvements set forth on Attachment A to this
Agreement pursuant to the bid set forth on Attachment B.
3.2 The Improvements shall be constructed in accordance with the
approved plans as set forth on Attachment A to this Agreement,
except as changes may be mutually agreed upon in writing between
Participant and the Agency.
3.3 All Improvements listed on Attachment A, whether being done by
a licensed contractor or the owner as owner -contractor, must be
completed to the satisfaction of the City of Tustin and Agency and
in compliance with City Codes within days after issuance
of the Notice to Proceed. Any extensions of time must be approved
by the Director of Community Development.

3.4 Before commencement of construction, the Participant in writing
shall at its own expense, secure any and all licenses and permits
which may be required by the City of Tustin (the "City") or any
other governmental agency affected by such construction.
3.5 The Participant or the approved contractor must obtain permits
within ten (10) days of signing or complete the plancheck process
and obtain permits within ten (10) days thereafter.
3.6 The Participant or the approved contractor must

4.3 All change order requests must be approved by the Director
Community Development or designated representative on an approved
form. Modifications or changes to the improvements performed
without the Tustin Department of Community Development's approval
will be the sole financial responsibility of the Participant.
4.4 Promptly after completion of all construction, Participant
shall furnish Agency with an Invoice for Final Payment. Approval
of the Invoice for Final Payment shall constitute conclusive
determination of satisfactory completion of the construction
required by this Agreement upon the Site, and of full compliance
with the terms hereof with respect to the Site.
SECTION 5. WORKER'S COMPENSATION, BODILY INJURY AND PROPERTY
DAMAGE INSURANCE
5.1 Prior to issuance of building permits, Participant

SECTION 6. MATERIALS AND WORKMANSHIP

Upon written approval by the Director of Community Development
or a designated representative, the time for completion of this
Agreement may be extended by the number of calendar days which
Participant, agents, servants, employees and contractors are
prevented from performing work as a result of:
A. Inclement weather
B. Acts of Participant or City not contemplated by this
contractor.
C. The unavailability of workers or materials because of
labor disputes.
D. Circumstances which would not reasonably have been
foreseen at the time of signing this Agreement.
E. Delay of any subcontractor for any of the above causes.

Participant and the Agency shall be consulted in advance of
any suspension or delay or work: to determine whether or not
circumstances justify extending the time of completion.
SECTION 8. INSPECTION BY THE CITY
The City of Tustin and Agency shall at all times have access
to the work during its progress, and shall be furnished with any of
participants documents necessary to determine that the materials,
workmanship and equipment are in accordance with the requirements
and intentions of this Agreement.
Agency shall make decisions and determinations on all claims
and disagreements of Participant, its agents, servants, employees
and contractors related to improvements required by this Agreement
and all determinations or disagreements shall be subjects to the
provisions of this Agreement.
SECTION 9 NON-DISCRIMINATION
A. PARTICIPANT shall execute against the Site a supplemental
agreement attached hereto as Attachment and incorporated

- herein by reference prior to the disbursement of the first
installment of the Agency which are incorporated herein
by reference.
B. There shall be no discrimination against or segregation
of any person, or group of persons, on account of race, color,
creed, religion, sex, marital status, national origin, or ancestry
in the sale, lease, sublease, transfer, use, occupancy, tenure or
enjoyment of the Site, nor shall PARTICIPANT itself or any person
claiming under or through PARTICIPANT establish or permit any such
practice or practices of discrimination or segregation with
reference to the selection, location, number, use or occupancy of
tenants, lesses, subtenants, sublessees, or vendees of the Site or
any portion thereof.
SECTION 10. DISPUTES TO BE DETERMINED BY AGENCY
Any disagreement arising out of this Agreement or from breach
thereof, shall be submitted to the Agency for determination.
Agency shall make its determination within thirty (30) days after
the matter is submitted to City for determination. It is mutually
agreed that the determination shall be a condition precedent to any
right of legal action that either party may have against the other.
SECTION 11. CLEAN-UP OF PREMISES
Participant, its agents, servants, employees or contractors
shall keep the premises free from accumulation of waste material
and rubbish; and at the completion of the work, Participant shall
remove from the premises all rubbish, implements, surplus
materials, and surplus equipment.
SECTION 12. ADDITIONS OR DELETIONS TO IMPROVEMENTS
In the event a change is requested in the scope of work
improvements to be done, the Participant shall prepare a Change
Order indicating the change for addition, deletion, or deviation
from the original Agreement. Said Change Order shall be signed by
the Participant and be subject to approval by a Agency
representative before the work covered by the change order may
proceed.
SECTION 13. CITY OF TUSTIN HOUSING REHABILITATION PROGRAM
A. Participant acknowledges that this Agreement has been
made pursuant to the City of Tustin Housing Rehabilitation
Program authorized and financed by the Tustin Community
Redevelopment Agency. Participant further acknowledges that
the City and Agency are not responsible for the performance of
any contractor or subcontractor of Participant, or for payment
of the Contractor, except to the extent participant is
entitled to the amount set forth in Section 4.1.

