The City Council meets the first and third Monday of each month at 7:00 p.m. in the City Council Chambers at 300 Centennial Way. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City Council agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use in the Council Chambers during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however,. if you desire to smoke, an outside speaker has been provided. JOINT MEETING WITH AUDIT COMMITTEE - The City Council will hold a joint meeting with the Audit Committee at 5:30 p.m. in. the Council Chambers. This meeting is open to the public. I. PROCLAMATION - CHERYL GUNDERSON, FORMER AUDIT COMMITTEE MEMBER V. PUBLIC HEARING 1. VESTING TENTATIVE TRACT MAP 14371 This item was continued from the January 6, 1992, City Council meeting in response to a petition submitted by concerned neighbors. These concerns centered on the conditions of the eucalyptus trees on the adjacent property to the north and the potential for Cactus Wren to be present on the site. Recommendation by the Community Development Department: a. Approve the Environmental Determination for the project by adopting the following Resolution No. 92-05: RESOLUTION NO. 92-05 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE TRACT MAP NO. 14371 AND ALL FEASIBLE MITIGATION CITY COUNCIL AGENDA PAGE 1 JANUARY 20, 1992 MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT b. Approve Vesting Tentative Tract Map No. 14371 by adopting the following Resolution No. 92-06, subject to conditions contained in Exhibit A: RESOLUTION NO. 92-06 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE TRACT MAP NO. 14371 TO CREATE FIFTY-FIVE (55) NUMBERED AND THREE (3) LETTERED LOTS FOR A SINGLE-FAMILY RESIDENTIAL PROJECT LOCATED ON LOT 26 OF TRACT 13627 VI. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO action can be taken on off -agenda items unless authorized by law). CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - JANUARY 6, 1992 REGULAR MEETING Recommendation: Approve the City Council Minutes of January 6, 1992. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $703,163.13 and ratify Payroll in the amount of $284,613.45. 3. RESOLUTION NO. 92-07 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ORDERING FORECLOSURE ACTIONS AND APPROVING SPECIAL COUNSEL AGREEMENT Recommendation: Adopt Resolution No. 92-07 ordering foreclosure actions and authorize the City Manager to execute the Special Counsel Agreement as recommended by the Finance Department. 4. RESOLUTION NO. 92-14 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESTRUCTION OF CERTAIN RECORDS Recommendation: Adopt Resolution No. 92-14 allowing for destruction of applications and testing materials for recruitments which have been closed for over two years as recommended by the Administrative Services Department. RESOLUTION , 92-18 - A RESOLUTION OF ',E CITY COUNCIL OF THE CITY OF TUSj.,.,40, CALIFORNIA, APPROVING THS� iDMISSION OF THE CITY OF DANA POINT AS A PARTY TO THE FOOTHILL/EASTERN TRANSPORTATION CORRIDOR AGENCY Recommendation: Approve the admission of the City of Dana Point as a party to the Foothill/Eastern Transportation Corridor Agency and authorize the Mayor to execute Amendment No. 2 to the First Amended and Restated Joint Exercise of Powers Agreement creating the Foothill/Eastern Transportation Corridor Agency by adopting Resolution No. 92-18 as recommended by the Public Works Department/Engineering Division. 6. ACCEPTANCE OF PUBLIC IMPROVEMENTS AND RELEASE OF BONDS FOR TRACT NO. 13788 Recommendation: Accept the public improvements within Tract No. 13788 and authorize the release of the following bonds of the indicated amounts: Faithful Performance Bond No. 09-12-80, $17,500.00; Labor and Material Bond No. 09-12-80, $8,750.00; and Monumentat ion Bond No. 09-12-81, $7,500.00 as recommended by the Public Works Department/Engineering Division. 7. RESOLUTION NO. 92-21 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 14295 Recommendation: Adopt Resolution No. 92-21, as submitted or revised, approving Final Tract Map No. 14295 as recommended by the Community Development Department. S. RESOLUTION NO. 92-20 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 13734 Recommendation: Adopt Resolution No. 92-20, as submitted or revised, approving Final Tract Map No. 13734 as recommended by the Community Development Department. 9. AWARD OF CONTRACT FOR SLURRY SEAL PROJECT, 1989-90 AND 1990-91 FY Recommendation: Award subject contract to Doug Martin Contracting Company, Inc., La Habra, in the amount of $153,468.61 as recommended by the Public Works Department/ Engineering Division. 10. RESOLUTION NO. 92-19 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 92-1 Recommendation: Adopt Resolution No. 92-19 approving Lot Line Adjustment No. 92-1 as recommended by the Public Works Department/Engineering Division. 