TUSTIN PLANNING COMMISSION
JANUARY 27, 2015

CONSENT CALENDAR:
Approved 1. APPROVAL OF MINUTES — JANUARY 13, 2015, PLANNING
as amended COMMISSION MEETING.
RECOMMENDATION:
That the Planning Commission approve the minutes of the January
13, 2015 meeting, as provided.
It was moved by Kozak, seconded by Altowaiji, to approve the January 13,
2015 Minutes, as amended. Motion carried 4-0-1.

TENANT SPACE.
A request to establish pawnbroker business in conjunction with a
retail jewelry and watch store located at 1631 Edinger Avenue,
Suite 104, within an existing 1,158 sq. ft. tenant space.

ENVIRONMENTAL:
This project is categorically exempt pursuant to the California
Environmental Quality Act (CEQA) Section 15301, Class 1.
RECOMMENDATION:
That the Planning Commission adopt Resolution No. 4277
approving CUP 2014-23 to authorize the establishment of a
pawnbroker business in conjunction with a retail jewelry and watch
store located at 1631 Edinger Avenue, Suite 104.

Smith Smith questioned the zoning code restrictions on window signage.
Binsack In response to Smith's question, Binsack stated the 25 percent maximum
allowable area is in the Tustin City Sign Code and that the amended
resolution provided would be a clarification of that requirement.
7:10 p.m. Public Hearing Opened.
Mr. Javanshir's comments/questions generally included: Background
information on his collateral lending business; favorable comments on
working and living in Tustin; clarification regarding window signage; his
understanding of the Tustin City Sign Code; and he asked if the blackened
window in front of the vault room could remain as signage or if it would be
considered part of the 25 percent requirement.
Binsack Binsack's response to Mr. Javanshir's questions generally included: The
possibility of qualifying for additional signage but it would be allocated to
the linear frontage of the store; signage may not pertain to the window area
that is blackened; and staff would need to take a look at what type of
signage would qualify.
Lumbard Lumbard asked if the blackened window would be considered signage
towards the 25 percent requirement. He also asked if the applicant
understood and was in agreement with the Conditions of Approval.
Binsack Per Binsack, the blackened window would constitute as a window and the
25 percent would apply; and that the applicant may qualify for additional
signage.

Mr. Javanshir was in agreement with the Conditions of Approval; however,
he requested further discussion with staff to see what he would be entitled
to, as well as clarification on pawnbroker signage and if that would include
using the word "loans". He also mentioned the blackened window with
regard to the previous owner and that there is only drywall behind the
window.
Binsack In response to Mr. Javanshir's question, the intent is "pawning" and the
purpose is "ancillary" to the primary use which is really the "jewelry"
function. The other portions may not be specifically advertised.
Smith Smith asked staff if the term "loan" is considered to be related to
"pawnbroker'.
Binsack Binsack stated the term "loan" would not be considered as part of a
"jewelry" store, but associated with the pawn operation.
7:15 p.m. Public Hearing Closed.
Kozak Favorable comments from Kozak to staff for the item and presentation as
well as for working with the applicant on the signage.
Altowaiji Favorable comments from Altowaiji for staff, the applicant and the item.
Smith Smith supported the amended resolution and thanked the applicant for
conducting his business in Tustin.
Lumbard Lumbard reiterated the comments the Commissioners previously stated.
It was moved by Smith, seconded by Altowaiji, to adopt Resolution No.
4277, as amended. Motion carried 4-0-1.
REGULAR BUSINESS:
Received 3. CITY OF TUSTIN COMMUNITY DEVELOPMENT 2014 YEAR IN
and filed. REVIEW
The Community Development Department's 2014 Year in Review
summarizes the Community Development Department's activity
throughout 2014 including discretionary permits processed and
approved (i.e. Conditional Use Permits, Design Reviews,
Subdivision Maps, etc.), major accomplishments for various
functional areas within the Department, Code Enforcement activities,
and Building Division activities.
RECOMMENDATION:
That the Planning Commission receive and file the report.

DiLeva- Presentation given.
Johnson
Kozak Kozak had favorable comments regarding the report. He is looking forward
to another similar year in 2015.
Altowaiji Altowaiji had favorable comments regarding the report as well as
Community Development's accomplishments.
Smith Smith had favorable comments regarding the report. He also asked about
the following: If film permits were being issued for the Hangars; what type
of film work is being done in the City; and what the long term branding
opportunities were.
Binsack Binsack's response to Smith's questions generally included: Plenty of
filming taking place city-wide including Tustin parks; there is filming interest
in the Old Town area and the Hangar; recently, a commercial was done at
the Domino's Pizza on Newport Avenue; and Chapman college students
are requesting film permits.
Lumbard Lumbard stated presentations were positive and impressive; positive
business environment, as seen by the new businesses; new construction
and infill construction throughout Tustin; increased Legacy planning shows
the City is past the economic slump; neighborhood improvements; graffiti
decrease; and he thanked staff, Commission and City Officials.
It was moved by Altowaiji, seconded by Kozak to receive and file the item.
Motion carried 4-0-1.
STAFF CONCERNS:
Binsack For the record, Chair Thompson's absence is excused.
COMMISSION CONCERNS:
Kozak Kozak thanked staff for the CLG report. Kozak attended the following:
• 1/20 City Council Meeting — Commissioner reappointments
• 1/23 10th Annual Mayor's Inaugural Dinner
Altowaiji Altowaiji congratulated Commissioners Lumbard and Smith on their
reappointment to the Planning Commission. On January 23, 20157
Altowaiji attended the 10th Annual Mayor's Inaugural Dinner.
Smith Smith thanked staff for working together for the past 2 years. He is looking
forward to working another 2 years with the Commission. Smith thanked
Council as well.

Lumbard Lumbard echoed Smith's comments. He is looking forward to the next 2
years and stated the last 2 years were interesting, busy, and fun.
7:35 p.m. ADJOURNMENT:
The next regular meeting of the Planning Commission is scheduled for
Tuesday, February 10, 2015, at 7:00 p.m. in the City Council Chambers
at 300 Centennial Way.
