INCREASE AND SET A PUBLIC HEARING DATE FOR JUNE 16, 2015
SUMMARY
Prior to solid waste and recycling rates being increased on July 1, 2015, the City Council is
required by Proposition 218 to notify all affected customers and conduct a protest hearing to
review and set rates. As part of this item, the City Council is being asked to approve the Notice
of Public Hearing that will be distributed to all CR&R Incorporated (CR&R) customers under the
City's contract and set the public hearing for June 16, 2015.
RECOMMENDATION
It is recommended that the City Council approve the Notice of Public Hearing for Solid Waste
Rate Increase and set a public hearing for June 16, 2015 at 7:00 p.m.
FISCAL IMPACT
There is no fiscal impact. Per the City's solid waste contract, CR&R Incorporated is responsible
for all costs associated with notifying the public of rate increases.
CORRELATION TO THE STRATEGIC PLAN
This item contributes to the fulfillment of the City's Strategic Plan Goal D: Strong Community
and Regional Relationships. Specifically, by implementing Strategy 3, which is to obtain
feedback from the community.
DISCUSSION AND BACKGROUND
CR&R's current rate structure was adopted by the City Council in July 2009 after a formal protest
hearing was conducted and Resolution No. 09-39 was adopted. Per Section 53756 of the
California Government Code, an agency providing refuse collection service may adopt a
schedule of fees or charges authorizing automatic adjustments for inflation if the schedule of fees
complies with the following:
Is for a period not to exceed five years,
Includes a clearly defined formula to adjust for inflation, so long as the adjustment does
not exceed the cost of providing the service, and
Notice of any adjustment pursuant to the schedule shall be provided not less than 30
days before the effective date of the adjustment.
Each of these requirements have been met and therefore a public hearing has not been
required since 2009. A protest hearing was required in 2014. However, CR&R and the City
were able to negotiate an amendment to the Contract that along with other items included a rate

freeze for all solid waste and recycling rates for one year, beginning July 1, 2014. The rate
freeze eliminated the need for the protest hearing.
Per the terms and conditions of the Contract, rates for service may only be increased for cost of
living adjustments, fee increases at solid waste disposal sites, and for a contractual recycling
incentive. CR &R's right to adjust service rates is contingent upon City confirmation that CR &R
has met the requirements of the Contract. The requirements have been met and the City will be
able to consider a rate adjustment for July 1, 2015.
The service rates are calculated in accordance with the rate formula established in the Contract,
which has four components: Collection, Processing, Disposal, and Diversion Incentive. The
Collection component is calculated based on the Producer Price Index (PPI) for Natural Gas
and for Finished Goods Less Food and Energy. The Processing component is calculated based
on the PPI for Finished Goods Less Food and Energy. The Disposal component is calculated
based on the actual change in the tipping fee at Orange County landfills. The Diversion
Incentive is a 1% incentive bonus for diverting 50% of the waste stream from all sectors within
the City.
Notice of Public Hearing
In order to comply with Proposition 218, the City must notify all customers affected by an
increase in solid waste and recycling rates of their opportunity to protest the rate increase for a
period of no less than 45 days prior to the public hearing in which rates are to be set. Should
the City receive a majority protest, the rate increase cannot take effect.
The rates set at the June 16, 2015 public hearing can be adjusted per the formula set forth in
the Contract on an annual basis for a period of no more than five (5) years so long as all
affected customers are notified at least thirty (30) days prior to the increase becoming effective.
CR &R's Contract expires prior to this and therefore the attached notice is allows for rate
adjustments through July 1, 2017.

NOTICE OF PUBLIC HEARING ON PROPOSED INCREASES
TO RATES FOR COLLECTION OF SOLID WASTE, RECYCLABLE MATERIALS,
YARDWASTE AND FOOD SCRAPS
The Tustin City Council will hold a public hearing on June 16, 2015 at 7:00 p.m. or as soon thereafter as the matter may
be heard, at 300 Centennial Way (City Council Chamber), to consider proposed increases to residential, commercial, and
multifamily rates for collection and handling of solid waste, including trash, yardwaste, recyclable materials and food
scraps within the City (collectively, "solid waste services "). You are receiving this notice because our records indicate you
are (a) the owner of real property that receives solid waste services; (b) a tenant that receives solid waste services and is
directly responsible for the payment of fees for those services; and /or (c) a property manager or property management
company that operates, manages or otherwise controls parcel(s) receiving solid waste services. Pursuant to City Code
Section 4312, all occupied properties in the City are required to arrange for solid waste collection service by the City's
contracted solid waste hauler (or to self -haul their own solid waste in accordance with requirements of the City Code).
This notice lists both the current rates and the new rates proposed to become effective July 1, 2015. If approved by the
City Council, the new rates will apply to all solid waste services provided by the City's contractor in the City of Tustin.
Rate Structure
In 2007 the City conducted a competitive procurement for a contract for solid waste services within the City and
awarded the contract to CR &R Incorporated. Pursuant to the contract, the rate structure for monthly solid waste service
fees has two customer classes: residential, and commercial /multi - family. The rates for solid waste service fees imposed
on each customer class are determined on the basis of (i) the size of the container (expressed in 'gallons' for wheeled
carts and in 'cubic yards' for bins and roll off boxes) serving the property; (ii) the type of material in the container (e.g.
yardwaste, recyclable materials, food scraps, or municipal solid waste ( "trash ")); and (iii) the frequency of pickups per
week. The rates are comprised of three components: the Collection Fee, the Processing Fee; and the Disposal Fee.
No Annual Rate Adjustment in 2014

