HUSTON, CITY MANAGER TO: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FROM: SUBJECT: REQUEST TO INVES~GA~ THE GATING OF KENYON DRIVE RECOMMENDATION: It is recommended that the City Council, at their meeting of March 18, 1996, receive and file this report. FISCAL IMPACT: None at this time. BACKGROUND: At a recent City Council meeting Mayor Potts requested that City staff investigate the possible gating of Kenyon Drive. DISCUSSION: According to the California Vehicle Code Section 21101.6, local authorities may not place gates or other selective devices on any public street which deny or restrict the access of certain members of the public to the street, while permitting others unrestricted access to the street. Based upon this, gates could not be installed on Kenyon Drive and still maintain it as a public street unless access was restricted for everyone. However, gates could be installed on Kenyon Drive by converting it to a private street. It is possible for the City, pursuant to the provisions of the Streets and ,Highways Code Sections 8300, to vacate streets as long as (1) the streets are unnecessary for present or prospective public use and (2) there is some public benefit to the City. There would be a public benefit for the city by being released from responsibility for maintenance of the streets. The abutting property owners would become responsible for street maintenance. Since Kenyon Drive is a cul-de-sac street and not regularly used as a through street by the public at large, presumably the street would be unnecessary for public use. Additionally, all of the adjacent property owners would need to consent to the vacation of the street. The street vacation process would involve the adoption of a Resolution of Intention to vacate by the City Council, which may be upon its own initiative or upon a petition or request of an interested person or party. The resolution would also need to identify the time and place of a public hearing for all persons interested in or objecting to the proposed vacation. Also, the adjacent property owners would need to enter into an agreement for maintenance responsibility and provide easements for all underlying utilities. According to their Public Works Department, they have not gated a public street to date. They did indicate that they have installed cul-de-sacs and mm restriction devices such as raised median islands and barricades, which have proven effective to deter traffic on certain streets. It is recommended that before the City considers the vacation of Kenyon Drive that all the property owners present the City a signed petition requesting the vacation. Tim D.
