REGULAR MEETING- 7:00 P.M. CALL TO ORDER INVOCATION PLEDGE OF ALLEGIANCE ROLL CALL CLOSED SESSION REPORT FIRST PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda, and within the subject matter jurisdiction of the City Council (no action can be taken on off-agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the digital recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name for the record. Total time allotted for public input on non-agenda items is limited to thirty (30) minutes to one (1) hour, at the discretion of the presiding officer. PUBLIC HEARING (ITEM 1 ) 1. ZONE CHANGE 02-006- MCAS TUSTIN SPECIFIC PLAN Zone Change 02-006 is a proposal to add Section 9246 to the Tustin City Code establishing the MCAS Tustin Specific Plan District (SP-1 Specific Plan) zoning regulations and amending the Tustin Zoning Map from Public and Institutional (P&I) to MCAS Tustin Specific Plan District (SP-1 Specific Plan). Recommendation from the Redevelopment Agency Staff: Open and Close a Public Hearing; and Introduce and have first reading by title only to adopt Ordinance No. 1257 approving Zone Change 02-006 adding Section 9246 to the Tustin City Code and amending the Tustin Zoning Map: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 02-006, AN AMENDMENT TO THE TUSTIN ZONING MAP TO RECLASSIFY CERTAIN PROPERTIES FROM THEIR EXISTING PUBLIC AND INSTITUTIONAL (P&I) DISTRICT ZONING DESIGNATION TO MCAS TUSTIN SPECIFIC PLAN DISTRICT (SP-1 SPECIFIC PLAN) IN ORDER TO ESTABLISH CONSISTENCY WITH GENERAL PLAN AMENDMENT 00-001, AND THE ADDITION OF SECTION 9246 TO THE TUSTIN CITY CODE RELATED TO THE ESTABLISHMENT OF THE MCAS TUSTIN SPECIFIC PLAN DISTRICT (SP-1 SPECIFIC PLAN) ZONING REGULATIONS. CONSENT CALENDAR (ITEMS 2 THROUGH 11 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. . APPROVAL OF MINUTES - DECEMBER 27, 2002 SPECIAL MEETING AND JANUARY 6, 2003 REGULAR MEETING Recommendation: Approve the City Council Minutes of December 27, 2002 and January 6, 2003. . APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $4,677,386.98 and ratify Payroll in the amount of $438,325.89. . PLANNING COMMISSION ACTION AGENDA- JANUARY 13, 2003 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. CLAIM OF JAMES NIEMIEC; CLAIM NO. 02-30 Recommendation: Deny the claim and direct the City Clerk to send notice thereof to the claimant and the claimant's attomeys. QUARTERLY INVESTMENT REPORT Recommendation: Receive and file the report. AWARD OF CONTRACT FOR THE RESURFACING OF THE HOCKEY RINK AT HERITAGE PARK (CIP NO. 2054) Recommendation: Award the construction contract for the resurfacing of the hockey rink at Heritage Park (CIP No. 2054) to Malibu Pacific Tennis Courts, Inc., the lowest responsive bidder, in the amount of $16,960, and authorize the Mayor and City Clerk to execute the contract documents on behalf of the City. APPROVAL OF AMENDMENT NO. 5 TO COOPERATIVE AGREEMENT NO. C-95-993 WITH ORANGE COUNTY TRANSPORTATION AUTHORITY FOR PROJECTS FUNDED BY MEASURE M Recommendation: Approve Amendment No. 5 to Cooperative Agreement No. C-95-993 with the Orange County Transportation Authority, and authorize the Mayor and City Clerk to execute the Agreement on behalf of the City. TUSTIN AREA SENIOR CENTER TENANT IMPROVEMENTS & COURTYARD LANDSCAPING RESOLUTION NO. 03-06; ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF COMPLETION Recommendation from Parks and Recreation Services: Adopt Resolution No. 03-06, accepting said work as complete, authorize the recordation of the Notice of Completion and direct the City Clerk to: 1. Release the Labor and Materials Bond no sooner than thirty-five days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond no sooner than one year after the date of recordation of the Notice of Completion. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR TUSTIN AREA SENIOR CENTER IMPROVEMENTS & COURTYARD LANDSCAPING (PROJECT NO. 2051) APPROVAL OF A JOINT USE AGREEMENT BETWEEN THE TUSTIN UNIFIED SCHOOL DISTRICT AND THE CITY OF TUSTIN FOR CAPITAL IMPROVEMENT OF SPORTS FIELD LIGHTING AT UTT MIDDLE SCHOOL Recommendation' Approve the Joint Use Agreement between the Tustin Unified School District and the City for the Sports Field Lighting Capital Improvement Project at Utt Middle School. RESOLUTION NO. 03-02- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION AND COMPENSATION PLAN FOR THE CITY OF TUSTIN AND APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF TUSTIN AND THE TUSTIN MUNICIPAL EMPLOYEES ASSOCIATION, CONCERNING WAGES, Agenda - City Council January 21, 2003 - Page 3 SALARIES, FRINGE BENEFITS AND CONDITIONS OF EMPLOYMENT Recommendation: Adopt Resolution No. 03-02 amending the City's Classification and Compensation plans and approving a one-year Memorandum of Understanding for the Tustin Municipal Employees Association as recommended by the Human Resources Department. REGULAR BUSINESS ( ITEMS 12 THROUGH 14 ) 12. ORDINANCE NO. 1264- ADOPTING PREZONE 02-001 FOR ANNEXATION NO. 158 (LORETTNBONNER/MEDFORD/GROVESlTE ANNEXATION) Adoption of Prezoning of LorettalBonnedMedfordlGrovesite county island properties from the Orange County "Single Family Residential" zoning district to the City of Tustin Single Family Residential (R-1) zoning district for annexation of Loretta/Bonner/Medford/Grovesite properties into the City of Tustin. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1264 (roll call vote): ORDINANCE NO. 1264- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING PREZONE 02-001 PREZONING THE LORETTA/BONNER/MEDFORD/GROVESITE COUNTY ISLAND PROPERTIES FROM THE ORANGE COUNTY "SINGLE FAMILY RESIDENTIAL" ZONING DISTRICT TO THE CITY OF TUSTIN SINGLE FAMILY RESIDENTIAL (R-l) ZONING DISTRICT 13. ORDINANCE NO. 1263- ADOPTING BY REFERENCE THE UNIFORM FIRE CODE WITH AMENDMENTS AND APPENDICES The State's Health and Safety Code requires local governments to adopt the most recent editions of the model codes related to construction. Ordinance No. 1263 introduces the California Fire Code. Recommendation: Introduce and have first reading by title only of Ordinance No. 1263 and set for second reading at the Council's February 3, 2003 meeting: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED CHAPTER OF ARTICLE 5 OF THE TUSTIN CITY CODE TO ADOPT THE 2001 CALIFORNIA FIRE CODE AND THE 2000 UNIFORM FIRE CODE AS AMENDED THERETO 14. RESOLUTION NO. 03-07 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, URGING THE CALIFORNIA LEGISLATURE TO REJECT THE GOVERNOR'S PROPOSED SHIFT OF LOCAL VLF REVENUES AND TO HONOR THE 1998 COMMITMENT TO RESTORE THE VLF Recommendation: Adopt Resolution No. 03-07 urging the Califomia Legislature to reject the governor's proposed shift of local VLF revenues and to honor the 1998 commitment to restore the VLF as recommended by the City Manager.
