= WATER MAIN REPLACEMENT
RECOMMENDATIONS:
That the Tustin City Council pass and adopt Resolution No. 92-25
declaring that public interest and necessity demands the
expenditure of public money to safeguard life and health for the
installation of approximately 1200 lineal feet of water main in
Esplanade Avenue between Seventeenth Street and a point 1200 + feet
northerly of Seventeenth Street.
BACKGROUND:
The proposed area of work is located on Esplanade Avenue between
Seventeenth Street and a point approximately 1200 + feet northerly
of Seventeenth Street.
Currently, there are sixteen residences on the westerly side of
Esplanade Avenue that front on and take access to Esplanade Avenue.
There is no water main located in Esplanade Avenue in this proposed
area of work and each of the sixteen residences are connected to a
5" steel water main on Gershon Place which is located westerly of
Esplanade Avenue. However, each of the water services to the
Esplanade Avenue residents traverse through an easement across the
residences fronting on Gershon Place a distance of approximately
120 feet.
A six inch diameter dead-end water main currently exists in
Esplanade Avenue northerly of the sixteen residences and the
nearest fire hydrant is located approximately 300 feet northerly of
the sixteen residences. There are no homes fronting along the
easterly side of Esplanade Avenue within this area.
DISCUSSION:
Staff has been receiving an increased number of complaints from the
Esplanade Avenue residents regarding their inability to receive
adequate water flow into their residences for everyday use. In
addition the lack of fire hydrants within the area could severely
hamper the ability to respond to fire fighting.
The installation of a new water main within Esplanade Avenue is
programmed/budgeted for this current fiscal year 1991-92, in the
amount of $97,700.00. However, plan preparation and the routine
Public Works bid advertisement procedures would not allow this
project to commence construction until June/July of this year.

Staff recommends that this water main installation project be
accelerated on an emergency basis with respect to both the design
and construction phases. In order to proceed with this project on
an emergency basis, it will be necessary to waive the formal bid
requirements. The attached resolution provides staff. the
authorization to proceed with said work on an emergency basis. It
is requested that this resolution be passed and adopted by the City
Council on February 3, 1992. Passage of the resolution requires a
four/fifths vote of the City Council. This action will allow staff
to negotiate a construction contract with contractors currently
doing work on water main replacement projects for the City.

RESOLUTION NO. 92-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
ORANGE COUNTY, CALIFORNIA, DECLARING THAT PUBLIC INTEREST
AND NECESSITY DEMANDS IMMEDIATE EXPENDITURE OF PUBLIC
MONEY TO SAFEGUARD LIFE AND HEALTH
WHEREAS, no domestic water main exists within the limits
of Esplanade Avenue, between Seventeenth Street and a point
approximately 1200 feet northerly of Seventeenth Street; and
WHEREAS, there are sixteen residences along the westerly
side of Esplanade Avenue that receive domestic water services
across private properties in an easement from a water main in
Gershon Place; and
WHEREAS, it has been determined that inadequate domestic
water flow and inadequate fire flow to the sixteen residences
exists.
NOW, THEREFORE, the City Council does resolve as follows:
SECTION 1. There is an immediate need to install a water
main along Esplanade Avenue, northerly of Seventeenth Street.
SECTION 2. That the public interest and necessity
demands the immediate expenditure of public money to safeguard
life and health.
SECTION 3: The Director of Public Works/City Engineer is
directed to take steps to immediately eliminate said
conditions in this emergency without complying with the formal
bidding procedures for public contract.
SECTION 4. This action is taken pursuant to Section
20168 of the Public Contract Code of the State of California.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin on the 3rd day of February,
'1992.
