PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF ORANGE STREET WIDENING/RECONSTRUCTION HCDA PROJECT (P.W. FILE NO. 2398) RECOMMENDATIONS: That the City Council, at their meeting of January 6, 1992, adopt the attached Resolution accepting works of improvement and repair and authorizing the recordation of the notice of completion for the Orange Street Widening/Reconstruction HCDA Project. Assuming no claims or stop notices are filed, it is further recommended_ that 35 days after the date of recordation of the notice of completion, the City Council authorize payment of the final 10% retention amount of $22,571.25. This amount together with the previous payment of $203,141.21 represents 1000 of the final contract amount of $225,712.46. -- BACKGROUND: This project included the construction of a storm drain connected to the new Caltrans storm drain on El Camino Real, new curb and gutter, sidewalk, handicap access ramps and street lighting on the west side of the street. Also, in this project, the street has been widened from 30 feet to 36 feet. Final.total of the bid items $166,918.39 Contract Change Order No. 1 61170.00 Contract Change Order No. 2 20,093.98 Contract Change Order No. 3 23,883.39 Contract Change Order No. 4 81646.70 $225,712.46 DISCUSSION: The storm drain and street improvements have now been completed by the contractor, Excalibur Contracting, Inc., of Irvine, to the satisfaction of the City's Public Works Department. Contract Change Order (C. C.O. ) 1 - Stemming from catch basin design change, an -increase in inlet size and an increase in quantity by one. C.C.O. 2 - Due to timing and the contract prices received for the project, the City was able to rehabilitate a larger portion of Orange Street with funds from the Major Maintenance'Program. C.C.O. 3 - Actual field conditions lead to an increase in asphalt concrete pavement removal and replacement quantities. C. C. 0. 4 - Various increases and decreases representing a change in contract bid quantity of twenty-five percent (25%) or more. These quantities were established during the final walk-through. The final contract amount for this project is $225,712.46. This represents a contract cost 35.8% above the original contract price of $166,208.65. However, 11.6% of the increase was to have been a part of the City's annual pavement repair program, but was included in this work to minimize any further disruption to the residents and to facilitate the completion of this work by utilizing the existing contractor. ACCEPTING WORKS OF IMPROVEMENT AND REPAIR, AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR ORANGE STREET WIDENING/RECONSTRUCTION - HCDA PROJECT WHEREAS, Excalibur Contracting, Inc., having a contract with the City of Tustin to construct the hereafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the notice of completion, and that Acceptance of said public work and improvement should be f iled and payment of the balance due on said contract be authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: The construction of a storm drain, some replacement of existing curb and gutter, installation of new P.C.C. curb and gutter and sidewalks, relocation of existing fences and signage and replacement and addition of asphalt concrete pavement. AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be and is hereby authorized to execute and file a notice of completion and acceptance of said public work and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin on the 6th day of January, 1992. ATTEST: City Clerk Mayor
