HUSTON, CITY MANAGER OFFICE OF THE CITY CLERK CONFLICT OF INTEREST CODE - DESIGNATED POSITIONS RECOMMENDATION Adopt Resolution No. 96-7 modifying the Appendix, Designated Positions, contained in the City's Conflict of Interest Codes. FISCAL IMPACT None BACKGROUND The Appendix (Designated Positions) defines those officials and employees who are required to file Statements of Economic Interests (Form 730). Prior to the filing of 1995 annual statements, the designated positions should be modified to reflect changes or deletions that have occurred within the City's classification system. It should be noted that pursuant to Government Code Section 87200, the positions of Councilmember, City Manager, City Attorney, Finance Director and Planning Commissioner, are required to file a Form 721 and are, therefore, not included as designated positions in the Appendix. The positions of Redevelopment Program Manager and Redevelopment Project Manager are designated positions pursuant to Resolution No. RDA 95-1 adopted by the Redevelopment Agency on March 20, 1995. The positions of Director of Community Services and Senior Accountant have been added to the Appendix of Resolution No. 96-7. No positions were deleted. That the revised Appendix, attached hereto, be aPproved and 'the Conflict of Interest Codes be modified accordingly. Ce That pursuant to Section 4 of the Conflict of Interest Codes of the City of Tustin, the City Council, as the Code-reviewing body, hereby instructs all persons occupying a designated position to file with the City Clerk's office Statements of Economic Interests as required' (1) assuming position, (2) leaving position, and (3) annually. Category I: Investment and real property disclosure. Category II: Personal income disclosure. Category III: Business Income, Commissions and Position Disclosure. * The City Council, City Manager, City Attorney, Finance Director, Planning Commissioners, and other public officials who manage public investments are required to file statement of Economic Interests Form 721 pursuant to Government Code Section 87200 and are, therefore, not included as designated positions in this Appendix. ** The city Manager shall determine on a case-by-case basis whether a particular consultant is required to comply with the disclosure requirements listed above. If the City Manager determines that a particular consultant must comply with the above disclosure requirements, the City Manager shall notify the consultant in writing. The written notification shall include a description.of the consultant's duties and, based upon those duties, a statement of the extent of the disclosure requirements. The City Manager's notification is a public record and shall be retained for public inspection by the City Clerk in the same manner and location as this Conflict of Interest Code. 2 :DESGPOSA
