FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - ASPHALT CONCRETE
REHABHJTATION AND OVERLAY PROJECT, 1995-96 (PROJECT NO. 700001)
RECOMMENDATION
It is recommended that the City Council, at their meeting of June 17, 1996, adopt Resolution No.
96-61 accepting said work as complete and authorizing the recordation of the Notice of
Completion, and direct the City Clerk to:
1. Release the I. abor' and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion; and
Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date
of recordation of the Notice of Completion, that the Council authorize payment of the final 10%
retention in the amount of $55,873.86. This amount together with previous payment of
$502,864.76 reple.sents 100% of the final contract amount.
FISCAL IMPACT
The final cost of the construction contract is $558,738.62 which includes one contract change order
in the amount of $43,738.33. This project is funded from the 1995-96 FY CIP Major Maintenance
Program (account number 020400-9999-9530-700001), from the 1995-96 FY Field Services
operating budget for street and alley repair (account number 010-4(X)4030-6245) with an amount
of $13,000.00 and from the traffic signal routine maintenance operating budget (account number
0104004020~. 220) with an amount of $6,380.00.
BACKGROUND
The FY 1995-96 Major Maintenance Program combined the annual asphalt concrete
rehabilitation/overlay and the slurry seal operation in one project. This project included repair and
resurfacing or slurry sealing of various streets between the 1-5 Freeway and Irvine Boulevard, and
between the SR-55 Freeway and Browning Avenue as shown on the attached locations maps.
This work has been completed to the satisfaction of the Engineering Division. The final contract
amount of $558,738.62 represents an increase of 14.6 percent from the original contract amount of
$487,639.00. The increase reflects final field measured quantifies and additional rehabilitated
streets.
Additional streets were resurfaced by a City initiated contract change order in order to help meet
the County's Measure "M' Maintenance of Effort (MOE) requirements.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, ACC~G THE WORKS OF
IMPRO~ AND AUTHORIZING RECORDATION OF
NOTICE OF COMPLETION FOR THE ASPHALT
CONCRETE REHABILITATION AND OVERLAY PROJECT
1995-96 FY (CH' 700001)
WlIERF, AS, All American Asphalt, having a contract with the City of Tustin to construct the
hereinafter described public works and improvements; and
WltEREAS, the City Engineer has duly certified to the construction and completion of said
public improvements, hereinafter mentioned, in a manner satisfactory to the City Council of the
City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions of the
contract documents and the Notice of Completion, and acceptance of said public work and
improvement should be filed and payment of the balance due said contract authorized in
accordance with the contract documents;
NOW, TItEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that
said public work and improvement is found to be complete, and the same is hereby accepted.
Said public work and improvement is more particularly described as follows:
Asphalt Concrete Rehabilitation and Overlay Project, 1995-96 FY (CIP 700001)
AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is
hereby authorized to execute and file a Notice of Completion for the acceptance of said public
works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held
on the 17~ day of June, 1996.
