It is recommended that the City Council uphold the Planning
Commission's action by adopting Resolution No. 92-17, as submitted.
BACKGROUND
On January 20, 1992, the City Council requested that staff revise
Resolution No. 92-17 to include a condition of approval to allow
the addition of an architectural embellishment, at the applicant's
discretion, for the combined monument sign to serve businesses
located at 240 East First Street and 135 South Prospect Avenue.
Staff has prepared the revised resolution for the Council's
consideration.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN MODIFYING THE PLANNING COMMISSION'S DECISION
ON AN AMENDMENT TO DESIGN REVIEW 91-07, TO PERMIT
AN ADDITIONAL DEVELOPMENT BONUS RELATED TO SIGN
HEIGHT PURSUANT TO THE CRITERIA OF THE LOT
CONSOLIDATION PROGRAM OF THE FIRST STREET SPECIFIC
PLAN FOR THE PROPERTIES LOCATED AT 135 SOUTH
PROSPECT AVENUE AND 240 EAST FIRST STREET
The City Council of the City of Tustin does hereby resolve
follows:
I. The City Council finds and determines as follows:
A. That an appeal of the Amendment to Design Reviei
91-07 was filed by Henry Kumagai to request the
elimination of the requirement to provide combine4
sign copy area for a monument sign on the propert,
located at 240 East First Street.
B. That an appeal before the City Council was dul;
held on January 20, 1992 and continued to Februar;
3, 1992.
C. That, pursuant to the criteria stated in Sectio
III.F of the First Street Specific Plan, th
following was determined:
1. The request to permit only sign copy area fo:
the car wash business on the monument sig.
does not address the design guidelines of th
First Street Specific Plan in that the resul
would not further the cohesiveness of th
development site.
2. The addition of an architectural embellishmen
causing the overall sign height to exceed si
feet will provide an architectural featur
similar in character to the main buildings o
both sites meeting the design guidelines o
the First Street Specific Plan.
E. This project is considered to be Categoricall
Exempt (Class 11) pursuant to Section 15311 of th
California Environmental Quality Act.
II. The City Council hereby modifies the Plannin
Commission's decision on an Amendment to Design Revie
91-07 granting an additional development bonus related t

Consolidation Program of the First Street Specific Plan
for the properties located at 135 South Prospect Avenue
and 240 East First Street, subject to conditions
contained in Exhibit A attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Cit
Council, held on the 3rd day of February, 1992.

CONDITIONS OF APPROVAL
AMENDMENT TO DESIGN REVIEW 91-07
GENERAL
The proposed project shall substantially conform to the
submitted plans date stamped February 3"1 gas o herein
with the Community Development Department
modified or as modified by the Director of Community
Development.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to the issuance of
any building permits for the project, subjectto
review
and approval by the Community Development Department.
(1) 1.3 Design Review approval shall become null and void unless
sign permits and all construction is completed within
eighteen (18) months of the date of this exhibit.
(1) 1.4 Approval of the modification to an Amendment to Design
Review 91-07 is contingent upon the applicants signing
and returning an "Agreement to Conditions Imposed" form,
as established by the Director of Community Development.
*** 1.5 All applicable conditions contained in Exhibit A of City
Council Resolution No. 91-111 shall remain in full force
and effect.
*** 1.6 This approval is related to the monument sign only.
PLAN SUBMITTAL
(1) 2.1 At building plan check and prior to the issuance of sign
(3) permits, the applicant shall submit two copies of plans,
including site plan, fully dimensioned and detailed
elevations, attached methods and electrical details for
illumination, structural calculations for footings for
approval by the Building Official.
