As we discussed, McWhinney Berries works with many non-profit organizations and charities throughout Orange County. McWhinney Berries, along with these charities, would like to expand our fundraising concept into the city of Tustin. I am enclosing, for your review, some background information and a copy of an ordinance the Orange County Board of Supervisors passed November 5th, 1991, to allow fundraising strawberry stands in the county. Other cities such as Huntington Beach, Fountain Valley, Westminster, Laguna Niguel, and Costa Mesa will be returning this season. Off' -site sale ,of single seasonal agricultural products A temporary stand for the sale of a singlet seasonal agricultural product not grown on site shall be permitted in any agricultural, commercial or industrial district or in similar areas of planned communities and specific plans, unless otherwise jyrohibi ted, and on all church and school sites and o vacant residential property abut tiing drterial highways subject to the following requirements: (a) R::tablishment of Use/time limit Prior to I -A -ginning sale of any product, ille applicant shall obtain a temporary c(,-,tificate of use and occupancy for land from the County of Orange. The certificate shall be good for a period time not to exceed 90 days from date of issuance. (b) Merchandise to be sold The stEnd shall be limited to the sale of a single agricultural product at any one time. (e) Electrical Permit The applicant shall secure an electrical permit from the Director, RMA if the facility is to be energized. (d) Re mova of facility The ft _ili ty shall be removed and the pr et,--ises cleared of all c. �tbr is and restored to the condition prior to the establishment of .the facility ui thi fourteen (14) days of the expiration of the time limit. (e) Fire p_evention standards The facility shall comply with the fire prevention standards as approved and enforced by the County Fixe Chief/ RECOMMENDED ADDITION (F) All sales must bip by or in conjunction with a non-profit organization.