B. Participant has read and understands the above terms, and
finds that it is complete and acceptable. Participant agrees
to abide by the foregoing terms and conditions and realizes
that the failure of any or all of these conditions may relieve
the City of Tustin and Agency of any obligation to pay any

SECTION 14. ENTIRE AGREEMENT, WAIVERS AND AMENDMENTS
This Agreement integrates all of the terms and conditions
mentioned herein or incidental hereto, and supersedes all
negotiations or previous agreements between the parties with
respect to any part of the subject matter hereof.
All waivers and amendments on the provisions of this Agreement must
be in writing.

GRANT PROGRAM PARTICIPATION AGREEMENT
THIS AGREEMENT is entered into on , by and
between the Tustin Community Redevelopment Agency (hereinafter the
"Agency") and
(hereinafter the "Participant(s)". The City and the Participants
agree as follows:
SECTION 1. PURPOSE OF AGREEMENT
1.1 The purpose of this Agreement is to implement the Housing
Rehabilitation Program (the "Project") and to provide for the
participation in the Project by the Participant through the
rehabilitation and/or construction of improvements on that certain
real property owned or occupied by Participant and located at
(hereinafter the "Site").
SECTION 2. PRELIMINARY APPROVALS
2.1 Participant has submitted, and the City has approved plans for
rehabilitation and/or construction ed k (thereinafter

"Improvements") for the Site. The approved plansare

SECTION 3. CONSTRUCTION OF IMPROVEMENTS

which may be required by the City of Tustin (the "City") or any
other governmental agency affected by such construction.
3.5 The Participant or the approved contractor must obtain permits
within ten (10) days of signing or complete the plancheck process
and obtain permits within ten (10) days thereafter.
3.6 The Participant or the approved contractor must commence work
within a reasonable time after issuance of the Proceed Order.
3.7 Painting shall be deemed an eligible improvement for commercial
rehabilitation contingent upon the prohibition of the use of
lead-based paint hazards. All such surfaces which require
treatment shall be thoroughly washed, sanded, scraped, or
wire -brushed, so as to remove all cracking, scaling, peeling, and
loose paint before repainting.
3.8 In the event a contractor is utilized to construct
Improvements, the contractor shall provide a one (1) year guarantee
of all materials and labor except for applicable manufacturing
guarantees.

persons, parties, or entities because of any action taken or not

SECTION 9 EMPLOYMENT REGULATIONS AND LABOR STANDARDS
A. If the amount of Improvements is $10,000 or less, the
following conditions shall apply:
1. Participant, or its agents, servants, employees and
contractors shall not discriminate against any employee or
applicant for employment because of race, color, religion, sex
or natural origin. Participant, its agents, servants,
employees and contractors will take affirmative action to
insure that applicants are employed and that employees are
treated during employment without regard to their race, color,
religion, sex, or national origin. Such action shall include,
but not be limited to the following: employment, upgrading,
demotion or transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay or other forms of
compensation; and selection for training, including
apprenticeship./ Participant agrees to post in conspicuous
places, available to employees and applicants for
employment,notices to be provided by the City setting forth
the provisions of this nondiscrimination clause.
2. Participant, its agents, servants, employees and
contractors will, in all solicitations or advertisements for
employees placed by or on behalf of Participant, state that
all qualified applicants will receive consideration for
employment without regard to race, color, religion, sex, or
national origin.
3. Participants, its agents, servants, employees and
contractors will send to each labor union or representative of
workers with which he or she has a collective bargaining
agreement or other contract or understanding, a notice to be
provided advising the said labor Union or workers'
representative of Participants commitments under this Section,
and shall post copies of the notice in conspicuous places
available to employees and applicants for employment.
4. Participant, its agents, servants, employees and
contractors shall comply with all provisions of Executive
Order 11246 of September 24, 1965, and of the rules,
regulations, and relevant orders of the Secretary of Labor.
5. Participant, its agents, servants, employees and
contractors will cause the foregoing provisions 1-4 to be
inserted in all contracts for any work covered by this
Agreement so that such provisions will be binding upon each
subcontractor, provided that the foregoing provisions shall
not apply to contracts or subcontracts for standard commercial
supplies or raw materials.
6. Participant small, to the greatest extent feasible,
award contracts and subcontracts to firms representative of
the racial and ethnic groups residing in the Project Area in
a dollar value proportion which is equivalent to the
percentage of the Project Area residents who are members of
such racial groups. In addition, Participant and any
contractor subcontractor shall to the greatest extent
feasible, hire their labor force of any Participant,
contractor and any subcontractor shall be proportionately
representative in all work categories of the racial and ethnic
groups residing in the Project Area.
7. Participant, its agents, servants, employees and
contractors shall, to the greatest extent feasible: undertake
the improvement work in this Agreement, abide by Section 3 of
the Housing and Urban Development Act of 1968, as amended, to
provide opportunities for training and employment for lower
income residents of the Project Area and to award contracts
for work in connection with the project to eligible business
concerns Which are located in or owned substantial in part by,
persons residing in the areas of the project.
SECTION 10. DISPUTES TO BE DETERMINED BY CITY
Any disagreement arising out of this Agreement or from breach
thereof, shall be submitted to the City for determination. City