11. TRACT NO. 13746 - QUITCLAIM DEED Recommendation: Authorize and execute the following document for Tract No. 13746 on behalf of the City: City Quitclaim Deed to Mandeville Condominium Association for relinquishment of sidewalk easements as recommended by the Public Works Department/Engineering Division. 12. RESOLUTION NO. 92-22 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION PROGRAM UNDER SECTION 164.56 OF THE STREETS AND HIGHWAYS CODE 1989 FOR THE NISSON ROAD LANDSCAPING RESTORATION PROJECT Recommendation: Adopt Resolution No. 92-22 authorizing Robert Ledendecker, Director of Public Works, to submit an application for the State Resource Agency Environment Enhancement and CITY COUNCIL AGENDA PAGE 3 JANUARY 20, 1992 Mitigatic Program Grant as recon led by the Community Developmer, L. Department. 13. RESOLUTION NO. 92-16 - A RESOLUTION OF THE CITY COUNCIL OF THE - CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION AND COMPENSATION OF TREE TRIMMERS Recommendation: Adopt Resolution No. 92-16 amending the City of Tustin Salary Schedule as recommended by the Administrative Services Department. VIII. ORDINANCES FOR INTRODUCTION - None IB. ORDINANCES FOR ADOPTION - None X. OLD BUSINESS - None %I. NEW BUSINESS 1. REDEMPTION OF 1973 CIVIC CENTER GENERAL OBLIGATION BONDS The City Council has expressed a desire to redeem outstanding 1973 Civic Center General Obligation Bonds at the earliest opportunity. Recommendation: Direct staff to call for the redemption of all outstanding bonds of the 1973 Civic Center issue on the next available call date of April 1, 1992. Further direct that, upon the determination of the Finance Director that the redemption has been finalized, any surplus funds are to be transferred to the Park Development Fund for future park projects as recommended by the Finance Department. 2. APPEAL OF AMENDMENT TO DESIGN REVIEW 91-07 The applicant is requesting that the copy area of a monument sign be permitted to reflect only his car wash business at 240 East First Street and not provide a copy area for the adjacent tire business located at 135 South Prospect Avenue. Recommendation: Uphold the Planning Commission's action by adopting the following Resolution No. 92-17, as submitted or revised, as recommended by the Community Development Department: RESOLUTION NO. 92-17 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION'S ACTION APPROVING AN AMENDMENT TO DESIGN REVIEW 91-07, GRANTING AN ADDITIONAL DEVELOPMENT BONUS RELATED TO SIGNAGE PURSUANT TO THE CRITERIA OF THE LOT CONSOLIDATION PROGRAM OF THE FIRST STREET SPECIFIC PLAN FOR THE PROPERTIES LOCATED AT 135 SOUTH PROSPECT AVENUE AND 240 EAST FIRST STREET 3. REQUEST FOR STOP SIGNS OR SPEED BUMPS ON PARRCENTER LANE AT MARICOPA AND AT MONTEREY STREET The City has received a letter from the management representative of the Maricopa Community Association requesting installation of stop signs or speed bumps on Parkcenter Lane at Maricopa and at Monterey Street. STATUS REPORT - ST. JEANNE DE LESTONNAC SCHOOL DRIVEWAY ACCESS At the January 6, 1992 City Council meeting, representatives of the St. Jeanne de Lestonnac School, at 16792 East Main Street, raised a concern about the impacted Main Street access to and from the school as a result of the I-5 Freeway widening project being administered by Caltrans. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. S. LEGAL FEES This report responds to the questions and comments in Councilmember Potts' December 5, 1991, memorandum to the City Manager regarding the City's cost for legal services. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - JANUARY 13, 1992 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of January 13, 1992. 2. ANNUAL REPORT OF THE AUDIT COMMITTEE AND SUBMITTAL OF THE CITY OF TUSTIN'S COMPREHENSIVE ANNUAL FINANCIAL REPORT DATED JUNE 301 1991 The Audit Committee has submitted a report outlining completion of duties and activities for the past year. Recommendation: Receive and file subject reports as recommended by the Audit Committee. 3. WISHING WELL RECONSTRUCTION Over the recent holidays, a heavy wind resulted in significant damage to the wishing well on the Civic Center site. Recommendation: Receive and file subject report as recommended by the Community Development Department. 4. STATUS REPORT - COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT The Americans with Disabilities Action (ADA), effective July 26, 1991, is a federal anti -discrimination statute designed to remove barriers that prevent qualified individuals with disabilities from enjoying the same opportunities that are available to non -disabled individuals. OVERVIEW OF 1991 WATER STATUS Summary of the actions undertaken during 1991 by the City of Tustin to meet conservation guidelines set by the Metropolitan Water District. Recommendation: Receive and file subject report as recommended by the Finance Department. 6. STATE OF THE CITY ADDRESS Mayor Charles E.
