Motion carried 5-0. Commissioner Mitzman moved, Lunn seconded, to recommend that the City Council approve Amendment to Vesting Tentative Tract Map 14410 by adopting Resolution No. 3450 as submitted. Motion carried 5-0. 3. Desiqn Review 96-014 and Variance 96-003 APPLICANT: OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: MATLIN DVORETZKY & PARTNERS MR. CHARLES KANE 1602 NISSON ROAD MULTIPLE FAMILY RESIDENTIAL DISTRICT (R-3) THIS PROJECT HAS BEEN DETERMINED TO CATEGORICALLY EXEMPT (CLASS 2) PURSUANT TO THE PROVISIONS OF SECTION 15302 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT 1. TO RELOCATE TWO EXISTING ON-SITE APARTMENT BUILDINGS ABOVE A PROPOSED NEW,. SEMI- SUBTERRANEAN PARKING GARAGE. 2. MIKE MCNEESE, DIRECTOR OF OPERATIONS THE RREEF FUNDS MICHAEL F SEVERSON 1162-1192 IRVINE BOULEVARD RETAIL COMMERCIAL (C-i) THIS PROJECT HAS BEEN DETERMINED CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO THE PROVISIONS OF SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. AUTHORIZATION TO ESTABLISH A HEALTH CLUB WITHIN AN EXISTING TENANT SPACE IN TUSTIN HEIGHTS CENTER. Recommendation -It is recommended that the Planning Commission approve Conditional Use Permit 95-027 by adopting Resolution No. 3441, as submitted or revised. Motion carried 5-0. · Amendment to Vestinq Tentative Tract Map 13908 and Desiqn Review 95-042 - APPLICANT/ OWNER LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: BRAMALEA CALIFORNIA JEFF ROOS TRACT 13908 PLANNED COMMUNITY RESIDENTIAL-ETSP THIS PROJECT IS COVERED BY A PREVIOUSLY CERTIFIED EIR (85-2) FOR THE EAST TUSTIN SPECIFIC PLAN. NO ADDITIONAL DOCUMENTATION IS REQUIRED. AUTHORIZATION TO ADD THREE ADDITIONAL PRODUCTION UNITS TO THE BUILDOUT OF THE EXISTING RESIDENTIAL DEVELOPMENT Recommendation - That the Planning Commission continue this project to the June 10, 1996 Planning Commission meeting to ~allow the applicant and residents additional time to discuss and resolve outstanding concerns. Use Interpretation 96-003 APPLICANT: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: CALIFORNIA PACIFIC HOMES WILLIAM L. MOORHOUS LOT 27, TRACT 13627 MEDIUM-HIGH DENSITY RESIDENTIAL -ETSP THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO SECTION 15303 OF THE CALIFORNIA EQUALITY ACT (CEQA) TO DETERMINE THAT THE FRONT YARD SETBACKS CAN BE MEASURED FROM THE BACK OF SIDEWALK RATHER THAN RIGHT-OF-WAY LINE Recommendation - That the Planning Commission determine by Minute Motion that front yard setbacks shall be measured from the Right- of-Way line as specified in Section 3.6.3.3.a of the East Tustin Specific Plan. Desiqn Review 96-018 APPLICANT/OWNER LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: NEXTEL COMMUNICATIONS 36 AUTO CENTER DRIVE PLANNED COMMUNITY COMMERCIAL THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO THE PROVISIONS OF SECTION 15303 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. 'APPROVAL OF A 60-FOOT HIGH MONOPOLE WITH 5-FOOT HIGH ANTENNAS AND ACCESSORY STRUCTURE. Recommendation - That the Planning Commission approve Design Review 96-018 by adopting Resolution No. 3451, as submitted or revised. Presentation: Rosa Ceja, Assistant Planner Commissioner Vandaveer moved, Mitzman seconded, to approve Design Review 96-018 by adopting Resolution No. 3451 revised as follows: Condition 1.6 shall read, "Prior to the issuance of building permits~ the applicant shall provide to the Community Development Department, documentation issued by the California Public Utilities Commission confirming that Nextel Communications' Enhanced Specialized Mobile Radio (ESMR) is a public utility." Motion carried 5-0. STAFF CONCERNS: ~ Report on Actions taken at the May 20, 1996 City Council Meetinq. - The Director reported on the subject agenda. COMMISSION CONCERNS: Commissioner Lunn Commissioner Mitzman Commissioner Vandaveer - None - None - Asked for an update on the status of the bollard lights at E1 Camino Real and Main Street. Doug Anderson, Traffic Engineer, stated that the Public Works Department is still working on the project. Planning Commission Action Agenda May 28, 1996 Page 7 Commissioner Bone Inquired about the increasing number of blue tarps on the condominium roofs at E1 Camino between Park Center and Tustin Ranch Road. The Director stated that she will find out the re-roofing schedule and report back to the Commissioner. Asked what happened to the proposed project of Al's Woodcraft. Dan Fox, Senior Planner, stated that the Community Development Department will look into matter and report back. Reported that the state of the City luncheon has been sold out and there is now a waiting list. Commissioner Kasalek - None ADJOURNMENT: Commissioner Vandaveer moved, Lunnseconded, to adjourn the meeting at 7:54 p.m. Motion carried 5-0.