pursuant to Federal Statute and HUD regulations, and the City
is not responsible for the performance of any contractor or
subcontractor of Participant, or for payment of the
Contractor, except to the extent participant is entitled to
the amount set forth in Section 4.1.
B. Participant has read and understands the above terms, and
finds that it is complete and acceptable. Participant agrees
to abide by the foregoing terms and conditions and realizes
that the failure of any or all of these conditions may relieve
the City of Tustin of any obligation to pay any funds pursuant
to this Agreement.

receiving such assistance to enter into a contract or lien agreement with the
"Agency" for repayment of said loan on the sale, conveyance, or other
transfer of title to the property or the recordation of any mortgage, trust
deed, or other lien agreement on the property; and
WHEREAS, "Landowners" desire to utilize provisions of the Local Housing
Rehabilitation Loan Program and in consideration of the payment to them, and
each of them, of the hereinafter set forth sum agree as follows:
1. Landowners, and each of them, in consideration of the terms and
provisions of this agreement, and the advancement to them of the sum of

agree to repay to the Agency the aforementioned sum, at the time title is
transferred to all or any part of the property to other than the present
record owner of said property, this includes the sale, conveyance, or other
transfer by said Landowners of their interest in the aforementioned described

lien against said property, whether voluntary or by operation of law, and
further agree on behalf of their executors, administrators, heirs,
successors, and assigns, that if not sooner paid, said sum shall be due and
owing within six (6) months of the death of the Landowners, and if not paid
on the aforementioned date said sum shall draw interest at the rate of seven
percent (7%) per annum from the aforementioned due date. In the event
Landowners hold title in joint tenancy, or are husband and wife, and their
surviving joint tenant or spouse remains in possession of said real property
upon the death of the first of said Landowners, the due date arising by
reason of the death of Landowners shall be six (6) months following the death
of the surviving joint tenant or spouse. It is further agreed that repayment
of the aforementioned sum shall also be required immediately should owners
fail to adequately maintain said property in compliance with City Codes as
determined by the City of Tustin or to maintain adequate fire insurance
coverage as determined by the Agency.
2. This Agreement shall be binding upon Landowners, and each of them,
their heirs, successors, or assigns and shall continue a covenant running
with the land binding all successors in interest of the Landowners as though
the same were parties to this Agreement. The Landowners, upon any sale,
transfer, assignment, or transfer of an interest in said property shall
notify their successor in interest of this obligation and that the same is
due and owing. In addition, said Landowners, and each of them, or their
executors, administrators, mentioned obligation is due -and owing and of the
mailing address of any successor in interest of said Landowners, and upon
failure of Landowners to do so the Agency may give notice to the Landowners
at the address herein set forth which shall be binding on said Landowners,
and each of them, and their heirs, successors, or assigns.
3. Landowners agree that upon nonpayment of the aforementioned amount
when due and owing, said unpaid balance shall constitute a lien against.said
property, which said lien shall be terminated and become null and void upon
the occurrence of any of the following conditions.
a. Upon recordation of notice to that effect in the office of the
Orange County Recorder.
b. Upon payment in full to the Agency of the principal sum plus
any interest herein set forth.
4. Landowners, and each of them, further acknowledge that the Agency
reserves the right to collect said amount by. any and all other. remedies
provided in law or equity.
5. Any other notice required to be given hereunder may be given by.
mailing notice, with postage prepaid thereon by United States First Class.
