HUSTON, CITY MANAGER FROM- COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: RESOLUTION 96-23; SUPPORT FOR MEASURE S BACKGROUND On March 4, 1996, the City Council directed staff to prepare a resolution supporting the "Responsible Economic Development Initiative -- Measure S" on the March 26, 1996, County of Orange Primary Election ballot. Resolution 96.-23 is attached for the City Council's consideration. If passed, Measure S would repeal the initiative known as Measure A which was passed by voters on November 8, 1994. Measure A created an E1 Toro Airport Planning Area that identifies the highest and best civilian use for the Marine Corps Air Station; E1 Toro (MCAS, E1 Toro) as a civilian airport serving Orange County's air passenger and air cargo needs. In contrast, Measure S recognizes that the highest and best use of MCAS, E1 Toro, is not necessarily 'a civilian airport and explores other land uses. In summary, Measure S would: Delete changes to the County's General Plan enacted by Measure A, including deleting the commercial aviation land use designation for 2,000 acres at MCAS, E1 Toro; Abolish the E1 Toro Airport Citizens Advisory Commission; Require that an airport plan for a commercial airport at MCAS, E1 Toro be ratified by a majority of the voters of Orange County; and Require that any proposed airport plan be the subject of a valid Environmental Impact Report (EIR) and Environmental Impact Statement (EIS). A valid EIR, as defined by Measure S: Does not allow for a Statement of Overriding Considerations to be made; Requires full mitigation measures for any significant environmental impacts: and, Has not been challenged in court or has been challenged and appealed and is not subject to further challenges. RESOLUTION 96-23; SUPPORT FOR MEASURE S March 18, 1996 Page 2 DISCUSSION In developing Resolution 96-23, staff addressed, general issues related to the land use planning process for MCAS, E1 Toro as well as potential environmental impacts to Tustin. Although Measure S does not preclude implementation of a commercial airport, the initiative proposes a more traditional land use planning process than Measure A, wherein operational, fiscal, and environmental impacts will be studied prior to approval of enabling entitlements (e.g., General Plan amendments, zoning code amendment, and use permits). In contrast, Measure A enacted an amendment to the County's General Plan without prior fiscal and environmental analysis. Although there are no final environmental documents for the designated land uses at MCAS, E1 Toro, there are potential environmental impacts associated with the development of a commercial airport. Staff has reviewed "Opportunities for Commercial Aviation Development at MCAS, E1 Toro" prepared by the E1 Toro Reuse Planning Authority (ETRPA), a Joint Powers Authority comprised of member cities in the vicinity of MCAS, E1 Toro. The study was released on February 29, 1996, and is a preliminary analysis of operational, fiscal, and environmental opportunities and constraints associated with development of a commercial airport on 2,000 acres of MCAS, E1 Toro. The study concluded that: The potential flight patterns of aircraft arriving and departing from a commercial airport at MCAS, E1 Toro may need to be oriented in a north/south direction; Noise impacts associated with a commercial aviation facility at MCAS, E1 Toro may significantly affect neighborhoods that are not currently affected by military operations; and, A significant increase in both regionally and locally generated traffic accessing a commercial aviation facility may affect existing and planned transportation facilities in the vicinity of MCAS, E1 Toro. Specifically related to Tustin, the potential environmental impacts of a commercial aviation facility at MCAS, E1 Toro include concerns related to overflights, noise, and traffic, and support the findings of Resolution 96-23. The City Council of' the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: ae Whereas the Orange County/E1 Toro Economic Stimulus Initiative (Measure A) narrowly passed in November 1994, despite being strongly opposed by the communities in closest proximity to MCAS, E1 Toro; and,' Be Whereas Measure A amended the County's General Plan to designate 2,000 acres of MCAS, E1 Toro for commercial aviation and the remaining 2,738 acres for uses compatible with an airport; and, Co D® Whereas, the existing planning process was implemented through ballot box planning and was not the product of detailed consideration or study, and requires the use of an initiative to provide any redress by the citizens of Orange County; and, Whereas, objective studies of the highest and best use for the subject property have not been completed; and, Et Fo Ge Whereas, studies of constrained air transportation and cargo demands are not yet available; and, Whereas, the financial impact of developing a commercial airport at MCAS, E1 Toro is not yet known, nor are any funding sources identified; and, Whereas,. the potential flight patterns of aircraft using, a commercial aviation facility at MCAS, E1 Toro have not yet been determined and may need to be oriented in a north/south direction, thereby' subjecting portions of Tustin to overflights; and, 10 11 12 13 14 15 16 18 19 20 21 22 23 ~24 ¸25 26 27 Resolution No. 96-23 Page 2 He I · Whereas, the noise impacts associated with a commercial aviation facility have not yet been determined and may subject portions of Tustin to significant aircraft noise from overflights; and, Whereas, the impact to existing and planned off- site transportation systems, on and off-ramps, overpasses, and infrastructure has not been determined and may result in a significant increase of both regionally and locally, generated traffic on local roadways in Tustin; and, NOW THEREFORE, be it resolved that the City Council of the City of Tustin supports Measure S on the March 26, 1996, County of Orange Primary Election ballot.
