PUBLIC HEARING ( ITEM I )
1. FISCAL YEAR 1996-97 ONE-YEAR ACTION PLAN AND PROPOSED USE OF
COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS
The Citizen Participation Committee is recommending that the City Council support
proposed projects for use of Fiscal Year 1996-97 CDBG funds for inclusion into the
One-Year Action Plan.
Recommendation: Adopt the following Resolution No. 96-25 approving the proposed
use of Community Development Block Grant (CDBG) funds for inclusion in the
Consolidated Plan - One-Year Action Plan for Fiscal Year 1996-97:

2. HEARING AND ADOPTION OF RESOLUTION OF NECESSITY FOR THE
SEVENTEENTH STREET WIDENING PROJECT (NORTHSIDE OF 17TH STREET
BETWEEN CARROLL WAY AND SR-55
The Orange County Transportation Authority in cooperation with Caltrans is widening
SR-55, and the project also involves the widening of the 17th Street bridge over SR-
55. A cooperative agreement between the Cities of Tustin, Santa Ana and the
County of Orange has been approved to widen the 17th Street approaches to the
SR-55 bridge, which involves the construction of a westbound dedicated right-turn
lane between Carroll Way and SR-55. The affected properties are portions of two
parcels along the northside of 17th Street. The City needs to acquire some of the
parcels' frontage to widen 17th Street to create the dedicated right-turn lane and to
acquire a temporary construction easement on both parcels.
Recommendation by the City Attorney'
1. Hold hearing for property owner to address proposed Resolution of Necessity.
2. Adopt the following Resolution of Necessity. A four/fifths (4/5) vote is required
for approval'

Recommendation: Approve the City CoUncil Minutes of March 18, 1996.

APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation. Approve Demands in the amount of $1,624,'567.26 and ratify
Payroll in the amount of $337,142.11.

Recommendation: Adopt Resolution No. 96-26 accepting said work as complete and

Recommendation: Adopt Resolution No. 96-28 accepting said work as complete and
authorize the recordation of the Notice of Completion and direct the City Clerk to (1)
Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion,-and (2) Release the Faithful

DIRECTIVE TO FILL AUDIT COMMITTEE VACANCY
Recommendation: Direct staff to advertise for applicants to fill the remaining term
of G.W. Jeffries, who recently resigned from the Audit Committee as recommended
by the Finance Department.
RESOLUTION NO. 96-30 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

Recommendation: Adopt Resolution No. 96-30 accepting said work and authorizing
recordation of the Notice of Completion as recommended by the Public. Works
Department/Water Division.

SERVICE AUTHORITY ABANDONED VEHICLE (SAAV) REIMBURSEMENT PROGRAM
Recommendation: Approve the appropriation of funds received from the Service
Authority Abandoned Vehicle (SAAV) Reimbursement Program to the Community
Development Department-Planning Division (3010) Supplies and Services Accounts
as recommended by the Community Development Department.

14. ASSEMBLY BILL 2736
Assembly Bill 2736 amends the .military base redevelopment section of the
Community Redevelopment Law.
Recommendation: Adopt the following Resolution No. 96-29 supporting Assembly
Bill 2736 amending the redevelopment law to facilitate the use of redevelopment
benefits at closing military bases, and directing the Assistant City Manager to inform
the Bill's sponsor and others of the City's support for the measure:

BUSINESS AND DE~,,__~0PMENT PLAN
The Department of Defense has published the final rules for implementing portions
of the National Defense Authorization Act. The rules provide the .City an opportunity
to obtain title to surplus military properties at or below fair market value through an
Economic Development Conveyance (EDC). Approval of an EDC requires the
submission of an application and a number of items of information which explain why
an EDC is being requested. One of the items to be submitted is a Business and
Development Plan.
Recommendation' Authorize the City Manager to execute a Consultant Services
Agreement with the Sedway Kotin Mouchly Group for preparation of a Business and
Development Plan as recommended by the Assistant City Manager.
PROPOSED AMENDMENTS TO THE CITY OF TUSTIN INVESTMENT POLICY
The Government Code and the City of Tustin's Investment Policy require at least an
annual review of the current policy and informal adoption of the policy for the'
following year.
Recommendation' Adopt the amended City of Tustin Investment Policy as
recommended by the Audit Committee.
REQUEST FOR FUNDING, FOOTHILL HIGH SCHOOL GRAD NIGHT
The Foothill High School Grad Night Committee is requestin'g a $3,000 donatio'n from
th'e City of Tustin.
Recommendation: Pleasure of the City Council.
RESOLUTION NO. 96-32, RECOVERY OF STATE LIBRARY FUNDING
Mayor Pro Tern Worley 'requested that the City Council adopt the following
Resolution No. 96-32 concerning funding for the Orange County Library System'
RESOLUTION NO. 96-32- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, STATING THE COMMITMENT OF THE CITY OF TUSTIN TO
RECOVER STATE LIBRARY FUNDING WHICH HAS BEEN WITHDRAWN
Recommendation: Pleasure of the City Council.
AMENDMENT TO CONTRACT WITH PUBLIC EMPLOYEES RETIREMENT SYSTEM TO
ADD MILITARY BUY BACK OPTION
Government Code Section 20930.3, Military Service as Public Service, allows
employees to elect to purchase up to four years of service credit for any continuous
active military or merchant marine service prior to employment.

OF TUSTIN, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE
CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF TUSTIN AND THE
BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES
RETIREMENT SYSTEM
AUTHORIZATION TO ENTER INTO AN AGREEMENT WITH EMPLOYMENT
SYSTEMS, INC.
The City was notified in 1995 that the Department of Defense Office of Economic
Adjustment had approved a grant to the City in the amount of 9397,043 for
additional planning-related activities pertaining to the closure of MCAS Tustin. One
of the specific uses of grant funds that was approved was the provision of additional
interim staff support for MCAS Tustin-related planning efforts.
Recommendation by the Assistant City Manager:

Certify by minute motion that the 'use of Employment Systems, Inc. is
consistent with the City's purchasing ordinance and would not require formal
bidding procedures and that a bid process for the proposed services would be
impractical and unsuitable.

Authorize the Assistant City Manager to negotiate and enter into an agreement
with Employment Systems, Inc. to provide contract staffing services for grant-
related tasks to the City of Tustin, subject to review and approval by the City
Attorney.
REMOVAL OF BUS BENCH TRELLIS FROM THE SOUTHEAST CORNER OF MAIN
STREET AND EL CAMINO REAL
Mr. Phil Cox has submitted a letter requesting that the bus bench/trellis located on
the southeast corner of Main Street and El Camino Real be removed.
Recommendation: Direct staff to remove the existing bus bench/trellis from the
southeast corner of Main Street and El Camino Real as recommended by the Public
Works Department/Engineering Division.

At the November 20, 1995 regular meeting of the Tustin Community Redevelopment
Agency, the Agency authorized the use of South, Central Project Area increment for
'the acquisition and architectural design services for the Newport Family and Youth
Center.
Recommendation: Review and comment on site plan; direct staff to begin
developing construction documents as recommended by the Community Services
Department.
