HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT ASSEMBLY BILL 2736 RECOMMENDATION That the City Council adopt Resolution No. 96-29 supporting Assembly Bill 2736 amending the redevelopment law to facilitate the use of redevelopment benefits at closing military bases, and directing the Assistant City Manager to inform the Bill's sponsor and others of the City's support for the measure. FISCAL IMPACT · No negative fiscal impact will occur as a result of Council support or State adoption of this Assembly Bill. In fact, it is anticipated that the provisions established by the bill would be potentially beneficial to the City in using redevelopment for closing Marine Corps Air Station (MCAS) Tustin. BACKGROUND/DISCUSSION AB 2736 (Weggeland) amends the military base redevelopment (MBR) section of the Community Redevelopment Law (CRL). MBR was intended to facilitate the use of redevelopment tools to upgrade the infrastructure at closing military bases. Just as traditional redevelopment was designed to finance improvements to outdated and deteriorated infrastructure in blighted urban areas, redevelopment is also an appropriate tool for financing improvements to inadequate infrastructure on former military base sites. MBR was enacted in 1993 (Chapters 943 and 944), but has not been used by any military base reuse authority because of severe limitations in the enacted provisions. AB 2736 is an attempt to remedy these limitations and to add additional provisions that have been approved in special legislation for individual bases and for disaster areas (Chapter 186/1995). The following summary highlights some of the key provisions of the bill: 1) Revises and simplifies the definition of blight for MBR, to more appropriately match conditions on closing military bases. City Council Report Assembly Bill 2736 April 1, 1996 Page 2 2) 3) 4) 5) 6) Aligns the allocation,formula for tax increment to match the statutory formula in AB 1290 (standard CRL). Allows inclusion of off-base property in the base project area only if it meets the standard (AB 1290) definition of blight. Repeals the requirement for a fiscal review committee (unnecessary, since pass-through would be statutory rather than negotiated). AllOws deferral for up to 10 years of payments to the low- and moderate-income housing fund. Any deferral must be repaid by the 20th year after the deferral begins. Allows deferral of CEQA for the redevelopment plan for up to 18 months. During this period, individual projects will be subject to CEQA if they may cause an effect on the environment. The City is supporting its own legislation to accomplish many of the provisions indicated above. However, the City should support AB 2736 to ensure benefit to the MCAS, Tustin project particularly if our own legislative efforts are not successful. CONCLUSION Adoption of Resolution No. 96-29 will indicate the City of Tustin's support of Assembly Bill 2736 and could lead to legislative changes which would assist the City in establishing a redevelopment project area at MCAS Tustin. Since creation of a redevelopment project area is seen as critical to the reuse and economic, development of the base, staff recommends that the City Council adopt Resolution 96-29 and direct the Assistant City Manager to inform the Bill's sponsor and others of the City's support for the measure. Christine shingleton-// Assistant City Manag'~r DO:do\ccreportXab2736. do Attachments: Resolution No.96-29 Dana Ogdo~ Senior Planner 2-O 2.2 2.3 2.4 15 17 2-8 2.9 2O 22. 22 23 24 25 26 27 28 RESOLUTION NO. 96-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SUPPORTING THE ADOPTION AND ENACTMENT OF AB 2736 AMENDING REDEVELOPMENT LAW TO ASSIST REUSE AND ECONOMIC DEVELOPMENT AT CLOSING MILITARY INSTALLATIONS The City Council of the City of Tustin, California, DOES HEREBY RESOLVE as follows: WHEREAS, the military base redevelopment (MBR) section of the Community Redevelopment Law (CRL) was enacted in 1993 to facilitate reuse and economic development at closing military installations in California; and WIqEREAS, severe limitations in the enacted provisions prevented the use of the MBR by agencies interested in the use of redevelopment for installations closing in their jurisdictions; and WHEREAS, Assemblyman Weggeland has drafted Assembly Bill 2736 to amend the MBR to eliminate these limitations and has asked for input from affected communities; and WHEREAS, the City Council has considered the benefits of Assembly Bill 2736 at a public meeting held on April 1, 1996; NOW THEREFORE, BE IT RESOLVED that the City Council: . Supports the passage of Assembly Bill 2736 to further the reuse and economic development efforts at closing military bases throughout California; and o Directs the Assistant City Manager communicate this support to the State Assembly and other affected parties.
