RECOMMENDATION
It is requested that the Tustin City Council approve the attached
Memorandum of Understanding for the widening of overcrossings on
State Route 55 at Seventeenth Street, Santa Clara Avenue and
Fairhaven Avenue and authorize the Director of Public Works/City
Engineer to execute said Memoranddm of Understanding on behalf of
the City of Tustin.
BACKGROUND
The Orange County Transportation Authority (OCTA) is administering
the project design phase for Caltrans for the widening of the State
Route 55 (Costa Mesa) Freeway from Seventeenth Street to the State
Route 91 Freeway. Additionally, the funding source for the
construction of this project will be Measure "M" funds designated
solely for freeway type projects. It is proposed to separate the
project into two phases:
Seventeenth Street to Fairhaven Avenue
° Fairhaven Avenue to State Route 91
This staff report and the attached Memorandum of Understanding will
pertain to Phase I, between Seventeenth Street and Fairhaven
Avenue.
DISCUSSION
The State Route 55 widening Phase I will add a general purpose lane
and an auxiliary lane, widen the existing freeway median, travel
lanes and shoulder widths, and add a four foot high occupancy
vehicle (HOV) separation buffer in both directions of the freeway.
The freeway overcrossings at Seventeenth Street, Santa Clara Avenue
and Fairhaven Avenue are to be replaced to accommodate the freeway
widening. The staff for the Cities of Orange, Santa Ana, Tustin
and County of Orange (local agencies) have expressed a desire to
widen and increase the traffic capacities of each of these
overcrossings.
The Measure "M" Freeway program does not provide local agency
funding to increase the capacity of the overcrossings and any
overcrossing widening costs would have to be borne by each of the
local agencies where the facility is located. Table 1 of the
attached Memorandum of Understanding summarizes these estimated
costs to be borne by OCTA and the local agencies for the widening
of these facilities.
The attached Memorandum of Understanding provides for the
following:
1. That the widening of the three arterial highway crossings
over the State Route 55 Freeway are important to the
efficient and effective operation of the local street
systems.
2. The local agencies agree to pay a share of the
incremental costs to prepare the environmental
documentation, design and construct the widened
overcrossings. The design phase is scheduled to commence
in October, 1992 and construction is scheduled for July,
1995.
3. OCTA and the local agencies agree to enter into a
cooperative agreement to formalize the above
understandings and finalize the cost sharing prior to
commencing final design. ,
The four previously mentioned local agencies are all parties of the
Growth Management Area (GMA) No. 7 along with the City of Irvine
and have agreed upon funding the local agencies share with GMA No.
7 Measure "M" funds. In the event these funds were insuf f icient to
cover the local agencies share, staff would recommend that Tustin
fund its proportional share with Measure "M" turnback funds which
are estimated to be approximately $475,000 annually.

at
17TH STREET, SANTA CLARA AVENUE AND FAIRHAVEN AVENUE
BY AND BETWEEN
THE ORANGE COUNTY TRANSPORTATION AUTHORITY
AND
THE CITY OF ORANGE, CITY OF SANTA ANA, CITY OF TUSTIN
AND THE COUNTY OF ORANGE

The Orange County Transportation Authority (OCTA) in cooperation with the California
Department of Transportation (Caltrans) is proposing to implement operational and safety
improvements on State Route 55 between 17th Street and Fairhaven Avenue. It is
proposed to add a general purpose lane and an auxiliary lane; widen the existing freeway
non-standard median, travel lanes and shoulder widths; and add a four foot high -
occupancy vehicle (HOV) separation buffer in both directions on this segment of SR 55.
This project is included in the Measure M Freeway Program.
The freeway overcrossings at 17th Street, Santa Clara Avenue and Fairhaven Avenue are
to be replaced to accommodate the freeway widening. The Cities of Orange, Santa Ana
and Tustin and the County of Orange (local agencies) desire to widen and increase the
capacity of these overcrossings as part of this project.
Because the Measure M Freeway Program does not provide funding to increase the
capacity of overcrossings, the following understandings have been agreed to by the
above named agencies for the widening of these overcrossings:
A. That the widening of the above overcrossings are important to the efficient and
effective operation of the local street systems.
B. That the above named local agencies agree to pay a share of the incremental
costs to design and construct the widened overcrossings. The preliminary
estimated costs to widen the overcrossings and the funding responsibilities for the
local agencies and OCTA are shown on Table 1.
C. That OCTA will prepare the environmental documentation for the widening of the
above overcrossings and that the local agencies will share in the cost for this work.
D. That OCTA and local agencies shall enter into a cooperative agreement to
formalize the above understandings, to finalize the cost sharing and to establish
procedures for reimbursement prior to commencing the final design phase. The
final design phase is scheduled to begin in October 1992 and the project is
scheduled to advertised for construction in July 1995.
The above understandings constitute a guide to the intention and policies of the parties
involved through the preliminary development phase which includes technical studies,
project report and environmental documentation for the widening of the above
overcrossings.
