CALL TO ORDER / PLEDGE OF ALLEGIANCE INVOCATION- The Invocation will be given by Captain Lee Lescano, Salvation Army Church. ROLL CALL PUBLIC INPUT- At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO ACTION can be taken on.off-agenda items unless authorized by law). If you wish to address the city Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of.the meeting can be attributed to you. When you start to address the City Council, please state .your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. PUBLIC HEARINGS (ITEMS I THROUGH 2 ) 1. GENERAL PLAN AMENDMENT 95-001 (DAHN CORPORATION) The applicant proposes to change the present General Plan Land Use Designation of "Military" to "Industrial" on a 2.6 acre triangular site located north of Warner Avenue between Jamboree Road and Peters Canyon Wash. Recommendation by the Community Development Department: 1. Certify the Negative Declaration as adequate for the project by adopting the following ResoSutJon No. 96-2, as submitted or revised: _ RESOLUTION NO. 96-2 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR GENERAL PLAN AMENDMENT 95-001 INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT 2. DRNIA,.APPROVING GENER~ .AN AMENDMENT 95-001, A REQUEST TO CHANGE THE LAND USE DESIGNATION FROM "MILITARY" TO "INDUSTRIAL" ON A 2.6 ACRE PARCEL ON THE PROPERTY LOCATED NORTH OF WARNER AVENUE BETWEEN JAMBOREE ROAD AND THE PETERS CANYON WASH PROPOSED ADOPTION OF THE UPDATED EDITION OF THE UNIFORM BUILDING CODE AND ASSOCIATED TECHNICAL CODES WITH LOCAL MODIFICATIONS Uniform Building Codes, promulgated by the International Conference of Building Officials, are revised every three years. Recommendation by the Community Development Department: 1. Conduct public hearing as scheduled regarding Ordinance No. 1160. 2. Adopt the following Resolution No. 96-1 setting forth findings for local modifications to the uniform codes: RESOLUTION NO. 96-1 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SETTING FORTH FINDINGS WITH RESPECT TO LOCAL CONDITIONS WITHIN THE CITY OF TUSTIN WHICH MAKE CERTAIN MODIFICATIONS AND CHANGES TO THE UNIFORM BUILDING CODE, THE UNIFORM PLUMBING CODE, AND THE NATIONAL ELECTRICAL CODE REASONABLY NECESSARY FOR HOUSING OCCUPANCIES 3. Have second reading by title only of Ordinance No. 1160. 4. Adopt the following Ordinance No. 1160 (roll call vote): ORDINANCE NO. 1160 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF ARTICLE 8 OF THE TUSTIN CITY CODE ADOPTING THE 1994 EDITIONS OF THE UNIFORM CODES AS THE BUILDING REGULATIONS OF THE CITY OF TUSTIN CONSENT CALENDAR (ITEMS 3 THROUGH 6) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the-Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. ~ . APPROVAL OF MINUTES - DECEMBER 4, 1995 REGULAR MEETING Recommendation: Approve City Council Minutes of December 4, 1995. 4. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,370,327.79 and ratify Payroll in the amount of $639,669.01. RESOLUTION NO. 96-4 - A RESOLUTION OF THE-CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO RELEASE A PORTION OF THE COMBINED TRANSPORTATION PROGRAM FUNDS FOR THE EDINGER AVENUE WIDENING PROJECT FROM 2500 FEET WESTERLY OF JAMBOREE ROAD TO HARVARD AVENUE (PROJECT NO. 700127) Recommendation: Request the Orange County Transportation Authority to release a portion of the Combined Transportation Program Funds for the Edinger Avenue Widening Project from 2500 feet westerly of Jamboree Road to Harvard Avenue by passing and adopting Resolution No. 96-4 as recommended by the Public Works Department/Engineering Division. REGULAR BUSINESS (ITEMS 7 THROUGH 8 ) 7. ORDINANCE NO. 1161, ALCOHOLIC BEVERAGE SALES Ordinance No. 1.1 61 had first reading by title only and introduction at the December 4, 1995 City Council meeting. Recommendation' Have second reading by title only and adoption of the following Ordinance No. 1161 (roll call vote)' ORDINANCE NO. 1161 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS IN THE COMMERCIAL AND INDUSTRIAL DISTRICTS OF ARTICLE 9 OF THE TUSTIN CITY CODE DISTANCE SEPARATION REGULATIONS FOR ALCOHOLIC BEVERAGE SALES ESTABLISHMENTS (C.A. 95-003) Sm REDEVELOPMENT PROJECT AREA AGREEMENT BETWEEN THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY AND THE CITY OF IRVINE In March 1995, the Tustin City Council designated a survey area for redevelopment purposes which included the Marine Corps Air Station, Tustin and certain surrounding properties. State law allows the City of Irvine to authorize the Tustin Redevelopment Agency to create a survey area, and ultimately a project area, for the portion of the Base in Irvine. Recommendation' Approve subject Redevelopment Cooperative Agreement between the City of Tustin, Tustin Community Redevelopment Agency and the City of Irvine as recommended by the Assistant City Manager. OTHER BUSINESS- City Manager, City Attorney, and City Council COMMITTEE REPORTS- City Council CLOSED SESSION - The City Council will convene in closed session to confer with the City Attorney and Special Counsel regarding W.D. Franks vs. City of Tustin; VVCAB No. AHM 0040436; and to confer with Nick Nichols, the City's labor negotiator. The employee organizations involved in potential negotiations are Tustin Municipal Employees Association and Tustin Police Officers Association. Unrepresented employees are management and confidential units. ADJOURNMENT - The City Council has scheduled a joint meeting with the Audit Committee On Monday, January 15, 1996, at 5:00 p.m. in the Council Chambers; and the next regular meeting of the City Council is scheduled for Monday, January 15, 1996, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