The City's original 7 -year contract with CR &R would have terminated September 30, 2014. In 2014 the City negotiated a
3 -year extension to September 30, 2017. As part of that negotiation, CR &R agreed to forego all parts of the annual rate
adjustment for 2014. Therefore, ratepayers did not receive an increase last year.
Calculation of Rate Adjustment
In accordance with the contract, the rates for solid waste services are adjusted annually to reflect changes in costs
according to specified indexes ( "PPI Adjustments "), The Collection Fee is adjusted annually by a combination of the PPI
for Natural Gas and the PPI for Finished Goods Less Food and Energy. The Processing Fee is adjusted annually by the PPI
for Finished Goods Less Food and Energy. The Disposal Charge is only adjusted when the County of Orange actually
adjusts the Disposal Charge at County -owned landfills. Effective July 1, 2015 the County has increased the Disposal
Charge by $0.54 per ton. Each year, CR &R is eligible to receive an incentive payment if the company recycled at least
50% of the tons it collected in the prior calendar year. The incentive is equal to a 1% rate increase. This helps the City
achieve the state - mandated recycling level of 50% and assists toward meeting the new statewide goal of 75% recycling
by 2020. CR &R earned the incentive for calendar year 2014. The above - described PPI Adjustments, the County Disposal
Charge increase and the diversion incentive earned by CR &R for 2014 have all been included in the calculation of the
proposed rates listed in this notice.
Future Rate Adjustments
The residential and commercial /multifamily rates in this notice are proposed to become effective July 1, 2015.
Additional annual rate adjustments will occur effective July 1, 2016 and effective July 1, 2017. The adjustments will be
calculated as described above. Prior to implementing those adjustments the City will provide written notice of the
adjustment to all property owners whose property is subject to payment of the solid waste service fees and to any
tenant directly responsible for the payment of such fees. The notice will be mailed not less than 30 days prior to the
effective date of the rate adjustment.
Public Hearing and Protests
Any property owner whose property is subject to the proposed increases to the rates for solid waste services and any
tenant directly responsible for payment for solid waste services (i.e, a customer of record) may submit a written protest
to the proposed rate increases; provided, however, only one protest will be counted per identified parcel. Any written
protest must: (1) state that the identified property owner or tenant is in opposition to the proposed rate increases; (2)
provide the location of the identified parcel (by assessor's parcel number or street address); and (3) include the name
and signature of the property owner or tenant submitting the protest. If the person submitting the written protest is the
owner of record but was not shown on Orange County's last equalized assessment roll as the property owner, that
person must provide written evidence that the person is the property owner. Written protests may be submitted by mail
or in person to the City Clerk at 300 Centennial Way, Tustin, CA 92780, or at the Public Hearing (date and time noted
above), provided they are received prior to the conclusion of the public comment portion of the Public Hearing. If
submitting your protest by mail, please provide sufficient time for it to arrive prior to the close of the public comment
portion of the Public Hearing. Any protest submitted via e-mail, fax or other electronic means will not be accepted.
Please identify on the front of the envelope for any protest, whether mailed or submitted in person to the City Clerk,
Attn: Public Hearing on Rate Increases.
The City Council will consider all written protests and hear and consider all oral comments to the proposed rate
increases and annual rate adjustments at the Public Hearing. Oral comments at the Public Hearing will not qualify as
formal protests unless accompanied by a written protest. Upon the conclusion of the Public Hearing, the City Council will
consider adoption of the rate increases to the City's solid waste service fees and the annual PPI Adjustments, County
Disposal Charge adjustments (if any) and diversion incentive payments to CR &R (if any are earned) for 2016 and 2017 as
described herein. If written protests against the proposed rate increases and the annual PPI Adjustments, County
Disposal Charge adjustments and diversion incentive payments to CR &R are not presented by a majority of the property
owners of the identified parcels upon which the rates are proposed to be imposed and tenants directly responsible for
the payment of the solid waste service fees, the City Council will be authorized to impose the rate increases and annual
PPI Adjustment, Disposal Charge adjustments and cost for CR &R diversion incentive payments as outlined above. If
adopted, the new rates listed in this notice will take effect beginning July 1, 2015.

Scout Service - Scout Service means moving individual Bins containing MSW, Recyclable Materials,
Yardwaste and /or Food Scraps to a centralized location on the property so the Bins can be emptied
by a frontloader vehicle and then returned to their original locations. The Bins are moved by a pickup
truck, motorized utility cart or other similar lightweight vehicle. Monthly rate is calculated by multiplying
the number of bins that require this service by the rate and then by the number of collection days for
this service. -
