REQUEST TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO RELEASE A
PORTION OF THE COMBINED TRANSPORTATION PROGRAM FUNDS FOR THE EDINGER
AVENUE WIDENING PROJECT FROM 2500 FEET WEST OF JAMBOREE ROAD TO HARVARD
RECOMMENDATION
It is recommended that the 'City Council, at their meeting of January 2, 1996 request the Orange
County Transportation Authority to release a portion of the Combined Transportation Program
Funds for the Edinger Avenue Widening Project from 2500 feet westerly of Jamboree Road to
Harvard Avenue by passing and adopting the attached Resolution No. 96-04.
FISCAL IMPACT
The City's Capital Improvement Program budget for 1995-96 FY provides $1,029,550 for Final
Design, Construction and Construction Administration/Engineering/Contingencies for the project.
The Orange County Transit Authority (OCTA) has allocated $483,450 for the Construction
Implementation Phase of this project. Adoption of Resolution 96-04 will enable the City to
request and receive an initial payment from OCTA of $383,933.47 for the project.
BACKGROUND
On September 11, 1995, the OCTA approved the transfer of $483,450 in Master Plan of Arterial
Highways (MPAH) program funds from the Jamboree Road (Interstate 5 to Irvine Boulevard)
widening project to the Edinger Avenue (2500 feet westerly of Jamboree Road to Harvard
Avenue) widening project.
The City Council,. at their meeting of December 4, 1995, awarded the construction contract for
the Edinger Avenue widening project to Cornerstone C&M, Inc., dba Sully-Miller Contracting
Company in the amount of $874,785.48.
DISCUSSION
Pursuant to OCTA guidelines, once a construction project has been awarded, the awarding
agency may request release from OCTA of 90 percent of the lesser of either the total allocated
project funds or the construction bid amount: In this case, 90 percent of the construction bid
is the lesser, therefore, this is the amount to be requested. It is recommended that the Tustin
City Council pass and adopt the attached Resolution No. 96-04 which requests that the Orange
County Transportation Authority release 90 percent of the Funds or $383,933'.47. Upon
completion of ,construction and full project accounting, including final construction costs,
construction administration and contingencies, the City will then request the remaining allocal'~on
of eligible expenses up to the original allocation of $483,450.

RESOLUTION NO. 96-04
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
REQUESTING THE ORANGE COUNTY TRANSPORTATION
AUTHORITY TO RELEASE A PORTION OF THE COMBINED
TRANSPORTATION PROGRAM FUNDS FOR THE EDINGER AVENUE
WIDENING PROJECT FROM 2500 FEET WESTERLY OF JAMBOREE
ROAD TO HARVARD AVENUE (PROJECT NO. 700127)
WHEREAS, the Orange County Transportation Authority approved a Combined
Transportation Funding Program (CTFP) for fiscal year 1994-95; and
WHEREAS, the program includes $483,450 in fiscal year 1994-95 for a street
widening project on Edinger Avenue from 2500 feet Westerly of Jamboree Road to Harvard
Avenue; and
"WHEREAS, the City of Tustin has adopted a General Plan Circulation Element whiCh
does not preclude implementation of the MPAH within its jurisdiction; and
NOW, THEREFORE, BE IT RESOLVED that the City of Tustin, hereby requests
the Orange County Transportation Authority allocate $383,933.47 of CTFP funds from the
MPAH Program for construction of said project to the City. This request is in conformance,
with the CTFP allocation process and does not exceed ninety (90) percent of the programmec
amount or ninety (90) percent of the construction contract.
BE IT FURTHER RESOLVED, that the City of Tustin, agrees to fund its share of
the improvement costs during Fiscal Year 1995-96 and any additional costs over the identified
programmed amount.
BE IT FURTHER RESOLVED, that the City of Tustin, has awarded the contract for
the project on December 4, 1995 for $874,785.48.
BE IT FURTHER RESOLVED, that the City of Tustin has: 1) designed the project
improvements; and 2) completed, required preparatory work in accordance with the standards
required by the City and other affected jurisdictions involved with said project.
BE IT FURTHER RESOLVED, that the remaining ten (10) percent in CTFP funds
will be transferred to the City of Tustin when construction is completed and a Final Report on
the project is accepted by the Orange County Transportation Authority. The City of Tustin
agrees to submit the final report to the Orange County Transportation Authority within one
hundred twenty (120) days after the City's acceptance of the improvements.
